Well, the First, Fourth, Fifth, Sixth, Eighth, and Ninth are pretty much dead letters anyhow.
I'll give up my Third Amendment rights when they pry my cold, dead fingers from around them!
That's right, go look it up.
Oh? We already restrict and regulate ownership of automatic weapons, short-barreled rifles and shotguns, and who can own a gun. So I guess by your standard, the Second Amendment has already been repealed.
As Scalia said in Heller, the government may restrict the types of firearms the people may keep, as well as who may keep them.
Interestingly, the ONLY right in the Bill of Rights that is restricted for discharged felons and the mentally ill is the Second Amendment. If you were the purist you claim to be, you would be banging on about the right of felons and the insane to own guns.
Rights are removed from felons because they have been convicted of a crime. It is part of their punishment.
Of course the type can be restricted, as full autos have been.....but to my way of thinking, the right extends to weapons that would serve a militia, in other words, straight up fighting guns. The AR 15 is a perfect example of a protected firearm, as it is the semi-auto version of the personal weapon carried by the US military, fires the same cartridge, and takes the same magazines.
I think it would be much more appropriate, and much more in line with the ideals of the constitution to strictly regulate handguns, as they are of little use in warfare. BTW handguns are used in 68% of gun homicides in the USA. Rifles (of all types) are used in just 3% of gun homicides..
