Fox News asked the judge to toss out McDougal's case by arguing that "Carlson's statements were not statements of fact and that she failed adequately to allege actual malice."
Fox News argued that Carlson "cannot be understood to have been stating facts, but instead that he was delivering an opinion using hyperbole for effect," the ruling said
US District Judge Mary Kay Vyskocil agreed with Fox's premise, adding that the network "persuasively argues" that "given Mr. Carlson's reputation, any reasonable viewer 'arrive with an appropriate amount of skepticism' about the statements he makes."

The ruling continued: "This 'general tenor' of the show should then inform a viewer that he is not 'stating actual facts' about the topics he discusses and is instead engaging in 'exaggeration' and 'non-literal commentary.’”
No reasonable person indeed

you mean he is lying?

I mean it almost sounds like the judge and Fox are saying that Carlson doesn't tell the truth.
No. It was a defamation case. If he was lying, the plaintiff would have won.

The judge basically said he was babbling nonsense, and anybody with a functioning brain knew it.

It wasn't Carlson that made the claims - he simply provided the video. Take it for what it is... after all he is a "pundit" who usually uses his opinion & hyperbole to get the information across - you know, so that the Leftists understand what he's actually saying?

Must be why the court officially found only a crazy person would take him seriously.

Exactly! Charge every single Republican who's stolen an election with... something!

Um the Dems have stated for many elections that they lost over the years that the those elections were "stolen" - guess that's ok. Ms. Clinton still says to this day that the 2016 election was "stolen" and no one says a word. How silly are people anyway?

Difference is, there is one case where a court actually did find election fraud, and overturned the result. North Carolina 9th Congressional district, 2108.

Yep, the fraud was committed by Republicans.
