It's because when you declare war you have obligations. We don't want to declare war because then we might have to formally end it at some point, or release prisoners, charge criminals with crimes, or redress the accidental mass murder of innocent people.

Unfortunately, when we declare war on a state we have some idea who our enemies are. But in the case of IS, anybody could be 'radicalized' and join up, even our own citizens. We still have a legal obligation to citizens whether at war or not. The government is trying to work around this by devaluing Canadian citizenship and creating a second class. It wouldn't have applied to this guy (if he had gone to Syria or Iraq), so say Omar Khadr, but it's an excellent start. Soon the problem of not declaring war but not being able to try citizens with treason will be washed away.
