The traditional rule is "If you voluntarily intoxicated yourself, you are responsible for what you did while intoxicated."

The way to go is to stamp out the approximately-conservative "He was just drunk" excuse, not to allow intoxication to be an excuse.

Drunk? High? Addicted? Don't care. Unless you can prove, as an affirmative defense (which means the defendant must introduce it and the burden of proof is on the defendant) that you were involuntarily intoxicated (basically roofied or otherwise poisoned), no dice.
Not in Canaduh. This just came about in the last couple of weeks. Being too drunk(high) to know what you are doing is now a legit defence in some instances. The article I read didn't go on to explain the instances.

Some years ago in Canada a Liberal govt tried this crap before. The fact that drunk drivers could potentially use it as a justifiable defence is what put the kibosh on it.

Interesting. Do you think you could "talk someone down" who is armed and walking into a school or mall who has the explicit, determined intent of killing as many people as possible?

I completely understand that in the interest of ignorant simplicity, many people focus on the gun when something like this happens. No doubt...it's very easy and convenient to blame a tool designed to kill for the carnage when this happens. It's almost as easy as the president standing up an hour later and addressing the nation while the bodies are still warm to politically divide people instead of uniting them and deliver tired old political talking points to try and grab more power and control over good people who are hurting. But these empty platitudes and partisan political maneuvers won't help the problem, not a bit. Someone with intent like this will absolutely find a gun, whether it be legally obtained or illegally... or in the absence of a gun will use a vehicle, a knife, a can of gasoline and a match...or any number of options available to carry out their task.

Serryah...I'm genuinely interested to know what you think the real problem is, and what you see might move us to a solution.

If two school shootings involving kids under ten isn't a sign to 'move to a solution', then there IS no desire to move anyone to a solution.

So I'll just go back to "Move along, nothing to see here, kids died, so what, who cares" because that is the prevailing general thought to a lot of those in the US (or, well, a lot of more monied people in the US anyway and they are all that count nowadays).

Nothing. It's become a culture-war issue. Republicans will accept no restrictions on guns other than those that already exist, and will try to eliminate them.

What would make sense would be for Democrats to offer a nationwide concealed-carry permit, with stringent conditions to get one.

What would make sense would be for Democrats to offer a nationwide concealed-carry permit, with stringent conditions to get one.

Sure, but to do that they'd either have to have Biden go alone with an Executive Order and see it challenged right away, most likely, or make it a 'law' and the Dems don't have a chance in Hell because, Republicans.

The chance they had was during Obama's tenure, they didn't take it, and they are as much as at fault as the R's for this.

Okay, so you are unable or unwilling to identify the problem or put forward any potential solution... only offer a rhetorical sarcastic criticism of the lack of caring and action by others. Not much help...but I honestly don't blame you. It's a complex and difficult problem, isn't it?

I've got a practical solution that would permit ownership of guns and meet all the reasonable desires of gun owners and would-be gun owners, whilst still making huge dents on both mass shootings and the instrument of about 95% of all gun homicides in the U.S. (handguns).

Why bother? The chances of passing it are slim and none, and Slim left town.

As I said above, it's become a culture-wars issue. Everybody's yelling, nobody's listening.

Solved illegal immigration, too. Nobody cares about that either.

Yeah, why bother? It's not like having rational practical discussion in a functioning democracy will do any good. It's just not worth the effort.

Besides, it's much more self-satisfying to jump on the internet and screech and complain about it, now that's progress.
