Over the years courts have declared many things. Not all of them are right and not all are believed by the populance. ANd not all countries have agreed to all laws either.

Sex and gender are not the same thing.
As for this question, IMO I think a sex based gender should be assigned at birth, but should be changed later when the person is old enough to know the difference between the gender assigned at birth and who they truly are, if it's applicable.
