Admit to a DUI charge?

To the people here who have such good advice I have a question...

If OMG had remained in the car and called the police giving them his location asking for assistance, would it have been a better choice than leaving the scene?

Anyone know how the law enforcement would have viewed it?
Worse. Then the charges would be "negligent driving", "DUI", and "failing to produce a license".

I think that all hinges on how impaired he was. I think impaired driving pretty well trumps all other driving charges where there was no injuries or fatalities. If he was under .08 I'd say yes, over .08 definitely no.

Last I heard, Canada has a 0 tolerance for blood/alcohol levels and that came down from .05

WOW - OMG I hope the night out was worth it before all that stuff happened.... a "night to remember" no doubt.

What a shame to have to learn life's lessons this way.

Last I heard, Canada has a 0 tolerance for blood/alcohol levels and that came down from .05

I agree with that, you can be charged with impaired driving at any level at the descretion of the cop, but over .08 is especially bad and a lengthy suspension is mandatory- under .08 can result in a 24 hour suspension but no charges usually.

Lucky, I've never had a DUI or any traffic offenses but one thing you do not do is admit to anything, because for all you know you might be under the legal limit.

My advice for your best chances are to take the alcohol test in jail that way it gives you time for the alcohol to leave your blood system. They are going to arrest you anyway under suspicion anyway so play the game carefully. Wouldn't matter anyway my neighbor has 9 DUI's and still retains his liscense.

I can understand the situation in front of the Police of whether to cooperate or not, that's why I just say "I don't drink" no matter how drunk I am, proven or not. Yeah it's a lie, but the main reason why I have never had a DUI is because I DO NOT DRINK AND DRIVE!

Yeah, and I hope when you eventually kill someone, you are charged with aggravated murder.

In Canada you can't get under the legal limit. 0 is 0

I doubt the cops will charge OMG with DUI because he is likely quite sober by now.

I do. Coffee or juice most of the time. No alcohol unless it's on my garden tractor.

You can "safely" drink 2 glasses of wine with dinner and drive home. For my self, I don't drive if I've had anything to drink................but that's changed in the past 40 years -at the that time we'd open the bar about 9 in the morning on Saturday in Revelstoke and drive home sometime after midnight- had to, too drunk to walk. You just don't do that sh*t anymore.

Yeah, I might have 2 glasses of beer or wine in maybe 4 hours. I guess the zero tolerance thing was just a fantasy of MADD's.

I used to drive a little red tractor as a kid. Can I be your hero? Farm came with a white horse I called pegasus...If that's all it takes. ;-)

Sorry, Drunk as usual as a man should be. Keeps us out of trouble, just maybe not on the road though. he he...:smile:

I agree with DurkaDurka. Keep your mouth shut, contact a lawyer ASAP and follow their advice. That's why you pay them.

Luckily no one was hurt. (I'm assuming) You are responsible for all damages resulting from your fender bender. I'd contact the other person and offer to settle out of court. Admit nothing, just offer to pay damages out of the kindness of your heart.

Drinking and driving is a felony and has potentially serious consequences including fines and jail time. If convicted you will have a criminal record and will be denied entry to other countries (USA). Leaving the scene of an accident can be similarly serious. That said, you may be able to get a deal through your lawyer. Often the courts aren't out for blood and most Canadian judges are known to exercise good judgment. Expect that you will face consequences appropriate for your actions.
