OTTAWA — Canada’s Federal Court needs information the government claims is secret to properly review whether the first use of the Emergencies Act — to end the so-called “Freedom Convoy” protests this winter — violated constitutional rights, civil liberties groups say.

The groups made their case before Justice Richard Mosley on Monday, while the federal government responded that the information they seek falls under the established principle of cabinet confidentiality. A government lawyer described one group’s efforts to obtain documents as a “classic fishing expedition” based on speculation.

The case comes as Prime Minister Justin Trudeau’s Liberal government has pledged to be open about why it invoked the Emergencies Act to deal with protesters who occupied the streets around Parliament Hill for about three weeks in January and February to voice opposition to the Trudeau administration and COVID-19 health measures.

In June, amid calls from the opposition to waive cabinet confidentiality, the government pledged to provide all “inputs” cabinet used to make the decision to a public inquiry investigating the affair. A spokesperson for the inquiry said Monday it is working with the government to obtain relevant documents, including from the federal cabinet.

The Privy Council Office — the branch of the civil service that support’s the Prime Minister’s Office — also told the Star last month that it would provide requested cabinet confidences to a parliamentary committee studying the use of the Emergencies Act. Matthew Green, a New Democrat MP who is co-chair of the committee, told the Star Monday that the body had not yet received any such documents, etc….

Arguing transparency over what they allege is needless secrecy, a Canadian civil rights organization took their fight for document disclosure surrounding February’s Emergencies Act invocation to court on Monday.
“We are here because the government has left us no choice to try and get the truth.”

Public Safety Minister Marco Mendicino and senior RCMP officers are defending the national police force's years-long and previously undisclosed use of spyware—capable of remotely accessing cell phone and computer microphones, cameras and other data—as part of dozens of major investigations.

Specifically, it was revealed that the amount of years and number of investigations in which these techniques have been deployed expanded beyond what had previously been reported to Parliament, and that to date the RCMP has not consulted with Canada's privacy commissioner about its use of spyware to essentially hack into electronic devices.

Justin & the Lib’s withdrew the use of the Emergencies Act the morning of the day that the Senate would have been able to Wade in on it. The below is from a Canadian Senator. Coincidence?

A quick history lesson: the Emergencies Act is heir to the War Measures Act (WMA), which was passed in the days after the declaration of the First World War. The WMA was also invoked by the federal government to send the military into Quebec in the 1970 October Crisis.

But it was a blunt instrument that was not well suited to a domestic crisis and so the Emergencies Act was passed in 1988 by a Progressive Conservative government, providing greater specificity on when and how it could be used along with substantive oversight and accountability mechanisms.

The Emergencies Act requires a situation that “seriously endangers the lives, health or safety of Canadians” or that “seriously threatens the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada.”

It is difficult to understand how anyone could say that the Ottawa protest came close to this threshold. Was it inconvenient, stressful, and at times annoying for those living and working in downtown Ottawa, including parliamentarians? Without a doubt. But it is ludicrous to suggest our sovereignty was in peril.

A third criterion says the act can only be used if there is no existing law that can deal with the situation. Ticketing and towing illegally parked vehicles is not digging very deep into the law enforcement toolkit. It happens just about every day and in every city in Canada.

People can also be charged with any number of bylaw and Criminal Code offences for disruptive behaviour, obstruction and illegal assembly.

Instead, the City of Ottawa and the Ottawa police sought out private property to facilitate trucker access to Parliament Hill — in at least one case over the objection of the site owner. Signs on Highway 417 directed protesters to the appropriate exit. The police set up barricades for them.

The Emergencies Act does not consider incompetence and inaction to be grounds for its use

Many who disagreed with the protesters resorted to vilifying them, presenting a handful of extremists as representative of the group who, in the words of the prime minister, hold “unacceptable views.”

It is this sort of speechifying that sparks anger and division in this country. And it obscures the fact that thousands if not millions of Canadians were sympathetic to Canadian truckers who had been on the front lines delivering goods that kept grocery store shelves stocked for the first two years of Covid. There was no compelling reason to abruptly change the rules to mandate vaccinations for those who crossed the Canadian border.

We are coming out from a brutal pandemic. People have lost income and jobs. People have lost loved ones. Billions have been spent wisely and billions more have been wasted. The country remains on edge. Thus, there are many legitimate reasons to review and criticize the federal response to the pandemic, including the invocation of the Emergencies Act without just cause.

It may be comforting for members of the federal government to imagine that everyone who disagrees with them is part of a deplorable, lawless mob. First, they would be wrong. Second, this is no justification for appropriating such sweeping powers unto themselves and the predictable abuse that followed.

Questioning our leaders and holding them to account — even through protest — is a right that belongs to all Canadians. And no government of the day can abrogate those rights because of incompetence, scapegoating, or political expediency without themselves being held accountable.

The surprising revelation is contained in a package of cabinet-level documents, previously marked secret, describing the discussions that took place in February as the cabinet weighed how to address a flurry of highly disruptive protests across the country that were primarily focused on opposing COVID vaccine mandates.


The documents are heavily redacted and there is no detailed explanation in the non-redacted sections related to the reference of a potential breakthrough.

Virtually ALL of the remaining minutes describing the meeting are redacted.

Conservative and NDP MPs said Thursday that the revelation of new details in court, coupled with heavy redactions, shows the government is not being transparent in defending its use of the act.

“The revelation that there was a potential breakthrough in negotiations the day before the Trudeau government used the Emergencies Act raises serious questions about the Liberal’s claim that the Emergencies Act was used as a tool of last resort,” said Conservative House Leader John Brassard, adding that it provides “further proof” that the government’s focus was on solving a political problem.

NDP MPs Alistair MacGregor and Matthew Green issued a joint statement saying that while the NDP supported the use of the Emergencies Act, revelations of a potential breakthrough show “a clear failure of the Liberals to be transparent with Canadians and parliamentarians.”

The NDP also questioned why the documents were released to the Federal Court, but not to parliamentarians reviewing the issue.

The move to invoke the act was supported by the federal NDP but was opposed by Conservatives and the Bloc Québécois.

The Canadian Constitution Foundation said it in a statement to The Globe that “the evidence filed by the government on whether it met the legal requirements of the Emergencies Act is grossly inadequate.”

Trudeau wanted a fight with the unruly crowd who had occupied the streets outside of Parliament in late January and early February and there was no way he’d let a negotiated settlement get in the way of that.

The Toronto Star first reported on Thursday that cabinet documents, filed in Federal Court, show that the PM’s national security advisor, Jody Thomas, said a deal was possible. That was at the cabinet meeting called on Sunday, Feb. 13, at 8:30 p.m., where the decision to invoke the Emergencies Act was made.

The next afternoon, Trudeau made the announcement official.

“This is about keeping Canadians safe,” Trudeau said.
Not really. This was about keeping Trudeau’s political fortunes safe. Trudeau knew that the overwhelming majority of Canadians didn’t support the convoy’s ongoing presence in Ottawa, or the blockades of border crossings.

The line from the Trudeau government now is that the potential for a breakthrough was due to negotiations between local city officials and convoy organizers. We’re told those talks were unsuccessful and that’s why the Emergencies Act was invoked.

Let me be clear, there is no chance that Trudeau would ever have been seen negotiating, talking to, even accepting the surrender of the convoy protestors. This is the group he denounced as racists and misogynists before they ever set foot in Ottawa.

His entire attitude toward this protest was to pick fights for political gain.

The idea that there was the possibility of a breakthrough sounds nice, quaint even, but it was never going to happen.

In all honesty, initially this trucker convoy was clean and honourable thing….grass roots movement, etc…. but before they got to Ottawa it was obvious that these guys were going to turn into political scapegoats.

After the first weekend with our Prime Minister in hiding….The point was made and it was time to go. Full Stop & where’s the Exit. Done Deal. After that first weekend it was like drunk company that can’t find their shoes or remember how to call a cab.

Was the Emergencies Act needed or necessary? Nope. Could Justin Trudeau stay in hiding for more than a few weeks? Nope. The protest should’a stayed the first weekend & rolled out on the Monday but that’s not how it played out, & Justin capitalized on opinion polls instead of sound judgement and good government…& here we are.

Crowds of people opposed to COVID-19 vaccinations clogged the streets of Vancouver and demonstrated outside hospitals across B.C. on Wednesday afternoon, earning the indignation of some political leaders.

According to police estimates, thousands of demonstrators gathered outside hospitals in Vancouver, Kelowna, Kamloops, Victoria, Prince George, Nanaimo and in other Canadian cities.

The protests were organized by Canadian Frontline Nurses, a group founded by two Ontario nurses who have promoted conspiracy theories about COVID-19 and attended rallies in the U.S. for those who think the pandemic is a "fraud." In posters for the event, dubbed "worldwide walkout," the group urged supporters to "stand up for freedom" and "reject the tyranny of mandatory vaccines."

Nursetards were protesting nursetards? What were nursetards demanding from other nursetards?
