That's why we need to have a trial - only then do we know for certain that he is guilty of any such crime.
We don't even know if there is enough evidence to warrant going to trial yet.

You might consider Obama an expert negotiator compared to the Israelis. They exchanged 1,027 prisoners to get just one guy, Gilad Shalit.
Yep.
Why do you think Hezbollah and Hamas are always trying to kidnap members of the IDF??
Bad move.
... I don't care if the guy is a deserter or not, the USA had a long standing rule to not to negotiate with terrorists.
I'm glad he is back, but God help the citizens of the USA from future terrorist attacks..

An american soldier is an american soldier, and they don't leave any man behind for any reason.
I know the French have, in the past, done shady deals with the enemy to have their captured troops released.
Now the Yanks are at it.
Britain doesn't do such deals with people who hold her troops or her civilian citizens prisoner (all British governments follow that rule). She just sends in the boys to rescue them, usually the SAS but sometimes just ordinary troops - even if it means flattening the building where the prisoners are held and killing the captors.
A famous example was the Iranian hostage siege in 1980.
Another one was the Basra prison incident of 2005.
In September 2005 two SAS officers were arrested by Iraqi police and taken to the Al Jameat police station in Basra.
British tanks encircled the jail where the men (whose photographs have been widely circulated but whose names have not been made public) were being held. A crowd gathered and began throwing stones and petrol bombs at the tanks, setting at least one ablaze. Three British soldiers were injured and, according to some reports, two demonstrators were killed.

After nightfall, the British army returned and stormed the prison where the SAS men were being held, breaking down the walls and freeing the two SAS men. According to the governor of Basra province, Mohammed al-Waili, the British had used "more than ten tanks backed by helicopters" to carry out the raid. After the British army left, around 150 other prisoners fled the prison.
On 25 December 2006, British troops again raided the Al Jameat station, killing seven gunmen and freeing 127 prisoners being held by Shia militias there. They then blew up the building.A British Army spokesperson stated that the 127 prisoners freed had been tortured and that there were fears that they were about to be executed.

So the operation was to liberate terrorist SAS insurgents.
No. It was to rescue two bloody heroes.
These are not heros, these are dirtbags nobody but a imbecile would invite to lunch. You know that type preys on the innocent forigners or it preys on the home front. Guess why they are selected. No it isn't cuz they're heros. Hero's don't murder the innocent.

I bet they thanked their lucky stars they were British. Had they been Canadians I'm assuming they'd have been left to fester in the prison by the liberal fairies who run your country and military.

THE HEROES WHO WERE RESCUED BY ANOTHER BUNCH OF HEROES
did he desert his post?
What do any of his actions have to do with his value in a trade like this?
An american soldier is an american soldier, and they don't leave any man behind for any reason.
I just listened to two sergeants from his platoon call him a deserter.......that makes three NCOs that were there publically accusing him of desertion.
Yeah, I think there is evidence.
The Canadian 'Heros' would have gone kicking a$$ and taking names and had this thing done in 10 minutes.
... Just like we did for you in 2 WWs
How about a trade of some foot soldiers that are in GITMO instead of the 5 top Taliban commanders?
If they could have given up nothing to get him back, I'm sure they would have preferred that even more.
I know the French have, in the past, done shady deals with the enemy to have their captured troops released.
Now the Yanks are at it.
So they caved and gave the Taliban exactly what they wanted. What a great negotiator Obama is!
Based on what? Do you have any information on what their initial demands were?
