Because they decided to try all of them in New York City where some of the finest lawyers in the world will defend them for free. (Columbia Law School, Fordum, City University School of Law, St, Johns. etc.) There will literally be hundreds of new law students wanting to make a name for themselves. In this case new will be good for them.

But this will no doubt be a Federal Trial which would be different from a NY state trial.

However you are correct...these guys will get a dream team...the best defense lawyers in the country will come out to defend these guys just to have their faces on TV.

BS. The Taliban had no interests outside Afghanistan. Give me an example of the Taliban threatening Canada or the US, let alone attacking the US or Canada. The US had a reason to attack people suspected of being involved in 9./11, but they had no justification supporting their attack of the Taliban.

Totally correct. The Taliban have no fight with the West, just like the PLO and Hamas who have their fight with Israel and not the West. Part of the war on terror on has been to convince people that a terrorist attack on Israel is an attack on the West.

The Taliban, being good Muslims, just want to kill other good Muslims in Afghanistan. I say let'em.

Why?

What was our mission in Afghanistan? Did it include supporting a government which maintains power by election fraud? Are we there to ensure corrupt people get their bribes and kickbacks? Why are Canadians dying in Afghanistan?

When NATO went into Afghanistan they were looking for al-Qaida who were being supported by and protected by the Taliban. That is the reason we are good and they are bad.

The Taliban are not accused of abducting innocent civilians including children and then putting them in pits in front of their tanks and artillery positions or standing behind their human shields and fire over their shoulders or have their human shields stand in front of them as they fire between their legs at their enemy. That's how Israel uses people as human shields, in the literal sense.

Also, the Taliban are accused of not allowing civilians to flee the area of fighting, by the Pakistan government which is hardly an objective third party. But assuming these claims are true, that would make the Taliban guilty of doing the same thing as Israel and Egypt. Israel built a wall around Gaza and refused to let Gaza civilians flee as they pounded densely populated areas with heavy artillery, white phosphorus and flechettes. So yes what the Taliban are accused of doing would be a war crime.

BTW, why aren't you as skeptical of this Pakistan government report as you are of the UN Fact Finding mission? You have different standards of proof depending on who is accused.

HRW accuses the Taliban of laying mines on the roads, which prevents civilians from fleeing. That doesn't sound like they are purposely preventing civilians from fleeing but creating a defensive perimeter.

Also it appears the Taliban aren't the only ones preventing civilians from fleeing the fighting:

...Residents of South Waziristan recently told Amnesty International that they had fled military operations in the mountainous areas of Ladah, Makin and Zahwarr.

They said they were forced to travel through often treacherous mountain roads because the military has blocked the main roads in the area.

The road blockades have aggravated local food shortages, also spurring people to leave their homes...

So the Pakistan government is doing almost the same thing and HRW accuses both sides of committing war crimes.
