You think Harper just would override a firm judicial decision on our turf?

Wow.. If you look carefully, the post I referred to the Federal gvt having the opportunity had to do with Northern Gateway (and Energy East). I assumed you understood that NG was entirely on Canadian soil as you posted some poll about how BCers didn't support it.

So, you changing on the fly here and not telling anyone?

Northern Ontario,
The power to take private property for public use by a state, municipality, or private person or corporation authorized to exercise functions of public character, following the payment of just compensation to the owner of that property.

Federal, state, and local governments may take private property through their power of eminent domain or may regulate it by exercising their Police Power. The Fifth Amendment to the U.S. Constitution requires the government to provide just compensation to the owner of the private property to be taken. A variety of property rights are subject to eminent domain, such as air, water, and land rights. The government takes private property through condemnation proceedings. Throughout these proceedings, the property owner has the right of due process.

Eminent domain is a challenging area for the courts, which have struggled with the question of whether the regulation of property, rather than its acquisition, is a taking requiring just compensation. In addition, private property owners have begun to initiate actions against the government in a kind of proceeding called inverse condemnation.

They should run that survey up in FSJ.

I'm wondering what with the big turn down in global consumer confidence and a pending planetary war if their isn't more to this stalling by the Americans. Maybe the demand isn't there or maybe denial of motor fuels has some utility.

an interstate highway system was built using, guess what? eminent domain.
And who owns the interstate highway system? TransCanada?

Try to wrap your head around the difference between public and private ownership.

Ultimately, however, you're right under the current state of the law. See Kelo v. New London, 545 U.S. 469 (2005).

If you live in Eastern Canada or US this is what you're paying for when you tank up.

Farting in a barrel sounds like a lot of fun.

Anyway, I am sure this ruling will be appealed at a higher court. And then we can enjoy the same roller coaster we have had in politics.

There are no property rights in Canada.

I get four cheques a year from SaskPower, SaskTel, SaskEnergy and CNR for crop losses. You can't say no to right of ways deemed right of ways by the Province or Feds.

In the meantime, we can enjoy the Canadian Feds approving the 2 major pipelines to the East and West coasts.

Lotsa jobs gonna be created in Ontario, Que, the East coast and BC... A real vote winner for Harper, non?
