Judge in Las Vegas dismisses case against Cliven Bundy, 2 sons

A federal judge dismissed felony conspiracy and weapons charges Monday against Bunkerville rancher Cliven Bundy, two of his sons and an independent militia member.

U.S. District Judge Gloria Navarro, who granted a mistrial in the case last month, said Monday’s decision was based, in part, on “flagrant prosecutorial misconduct.”

“A universal sense of justice has been violated,” Navarro said.

Bundy stepped out of jail-issued clothing for the first time in nearly two years, donning a cowboy hat, babyblue button-down shirt, gray sport coat, blue jeans and brown boots and left the federal courthouse in Las Vegas with his arm around his wife, Carol.

“I’ve got my sweetheart beside me. I’m feeling pretty good. But I’m not used to being free. I’ve been a political prisoner for right about 700 days today,” he said, after having been in federal custody since Feb. 10. “I come in this court an innocent man, and I’m going to leave an innocent man.”

Prosecution weighs next steps

First Assistant U.S. Attorney Steven Myhre, the lead prosecutor on the case, declined to comment on the decision as he walked out of the courtroom, but shortly afterward, newly appointed Interim U.S. Attorney Dayle Elieson released a statement: “We respect the court’s ruling and will make a determination about the next appropriate steps.”

Attorney Bret Whipple, who represents Bundy, said his client wiped away tears after the decision.

“He’s just ecstatic about the results, and we’re glad he’s finally going home,” Whipple said outside the courtroom.
As Carol Bundy waited for her husband’s release, she said, “It’s just a good day to have a good day. God blessed America once again.”

The Bundys were met at the entrance of the Lloyd George U.S. Courthouse by a crowd of reporters and cheering supporters.
“Freedom,” one man bellowed.

People who should be in jail or prison get off freely while others who do nothing are incarcerated.

Bundy et all should be in jail for the rest of their lives and should be paying back the money they owe.

But of course we can't have that, can we?

Sessions apparently started a DOJ investigation into the government improprieties, based on a whistle blower memo, this scared the judge to declare as she did.

the BLM, and all the law enforcement and prosecutional people were caught being crooked as shit.

Sometimes Justice just doesn't work.

BLM investigator alleges misconduct by feds in Bundy ranch standoff

A scathing memo from the lead investigator who assessed how federal officers handled the 2014 armed standoff with Nevada rancher Cliven Bundy accuses agents of far-reaching misconduct, recklessness and unrestrained antipathy toward the family.

The 18-page document, obtained Thursday by The Oregonian/OregonLive, is dated Nov. 27.

Prosecutors shared it last week with defense lawyers for Bundy, his two sons and co-defendant Ryan Payne as they were in the midst of their conspiracy trial, but it's not part of the public court record.

The memo prompted Cliven Bundy's lawyer to file a motion early Monday to dismiss the case, already in disarray over concerns raised previously about the government's failure to promptly share evidence with the defense.

The judge sent the jury home for more than a week as she tries to sort out the claims and prosecutors scramble to save their case.

The memo comes from Larry Wooten, who had been the lead case agent and investigator for the U.S. Bureau of Land Management after the tense confrontation outside the patriarch's ranch near Bunkerville. Wooten also testified before a federal grand jury that returned indictments against the Bundys. He said he was removed from the investigation last February after he complained to the U.S. Attorney's Office in Nevada.
