Jerry Morin, the last of four Alberta men charged with conspiring to murder Mounties during the Coutts border crossing blockade to seek bail, will remain behind bars with his alleged co-conspirators, a judge ruled Monday.


Court of Queen’s Bench Justice Johnna Kubik ruled Morin’s lawyer, Greg Dunn, had failed to establish grounds to have his client released pending trial.

Under the Criminal Code the Crown has the onus in most cases to establish why an accused should be detained, but for a few select charges, including conspiracy to commit murder, that onus shifts to the defence.

At Dunn’s request Kubik imposed a publication ban on the application, which includes her reasons for denying bail.

She also granted a request by Crown prosecutor Matt Dalidowicz that Morin have no contact with 11 of the 12 people the accused was arrested with on Feb. 14.

Dalidowicz said there had been an interim no-contact order put in place Feb. 15 that Morin have no contact with all 12, which included his significant other, Jaclyne Martin, but the prosecution was not seeking to further block contact by the couple.


“I think that’s a good exception given the circumstances of their relationship,” said Kubik.

“I think it’s not unreasonable for him to have some comfort while he’s incarcerated.”

Morin is charged along with Christopher Lysak, Anthony Olienick and Chris Carbert with conspiracy to murder members of the RCMP who were policing the border protest at the Coutts crossing into Montana in February.

The blockade crippled the international crossing for more than two weeks as truckers and others blocked the highway linking Montana and Alberta in protest of public health measures put in place to combat the COVID-19 pandemic.

Morin was arrested after a police raid on three trailers on a Coutts property yielded a cache of weapons and ammunition.


Police said they found 13 long guns, handguns, multiple sets of body armour, a machete, a large quantity of ammunition and high-capacity magazines.

Martin and eight others face lesser charges and have been released on bail.

Morin appeared in Lethbridge court via video link, sporting a large sliver chain and large cross.

He did not address court during the proceedings.

The two lawyers also appeared by WebEx as Kubik read her reasons in the courtroom.

Morin, Lysak, Carbert and Olienick are scheduled to face a three-week jury trial in Lethbridge to begin June 12, meaning they’ll have spent 16 months behind bars before their hearing unless their lawyers can successfully appeal their detention orders at the Alberta Court of Appeal, or have a review of their orders based on a change of circumstance.

Advisers to the U.S. Centers for Disease Control and Prevention (CDC) on Tuesday voted unanimously to recommend use of Novavax Inc’s COVID-19 vaccine for individuals aged 18 and above.


The shot has been endorsed by the CDC’s Advisory Committee on Immunization Practices (ACIP). CDC Director Rochelle Walensky still needs to sign off on the recommendations before the vaccine can be made available in the United States, and the shot may not be immediately ready for rollout.

The U.S. government has secured 3.2 million Novavax vaccine doses, but is waiting for the company to finish quality testing before they can be released. Novavax hopes to finish testing in the next few weeks.

The vaccine was authorized by the U.S. Food and Drug Administration last week as a two-dose primary vaccination series, becoming the fourth COVID shot to be authorized for use in adults in the United States.

Novavax hopes its protein-based shot can reach wider acceptance among vaccine skeptics, because it uses an older technology than the messenger RNA vaccines. Protein-based vaccines have been used for decades to combat diseases including hepatitis B and influenza.


More than 77% of U.S. adults have been fully vaccinated with shots from Moderna Inc, Pfizer-BioNTech , or Johnson & Johnson.

With the Novavax shots, “we really need to focus on that population with the hope that (the new shot) will change them over from being unvaccinated,” Dr Oliver Brooke, one of the ACIP voting members said.

In a 30,000 participant clinical trial conducted before the emergence of the vaccine-evasive Omicron variant, the two-dose vaccine was around 90% effective at preventing illness from COVID.

In July, Novavax said the vaccine shows broad immune response to currently circulating variants, including Omicron subvariants BA.4/5.

Serum Institute of India, company’s manufacturing partner, received FDA approval last week to export the vaccine to the country.


The Novavax shot has been available in Europe since December, but there has not been significant demand for it there. More than 13 million doses of the vaccine have been distributed around the EU, but only around 250,000 doses of the vaccine have been administered there.

Last week, the European Medicines Agency identified severe allergic reactions as potential side effects of the shot while the U.S. product label warns against administering the shot to people with a history of allergic reactions to any components of the shot.

Novavax has been testing updated vaccine based on the first BA.1 Omicron variant and expects it to be available by the fourth quarter.

The company has also accelerated development of shots to protect against the BA.4 and BA.5 subvariants and expects additional preclinical data on such in late summer or fall.

Polio case found in New York City suburb, state agency says

A case of polio has been identified outside New York City and confirmed by federal health officials, the New York State Health Department said on Thursday in what would be the nation’s first known case of the disease in at least thirty years.



Testing suggested the Rockland County case of the highly contagious virus may have originated outside of the United States, the department said in statement.

“We are monitoring the situation closely and working with the New York State Department of Health and the Centers for Disease Control and Prevention to respond to this emergent public health issue to protect the health and wellbeing of county residents,” Rockland County Health Commissioner Patricia Schnabel Ruppert said in a statement.

The CDC, which confirmed the case, has said no cases of polio have originated in the U.S. since 1979. However, the virus has been brought into the country by travellers with polio. The last time this happened was in 1993, it said.

TORONTO — The carcasses of thousands of migrant seabirds have washed up on the shores of eastern Canada this week and preliminary findings showed that the birds died of avian flu.


Since May 2022, the Canadian Food Inspection Agency has confirmed 13 positive cases of highly pathogenic avian influenza in Newfoundland and Labrador.

Environment and Climate Change Canada is conducting more investigations to confirm that the seabirds deaths are linked to avian flu, Peter Thomas, wildlife biologist for the centre said.

Dead herring gulls, Iceland gulls, common ravens, and American crows are the among the most affected by the influenza, Thomas added.

According to the Canadian Wildlife Service, the avian influenza virus is contagious and can affect domestic and wild birds throughout the world.

Canadian Wildlife Service is working closely with the provincial government of Newfoundland and Labrador, as well as the Canadian Wildlife Health Cooperative to contain the spread.


The highly pathogenic avian influenza has also been spreading rapidly in Vancouver Island, the British Columbia Society for the Prevention of Cruelty to Animals said, infecting birds like great horned owls, bald eagles, great blue herons, ducks and geese, and even crows.

“Every day I receive phone calls saying 10 are dead,” Elizabeth Melnick, of Elizabeth’s Wildlife Center, B.C., said.

“Wildlife centres in the country usually choose to save the dying ones as dead ones are picked up by the city,” she said.

According to the World Organisation for Animal Health, avian influenza is a respiratory pathogen that causes a high degree of mortality and becomes a serious threat to the poultry industry. It is naturally spread among wild aquatic birds worldwide and can infect domestic poultry and other bird and animal species.

According to the Canadian Food Inspection Agency, pet birds can be infected by avian influenza and spread the disease to humans, so wild birds should not be handled when they are sick or dead.

FORT SMITH, N.W.T. — Parks Canada says it is monitoring an anthrax outbreak in remote areas of Wood Buffalo National Park.

The agency says staff have observed at least 59 bison carcasses in the park and the deaths are suspected to be caused by anthrax, which mainly affects hoofed animals.

The bacteria that causes anthrax occurs naturally in the soil, which bison can contract from wallowing in dust baths.

A lab has confirmed the presence of anthrax in three of the dead bison.

The park, the country’s largest national park, stretches from northeastern Alberta into the Northwest Territories.

Parks Canada says resource conservation staff are conducting daily flights to monitor the extent of the outbreak.

A national incident management team is assisting with the disposal of carcasses.

It says risk to the public remains low and road-accessible visitor facilities remain safe.

Blacklock’s Reporter says Bloc Quebecois MP Kristina Michaud — a public safety critic critical of the fed’s use of emergency powers against the Freedom Convoy — will be the only Québec MP to lose her riding under federal redistricting recommended by the Electoral Boundaries Commission.

In a report Friday, the commission said Michaud’s riding — Avignon-La Mitis-Matane-Matapédia — should be eliminated due to a decline in population.

Michaud said of the convoy occupation that “someone in a hot tub in the middle of Wellington St.” hardly posed a threat to national security.

“Gaspesie will lose a Member of Parliament,” wrote the Commission, adding the recommendation was nonpartisan.

The report pointed out her riding’s population during the last 10 years has shrunk 6% — from 74,547 electors to 70,253 and was “the least populated of all the electoral districts in Quebec.”

Instead, the province will keep its current 78 seats with a new riding north of Montreal in the Laurentian Mountains, to be called Les Pays d’en Haut.

Michaud did not comment.

National redistricting under the Electoral Boundaries Readjustment Act will see the Commons grow from 338 to 343 seats.
