Fourth Coutts blockade suspect charged with conspiracy to murder denied bail

Jerry Morin, the last of four Alberta men charged with conspiring to murder Mounties during the Coutts border crossing blockade to seek bail, will remain behind bars with his alleged co-conspirators, a judge ruled Monday.
Court of Queen’s Bench Justice Johnna Kubik ruled Morin’s lawyer, Greg Dunn, had failed to establish grounds to have his client released pending trial.
Under the Criminal Code the Crown has the onus in most cases to establish why an accused should be detained, but for a few select charges, including conspiracy to commit murder, that onus shifts to the defence.
At Dunn’s request Kubik imposed a publication ban on the application, which includes her reasons for denying bail.
She also granted a request by Crown prosecutor Matt Dalidowicz that Morin have no contact with 11 of the 12 people the accused was arrested with on Feb. 14.
Dalidowicz said there had been an interim no-contact order put in place Feb. 15 that Morin have no contact with all 12, which included his significant other, Jaclyne Martin, but the prosecution was not seeking to further block contact by the couple.
“I think that’s a good exception given the circumstances of their relationship,” said Kubik.
“I think it’s not unreasonable for him to have some comfort while he’s incarcerated.”
Morin is charged along with Christopher Lysak, Anthony Olienick and Chris Carbert with conspiracy to murder members of the RCMP who were policing the border protest at the Coutts crossing into Montana in February.
The blockade crippled the international crossing for more than two weeks as truckers and others blocked the highway linking Montana and Alberta in protest of public health measures put in place to combat the COVID-19 pandemic.
Morin was arrested after a police raid on three trailers on a Coutts property yielded a cache of weapons and ammunition.
Police said they found 13 long guns, handguns, multiple sets of body armour, a machete, a large quantity of ammunition and high-capacity magazines.
Martin and eight others face lesser charges and have been released on bail.
Morin appeared in Lethbridge court via video link, sporting a large sliver chain and large cross.
He did not address court during the proceedings.
The two lawyers also appeared by WebEx as Kubik read her reasons in the courtroom.
Morin, Lysak, Carbert and Olienick are scheduled to face a three-week jury trial in Lethbridge to begin June 12, meaning they’ll have spent 16 months behind bars before their hearing unless their lawyers can successfully appeal their detention orders at the Alberta Court of Appeal, or have a review of their orders based on a change of circumstance.
