Which international law?

Serious question. I want to look it up.







Now the US doesn't recognize these things as "Illegal", but it suits them to ignore the actual reality/facts of it.

But just because the US "doesn't recognize it", doesn't mean it's not illegal, especially not when the Security Council (without the US, who abstained, of course) affirmed that yes, they are illegal.



As an aside, Canada's stance:

Occupied Territories and Settlements

Canada does not recognize permanent Israeli control over territories occupied in 1967 (the Golan Heights, the West Bank, East Jerusalem and the Gaza Strip). The Fourth Geneva Convention applies in the occupied territories and establishes Israel's obligations as an occupying power, in particular with respect to the humane treatment of the inhabitants of the occupied territories. As referred to in UN Security Council Resolutions 446 and 465, Israeli settlements in the occupied territories are a violation of the Fourth Geneva Convention. The settlements also constitute a serious obstacle to achieving a comprehensive, just and lasting peace.

Canada believes that both Israel and the Palestinian Authority must fully respect international human rights and humanitarian law which is key to ensuring the protection of civilians, and can contribute to the creation of a climate conducive to achieving a just, lasting and comprehensive peace settlement.

International law is a tricky business. Generally, treaties, conventions, and such are binding only on the parties signatory to them.

The International Court of Justice, a.k.a. the World Court, can only hear cases where the parties are countries. Not subdivisions of countries, not rebel groups, not international organizations. Recognized countries only.

There is also a "common law" of nations, but that's even trickier.

Finally, let's say for a moment that "Palestine" gets recognized by enough countries that the ICJ rules that it is a country. Palestine sues Israel over Gaza, and let's say Israel (under heavy pressure) accepts the authority of the ICJ, and the ICJ finds Israel's ongoing "war" in Gaza "illegal" under the common law of nations and orders Israel to stop. Israel says "Fuck you." Now what?

Well, the UN Security Council would have to resolve to intervene, somehow getting the permanent members to all go along and not cast a veto. So they put together a "peacekeeping force" with a mandate to throw Israel out of Gaza. The force will have only units from national armies who pony up units voluntarily.

Difficult, especially with the U.S. likely to veto any Security Council action.

OTTAWA — Canada intends to officially recognize a sovereign state of Palestine at the United Nations General Assembly this September.


The announcement was made by Prime Minister Mark Carney at a last-minute press conference on Parliament Hill late Wednesday afternoon, after a cabinet meeting convened to discuss concerns with Israel’s ongoing operation in Gaza.


“This intention is predicated on the Palestinian Authority’s commitment to much-needed reforms — including the commitments by Palestinian Authority President (Mahmoud) Abbas to fundamentally reform its governance, to hold general elections in 2026 in which Hamas can play no part, and to demilitarize the Palestinian state,” Carney said.

“Canada will increase its efforts in supporting strong, democratic governance in Palestine and the contributions of its people to a more peaceful and hopeful future.”


Carney’s announcement comes just days after British Prime Minister Keir Starmer said he’d do the same if Israel didn’t take steps to reduce suffering in Gaza, enact a ceasefire and not annex any more land in the West Bank.

“The level of human suffering in Gaza is intolerable, and it’s rapidly deteriorating,” Carney said in English before switching to French.

“Tens of thousands of Palestinians have been killed, thousands more are on the brink of famine. Canada condemns the fact that the Israeli government has let the situation deteriorate in Gaza to this extent.”

Foreign Minister Anita Anand, who spent the week attending high-level meetings at the United Nations in New York on the topic, stood by Carney’s side during Wednesday’s press conference.


“International co-operation is essential to securing lasting peace and stability in the Middle East, and Canada will do its best to help lead that effort,” Carney said.

“Canada has long been committed to a two-state solution — an independent, viable, and sovereign Palestinian state living side-by-side with the State of Israel in peace and security.”

Those hopes, he said, have been eroded by ongoing Palestinian terrorism, including the Oct. 7 2023 terror attacks, accelerated settlements across the West Bank and East Jerusalem, recent votes in the Knesset calling for the annexation of the West Bank, and Israeli government actions in Gaza, with Carney accusing Israel of impeding access to food and medical supplies.


Addressing the explosion of antisemitism Canada’s seen since the Oct. 7 attacks, Carney said legislation would be introduced this fall to criminalize intentionally blocking access to places-of-worship, community centres and schools.

Anti-Israel activists have frequently targeted Jewish schools, synagogues and businesses since Oct. 7, staging demonstrations, intimidation marches and even opening fire.

“The heinous attacks of Oct. 7th traumatized the Jewish people in Israel, here in Canada and around the world,” Carney said.

“With each day that the remaining hostages and their remains are not returned, families live in fear and grief.”

ISRAEL REJECTS CANADA’S MOVE
In a statement, Canada’s Israeli embassy rejected the gesture, saying it rewards Hamas’ barbarism and punishes both Israeli and Palestinian victims of terror.


“Let us be clear: Israel will not bow to the distorted campaign of international pressure against it,” said Israeli Ambassador Iddo Moed.

“We will not sacrifice our very existence by permitting the imposition of a jihadist state on our ancestral homeland that seeks our annihilation.”

The Conservative Party of Canada, while supporting the idea of a two-state solution, said recognizing it in the aftermath of Oct. 7 sends the wrong message.

“A unilateral declaration of Palestinian statehood, without peace negotiations or a renunciation of violence, destroys the path to a durable, two-state solution,” read a statement.

“Worse, it legitimizes terrorism by handing political rewards to a group that rules Gaza through fear, oppression, and brutality.”

I just figured it’s weird and maybe coincidental but probably not in relation to these Arab nations popping up after almost 2 years asking for Hamas to get out of the way…

The declaration, produced after a United Nations conference in New York, read: “In the context of ending the war in Gaza, Hamas must end its rule in Gaza and hand over its weapons to the Palestinian Authority, with international engagement and support, in line with the objective of a sovereign and independent Palestinian state.”

Yep. The Canadian Conservative Party said it has long supported a two-state solution but said recognizing Palestinian statehood in the wake of the Oct. 7 attacks would legitimize Hamas and undermine peace efforts.

“A unilateral declaration of Palestinian statehood, without peace negotiations or a renunciation of violence, destroys the path to a durable, two-state solution,” the party’s foreign affairs critic, Michael Chong, said in a statement. “Worse, it legitimizes terrorism by handing political rewards to a group that rules Gaza through fear, oppression and brutality.”

Terrific. But what if those fine words had been offered by a Liberal prime minister on October 8, 2023?😳 What if he had been joined by the British prime minister of the time (since the current one, Keir Starmer, is also intent on recognizing a Palestinian state)? What if the UN had joined them?
Where is this new state? Is it Gaza, a territory Israel left in 2005 and which was subsequently ruled and governed by terrorists with one overriding aim being the complete destruction of Israel? Or the West Bank, ruled by the corrupt Palestinian Authority?

(I believe both the PA & Hamas are each in about the 20th-ish years of their four year terms since their last elections, but maybe I’m high)

One of Carney’s stated reasons for recognizing Palestine was “because the Palestinian Authority has committed to lead much needed reform. “

Apparently, said Carney, Abbas has committed to holding general elections in 2026. This is the same Abbas who was elected in 2005 for a four-year term. He’s still there. There have not been any other elections in 20 years, but now that Abbas has “committed” to holding them next year, Canada will, this year, give him what he wants?
Israel has been fighting genocide since its inception.
Has Israel been left in peace or has it been repeatedly attacked by its neighbours, terrorist organizations, etc… for at least the last 3/4 of a century? Or something else?

(Yes, Jews are Zionists & Zionists are evil, and Jewish nationalism is bad and Arab Palestinian nationalism is good and fair and just and acceptable admirable at this point)

Maybe….maybe Both (I know, high? Etc…) sides (Palestinian & Israeli, with Hamas & Friends completely out of the picture) need to sort out a solution between themselves that they both agree upon, with everybody else just staying out of it until they come to an agreement, then others can help step into implement it?

Apparently, said Carney, Abbas has committed to holding general elections in 2026. This is the same Abbas who was elected in 2005 for a four-year term. He’s still there. There have not been any other elections in 20 years, but now that Abbas has “committed” to holding them next year, Canada will, this year, give him what he wants?

Has Israel been left in peace or has it been repeatedly attacked by its neighbours, terrorist organizations, etc… for at least the last 3/4 of a century? Or something else?

(Yes, Jews are Zionists & Zionists are evil, and Jewish nationalism is bad and Arab Palestinian nationalism is good and fair and just and acceptable admirable at this point)

Maybe….maybe Both (I know, high? Etc…) sides (Palestinian & Israeli, with Hamas & Friends completely out of the picture) need to sort out a solution between themselves that they both agree upon, with everybody else just staying out of it until they come to an agreement, then others can help step into implement it?

This probably could’ve been settled 10 times before the 1995, but it wasn’t, so I’m assuming there’s a little bit of cherry picking going on by picking only 1995.
