A father plans to appeal after a Quebec court ruled that he didn't have the right to punish his 12-year-old daughter by banning her from a school trip.

Quebec Superior Court Madam Justice Suzanne Tessier ruled Friday that the girl should be allowed to attend the three-day trip within Quebec this week.

The father first forbade his daughter from going online after the Grade 6 student posted photos on a dating site, the Globe and Mail reported in its Thursday edition.

The girl's parents are divorced, and after she had an alleged row with her stepmother, the dad barred her from going on a school trip to mark the class's graduation from elementary school, the newspaper says.

"When he said, 'OK, it's final. You're not going,' she smacked the door, left and went to live with her mother," the father's lawyer, Kim Beaudoin, told CBC News.

Last Wednesday, the dad received a motion petitioning the court to overturn the punishment.

Two days later, the justice ruled that the punishment was too severe since the girl had already been sufficiently disciplined, said Beaudoin.

Beaudoin said the justice also said there was no reason for the punishment to stand, since the girl was now living with her mother, even though the father has custody.

Beaudoin said the father, who has four children, was "devastated," especially since the ruling came days before Father's Day.

While Beaudoin said the case is a first for her, she doubts it will trigger a flood of similar claims.

"Usually children have lots of respect for their parents and they wouldn't go there," said Beaudoin.

She said the judge stressed that the case was an exception. "But for a field trip, I'm thinking this is a big exception."

Where the hell do courts get off telling parents how to parent their children?

This isn't him smacking and beating her around, she was posting images on an internet dating site, and I imagine just about any parent would be pissed about that, esspecially since she's just getting out of elementary school.

And it's not like he's denying her any human rights.... he punished her by not going on a field trip...... and they get the courts involved?

That's just plain stupid.

Have to agree. This is meddling, and it has likely destroyed the dad's authority with that child. The next time that twelve year old disagrees with dad, who has custody, she will run to mom again. They've made dad's job almost impossible.

How can any Canadian maintain whatever respect one may have had at some time for a judicial system that oversteps its bounds so flagrantly and so casually?

This nation is in a lot of trouble when the notion of "justice" is undermined by fools.

This sounds like a vengence type of thing from his ex, you don't actually think a 12 year old would formulate this idea on her own. Some people will use their kids to get even with a former spouse, while having total disregard on how this will affect their kids in the future.

Hell I'm all for protecting any children I have in the future, but if they decide to cry to divorced mommy and take me to court over a trivial punishment like this, all I'd say is "Fine, you don't want to live under my roof with my rules, go live with your damn mother and end up a prostitute like her."

I'm sorry, was that too harsh?

I agree. What is now going on in the States, and in Canada as well, is a little bit scary to my mind. Children are hardly ever punished, and if they are, they take mommy and daddy to court and win the case. How are the parents supposed to teach their kids the connection between the things they do and the things that come to them in life? And how are the kids going to live their lies, when they grow up, without that knowledge?

With the lack of dicipline these days, its no wonder you have all the trouble and violence in schools.

Many of the older generations have suffered no ill affects for being punished by their parents...

I think it all boils down to psych people trying out theories that lawyers take up as rules for lawyer-cum-politician friends to pass that guarantee work for psych people, law enforcers and lawyers.

How the hell is going on a field trip a "special circumstance". Give me a break. I hope the father appeals(which means the girl still won't be able to go on her trip, I believe). How much are we going to put up with before we oust these useless sacks of crap?:angryfire:

Thankfully, this was a judgement made under Quebec's Civil Code of Law, which is entirely separate and distinct from either criminal or civil law in the rest of the country.

As i said, Thank God for small mercies.

Soo ... like Senators and spanking doesn't matter? I think the law could use a crash course in the difference between abuse and discipline (unless the law just wants to regulate itself into perpetual business)
