Re: Vadir rearrested and recharged!

But if they had forensic evidence in the first run up to trial, why would the Crown stay the charges? Again, I'm not suggesting he isn't the guilty party, he very well could be. I just find the sequence of events rather weird.

I said IF they had forensics it would be submitted.

Circumstantial is a bitch to prosecute and get a conviction.

Re: Vadir rearrested and recharged!

I'm not arguing he didn't do it. I'm not even suggesting the circumstances warrant comparison to Milgaard or Morin necessarily, aside from the certainty of the authorities that they were the guilty parties. Which of course we now know they weren't.

I think they (the cops and Crown) may be in a bit of a quandary. Once they lay charge (from what I can gather) they have one year to precede with it or drop. Their year may have been quickly running out before they were ready to procede, so I guess they dropped it temporarily to give them a chance to get "their ducks in a row" before using up anymore of their year. I'm sure the rules favour the Crown over the defendant. If the f**ker actually did it, I also want to see him "burn".

By dropping they had to wait one year. Had they went forward with what they had, the evidence presented in the first trial can't be used in appeal. Double something something.

I don't think there's any doubt that they are dead and there is probably not too much doubt that they were murdered. They just don't sound like the kind of people who would stage some bullsh*t and disappear. A greater possibility is the cops f**ked it up and feel a conviction is mandatory to cover up or excuse their incompetence. Back in the prehistoric days when I was kid, no body, no charges, no conviction!

That would have let Picton go free.
