Why, if it is illegal in the US no packages should be sent (he was making money at it). Let a 'private individual' come up, buy the seeds and have them ship them down. Better yet get some place in the US where the purchase would even be more private.

That time-stamp on when it became legal is there for a reason. Not all changes to a law come with a grandfather clause, a 10 years long and expensive appeal might get that changed but by then anybody would probably already be out if it was just a selling seed (a few) charge.If anyone can still buy seeds from the orginal Emery list posted or one of hundreds of other Canadian seed companies then Emery should never have been extradited on the grounds claimed by the DEA and courts in Seattle.
