Bottom line is if the sales were kept domestic he would not have been arrested. Seems like he took a gamble and lost and now he's whining about it. Seems to be crocodile tears to even be applying for a transfer.


So he's in jail because he couldn't resist making a sale he should have known would cause him rael problems, I hope he fired his old lawyer, or is that who's minding the store since the arrest?

Why, if it is illegal in the US no packages should be sent (he was making money at it). Let a 'private individual' come up, buy the seeds and have them ship them down. Better yet get some place in the US where the purchase would even be more private.

There are plenty of seed sellers in the US. The DEA targeted Emery because of his politics. Do you feel that someone should be arrested and put in prison for their political beliefs?

Asd much as I am for the free pot thing when he was lighting up those super-joints I was kind of hoping he would jump into a vehicle and then get arrested for being impaired, Do the crime, do the time, maybe he will be more low-key when he is free to smoke again, take a pinner and smoke it in private then come before the cameras. He was looking for fame (and fortune), looks like it is one out of two.

It's not a crime in Canada to sell seeds.

If you are shipping illegal substances to a foreign country, my guess is you are just as guilty as if you walked across the border with it. What difference does the means of conveyance make?

Let's be clear. Emery was arrested for shipping a substance which is legal in Canada, but illegal in the US. Emery broke US law while in Canada. He did not break a Canadian law while in the US or a Canadian law while in Canada.

So which laws do you believe apply to Canadians living in Canada? Sounds like you believe US laws also apply in Canada. If so, do you believe all countries should be able to impose their laws on Canadians in Canada?

Wine is a legal substance in Canada, but an illegal substance in Saudi Arabia. Again, would you expect the Canadian government to extradite a Canadian vintner to Saudi Arabia for shipping a case of wine to Saudi Arabia? The vintner would be breaking a Saudi law while in Canada. That would be similar to the situation facing Emery, who broke US law while in Canada.

Do Saudi laws also apply in Canada like American ones?

Also, extradition has limits in Canada. Canada can refuse to extradite someone if their punishment in the other country differs significantly from what they would face in Canada for committing the same crime. Since marijuana seeds are technically legal in Canada and possession is a 10 year minimum jail sentence in the US, Canada is not obligated to extradite Mr. Emery to the US.

If a woman is guilty of adultery in Saudi Arabia, she faces the death penalty. Should Saudi law like American law also prevail over Canadian law? Should Canada arrest women who commit adultery in Canada for extradition to Saudi Arabia?

My point is that only Canadian law applies in Canada. Unlike Harper, I'm not willing to cede Canadian sovereignty to the US.

If anyone can still buy seeds from the orginal Emery list posted or one of hundreds of other Canadian seed companies then Emery should never have been extradited on the grounds claimed by the DEA and courts in Seattle.

Bull****, he was promoting that he had the right to sell to the US when it was illegal, there is no grandfather clause, how may US citizens were released when it became legal to sell seeds? Not a ****ing one. If he had waited would he have been arrested.

Never said it was, you could even sell to an Amnerican if he was the legal age and on Canadian soil. Those parameters were adjusted and they should have been paid attention to rather than being disregarded.

This is what I have been talking about, in the US it is called trafficking, that is why smuggling exists, that is why the black market exists.

The sale or transactions were all in Canada not USA. It's illegal to receive seeds in the US not to ship them there.

That time-stamp on when it became legal is there for a reason. Not all changes to a law come with a grandfather clause, a 10 years long and expensive appeal might get that changed but by then anybody would probably already be out if it was just a selling seed (a few) charge.

Which is it with this guy, was it a political statement or a financial endeavor? It would seem that legal changes were sought that would enhanse his ability to make a larger financial gain that he was already making with the current market available to him.

That might a fine line if no money was exchanging hands. He was knowingly helping an American do something that was illegal. Are you saying a person in Mexico that helps somebody pack a bag full of coke would not be considered to be a smuggler?
