The moment he picked up a weapon (I don’t care if it’s a gun or a shovel or a handful of gravel or a rock or a rake or what have you), and made the decision to “actually” use it as a weapon, that’s one of the line was crossed.

Protesting is generally legal, and a right (reasonable time, place, and manner restrictions can apply). Declaring a protest "illegal" is troubling, and should require a lot of justification.
