In May, US District Judge Murray Snow ruled that Maricopa County Sheriff Joe Arpaio and his Sheriff's Department had violated the civil rights of Latinos; detaining them simply because of their race.
Yesterday, after negotiations concerning a settlement agreement had reached an impasse, he issued orders implementing remedies, including putting the Sheriff and his Department under a Federal Monitor.
In his ruling Wednesday, Snow ordered that a monitor be appointed to oversee the agency's re-training of deputies and ensure the office is complying with constitutional requirements. Snow also ordered the creation of a community advisory board aimed at helping restore the public's confidence, among other remedies... Snow's ruling doesn't altogether bar Arpaio, 81, from enforcing the state's immigration laws, but it does impose a long list of restrictions on the sheriff's patrols, some of which focused heavily on Latino areas in the county. They include prohibitions on using race as a factor in deciding whether to stop a vehicle with a Latino occupant and on detaining Latino passengers only on the suspicion that they're in the country illegally.
Arpaio is, as expected, defiant.
Arpaio's lawyer, Tim Casey, said... The monitor cannot tell us what to do or not to do," ... referring to the monitor's role in the ruling as overseeing training and procedures, among other things. "The court will make the ultimate decision on whether or not the MCSO is in compliance with its order, and we're very pleased with that."​
And, according to various articles, his lawyer's are considering various appeals. Arpaio belongs in a jail cell, serving a one-month term for every person's civil rights he's violated (he'd be there for 10,000 years). But such is the power of law enforcement that no matter what their representatives do, from civil rights violations to executions, they are almost never held accountable. Only after years of effort and vast expenditures of time and legal acumen has Arpaio been (theoretically) brought even to heel.

A summary from the Atlantic:
The 59-page order, among other things, requires the department to:
  • Train all officers in anti-discriminatory practice, and post notices clearly outlining the prohibition against racial profiling.
  • Record all traffic stops with audio and video, radio in the reason for the stop before approaching the vehicle. Arpaio was sued in the first place by a group of Latinos over the sheriff department's use of "crime suppression" patrols in mainly Latino neighborhoods. The plaintiffs argued that officers stopped individuals simply because they looked like they might be undocumented.
  • During the traffic stop, officers unnecessarily extend traffic stops, and all traffic stops will be periodically audited. Officers are barred from selecting which vehicles to stop, which individuals to question, and which procedures to use based on the race or ethnicity of the person in question. The order will also bar traffic stop quotas.
  • The department will have to inform the community of the new policies, and have representatives available in Spanish and English to answer questions.
We know very well that the rot came from the top and has eaten its way through the entire department. Judge's orders and a Monitor are one necessary step, and we can hope they will curb the worst abuses. But a real fix can only happen if Arpaio, his assistants and two thirds of his deputies find themselves without a job.







Arizona taxpayers have had to fork over $50 million for his crimes. Soon enough they will have to pay FAR more when the rest of the cases against him are settled.

With Arpaio there seems to be no happy medium...........people either hate him or they love him. However he IS getting a little long in the tooth so his career will probably start winding down.

Does the judge think Arizona is full of illegal immigrants from Germany or Poland? Come on! I used to visit Tuscon every year and half the population was Latino and at least half of them were illegal. But hey, lets waste time and resources pulling over carloads of white guys to look for illegals.

Does the judge think Arizona is full of illegal immigrants from Germany or Poland? Come on! I used to visit Tuscon every year and half the population was Latino and at least half of them were illegal. But hey, lets waste time and resources pulling over carloads of white guys to look for illegals.
I agree. Instead we should pull over Latinos based on their race, in clear violation of the Fourth and Fourteenth Amendments. U-S-A! U-S-A! U-S-A!

Just out of curiosity, how did you know "at least half of them were illegal?" Brown skin, maybe?

I know! We can also pull over carloads of elderly nuns while looking for drug dealers so those heroin and crack sellers aren't having their rights violated. :roll:

Whatever you do don't look for tattooed guys in leather vests on Harley's if you're investigating biker gangs. :roll:

I wasn't aware that we looked for illegal Mexicans. I thought we looked for illegal aliens. Thanks for the info.

I know it's old-fashioned, but I still have a problem with detaining people because of the colour of their skin. Maybe if I was white it wouldn't matter so much.

I also have a problem with detaining people without probable cause, but that's just that old-fashioned thing again.

Actually, the possibility that you might be in the country illegally, is probable cause.

No, you look for illegal immigrants or visitors. In Arizona the vast majority of them will be from Mexico or Central America. Those places aren't rife with WASPs ya know.

So you don't like road-checks for alcohol? The basic principle is the same. If you aren't drinking the road-blocks won't bother you, if you immigrated legally you won't have a problem showing your green card.

Under that same Constitution, at least for now, and with an increasing number of exceptions, the cops cannot detain you without probable cause to think you have committed a crime or, under Terry v. Ohio, a reasonable, articulable suspicion that you have or are about to commit a crime.

I think roadblocks are a part of excercising your right to travel in a responsible manner so as not to endanger anyone else. Nothing unconstitutional about it. Your rights cannot infringe on my right to safety, that simple.

If 90% of 5he illegals in Arizona are latino there is probable cause to think a latino might be illegal. Like I said, if you have a legitimate green card you show it and leave. No problem.

Actually, the roadblocks are a bit much.

Can you think of a better solution to such a problematic issue?

The USSC already ruled that checking for ones green card was not a violation of the Constitution, non?

Not under our Constitution. The police can only detain someone if they have probable cause to suspect that person has committed a crime. That specific person. Even if he's brown.

You have to wonder how anyone can be so stupid as to love someone who has cost taxpayers over $50 million dollars with only about half of the lawsuits against him having been settled. The piece of sh1t claims he is protecting the state's border from illegals except that Maricopa county doesn't touch the Mexican border. Therefore, he has no valid claim but is being a total pr1ck. Even the Republican courts have all ruled against him so that tells you just how fücked up that bigoted piece of shït really is.
