then everybody would be able to work anywhere they wish.
No, we'll just find other things to compare and use. Like, character flaws...those are good.

Can they choose to fire you for having pre-marital sex?
I knew a Boy Scout who got kicked out of the troop for eating Brownies...I worked at a pickle factory when I was in high school and got fired for sticking my pecker in the pickle slicer.
She got fired to.

I am really sick and tired of the focus on cancer from smoking. do don't "catch" cancer, you either have it or you don't, it's just a matter of when it decides to kick in. How do you account for the people who smoke all their lives, and no cancer. As far as I'm concerned, we have worse things to be worried about, when it comes to our health than smoking. the food we eat is laced with chemicals, pesticides and such. the water we drink is polluted, and they try to fix it with chlorine, yeah, that's much better. The air, don't get me started, just about every night, where I live, you can smell something burning, and it isn't wood from fireplaces, or wood stoves. Chemicals are everywhere, and we the people, are the unlucky bunch that gets to soak them all in. Even people who think they're living "healthy", should get their blood tested, I think they'll be surprised to find what's in it. Usually, in a workplace, company shared health plans are optional, not manditory, so if you do smoke, and decide you don't want to be in on the company health plan, it's irelevent. they say smokers "phone in sick" more often than non-smokers. I say B.S. I think being lazy, dishonest, and/or drinking the night before. has everything to do with it, not being a smoker. The "sniffles" , do not count as sick, heaving you guts out , or not being able to be farther than 10 feet from a toilet, counts a sick. Strep thoat counts too. I was going to a "health center" for excersise, and I was coming down with a flu, or cold every 3 months, like clockwork, I stoppped going, I got sick twice, in two years. according to labour law, workers are allowed 2 15 min. breaks, if you work 8 hours a day, what you do with those 15 min. is your business. By the way, one of you is right, obesity is the next "cause" to be thrust into the limelight, politicians are already toying with the idea of an obesity tax, put on fast food and junk food, as much as 18%. I guess politicians don't have enough money to piss away, they need more. Not all overweight people are, or will be diabetic, one has a genetic predisposition for that. I think of the law says that cigarrette manufactures aren't allowed to advertise, neither should all fast food restaurant chains, all chip, chocolate, candy manufactures, and all softdrink manufacturers. Then we'll see some outrage. from all this anti-smoking and healthy eating crap, is spawned, basically, gov't legislated buisiness opportunities, so someone gets to make money off of you, and they get to advertise, (brainwash) all they want. Just another way, the gov't is sticking it's nose into your business.
Character flaws make character...can't be a 3d person without 'em.
How can an employer determine what after-work activities are acceptable, and which aren't? Smoking is perfectly legal. No employer has the right to discriminate against an employee who does something perfectly legal after work. It's just not acceptable. Not in my world.
Your examples are stupid - pedophilia is a criminal offense. Smoking is not.
Actually in certain circumstances they can. EG. Airlines prohibit pilots from having a drink within a certain time period before coming to work even though drinking is legal. I think most people would support this rule. Some trucking companies have similar rules. There are also many logging camps and probably construction camps that do not allow alcohol in camp. You can obey this rule or not work there.
