It was the only house he ever owned. Moved here and rented a house. His house didn`t sell immediately and he rented it out to help pay the mortgage. The house eventually sold (not sure how long) and he bought a house here. He thought, given the fact that he only ever owned one house, he didn`t have to pay CGT. He had hire lawyers and real estate agents and nobody said anything to him. Revenue Canada doesn`t care. Ignorance is no excuse.

So it was not his primary residence - He should have had the house assessed for value when he moved out- He still can - the difference if the assessed value when he moved out is lower than wht he sold for, then tax is paid.

You only gave part of the story. Why.

I`m not arguing what he should or shouldn`t have done. I`m saying that he had no idea what the law was.

You only gave part of the story. Why.

Am I to write a novel with each post. Why didn`t you assume there were other factors when you said that as far as you knew, you do not have to pay CST. Is it that you really weren`t that up on the law and had to do some research first

Yes it is, and available online. Unfortunately, the weak minded and morally bankrupt prefer to pass the buck and refuse to take responsibility for their own actions.

Precisely. The law is not as simple as that. If you move and do not sell your house immediately you could get stung.

You would need to be well versed in both the Land Title Act and Income Tax Act to know for sure. That's about 7000 pages of hardcore legalese. Have fun and let me know when your done and understand it all. ;-)

Understanding the laws is fairly easy. The vast majority don't apply to you. If you are planning to do something specific like planing a murder or buying some land then you should research that area of law. Now I know that there are over a thousand laws and regulations on mineral claims but since I have zero intentions of ever getting one I could care lees what the applicable laws are. Same goes for work. I know that WorkesafeBC has thousands of rules but most of them do not pertain to the work I do so I just ignore them, but I have a good grasp of the ones that apply.

What about when someone stakes a mineral claim to your land and moves in with a mining operation. You can run to court and plead ignorance of the law that allows them to do it all you want but ignorance is no excuse so you are SOL. Maybe you should read those laws! 8O

That is not my issue at all. My concern is only with simplifying the law and the legal process. I think it is only lawyers and the weak minded that would argue against that.

It is but lawyers go to school for years to learn it and then their practice deals in a small segment of the law. Do you really think the average citizen should know every aspect of it?

Don't be dim, only an idiot would think that. But say I was going to start up a wh*re house, then I would read up on all the laws pertaining to wh*re houses!
