Conspiracy?where did you such words,it seems you always want an argument,I can name at least three sex assault cases before the courts who can be questioned on their handling of the case,and more so what kind of agendas are being served by inproper handling,this is no conspiracty puss n boots.
i can lay out the cases and everyone on this forum,unless they are political blind would also question what the sh it is going on.

My feelings about this case, almost exactly.

The Ghomesi trial turns into a fiasco

When three women came forward in the fall of 2014 to press criminal charges against Jian Ghomeshi for sexual assault, many of us cheered them on. More than a dozen women, both on and off the record, had already described a pattern of odious behaviour over many years – alleged incidents of punching, slapping, choking, and hair-pulling that came out of the blue and were not consensual. It was past time for a reckoning. It was past time to send a signal to all abusers: We won’t take this any more.

Everybody knew a guilty verdict was far from sure. The bar for a criminal conviction is, as it should be, high. But nobody, not even the most experienced court-watchers, could have predicted how this trial would go. It has turned into a fiasco. The most high-profile witness – actress Lucy DeCoutere, who agreed to waive her anonymity – suffered a devastating blow to her credibility because she’d never told anyone involved in the case that she had pursued a relationship with Mr. Ghomeshi after he had allegedly assaulted her.

Witness Number Three also left a few things out – such as the fact that she, too, had had a date and sexual encounter after the alleged assault. The first time these witnesses mentioned these details to the Crown and the police (and perhaps their own lawyer) was just before they took the stand.

Witness Number One didn’t do too well either. She had a hard time explaining why she’d sent e-mails and a bikini photo to a man who’d allegedly just attacked her.

Whatever happened to them, not one of Mr. Ghomeshi’s accusers behaved like people who’d been attacked. Instead, they sent him sexy pictures and flowers and e-mails that ranged from coy flirtations to blunt sexual propositions. A few days after she says she was choked and slapped, Ms. DeCoutere sent him a six-page handwritten love letter that concluded, “I love your hands.”

Why does this matter? After all, as Ms. DeCoutere’s lawyer, Gillian Hnatiw, was quick to remind us, “Violence against women is not about the behaviour of the woman … It’s not about whether [victims of violence] see their abusers again or send flowers, any more than it is about what they wear or how much they had to drink.”

She’s right – to a point. What happened after their encounter doesn’t change what happened during it. And (to me, at least) the women’s allegations have the ring of truth. But a criminal conviction needs more than that. It needs witnesses who are consistent, credible and open. And Ms. DeCoutere, for one, was not. She testified that her relationship with Mr. Ghomeshi after that night was distant and professional. Yet the evidence depicts a lovesick fan, pursuing a man who was no longer interested in her. When confronted with her e-mails and the letter, she said she couldn’t remember writing them. She said that when she told Mr. Ghomeshi she wanted to **** his brains out, she didn’t mean it.

Why didn’t she and Witness Number Three disclose these awkward details beforehand? Maybe they were embarrassed. Or they forgot. Or they thought no one would find out. Whatever the case, they appear to have evaded the whole truth because the whole truth made them look bad. Or perhaps nobody involved in preparing them for trial had asked them to disclose all the awkward bits – in which case they should be fired for negligence. In any event, by the end of Monday’s proceedings, Marie Henein, Mr. Ghomeshi’s defence lawyer, had demolished the first two witnesses and had started in on Number Three. I felt sorry for them.

I know the dynamics of abuse can be complex. I know that women can both love and fear their abusers. But these women were not battered wives. They were not in relationships with Mr. Ghomeshi. They barely knew him. They had no reason to fear him, and he had no power over them at all – except the power of his charm and celebrity. They could have walked away. They didn’t.

And all that’s left is their word about unpleasant encounters that may or may not rise to the standard of criminal assault.

From the start, this case has evoked powerful emotions. Many of us hoped Mr. Ghomeshi’s accusers would prevail, and that they would help give voice to the many silent victims of sexual assault who have never been heard. If the case collapses – as seems increasingly likely – lots of people will be outraged, and will want to know why. And other people will wonder if there ever really was a case at all.

i know one thing the design of this case is wonky,and their is a certain amount of expectations in cases like this,therefore there is predicatability,and what is sad is the obvious in the predictability was overlooked.

I am no lawyer,but the Crown in this case failed to advise correctly,this beingon purpose and with intent,the most obvious was dismissed ,sad day for Canada.

Win or loose, this guy is brutal and needs to get a job at an S & M club.

Like you, my first thought was "what a fricken animal" - guess there's rhyme and reason for "innocent until proved guilty".
then the next case is more like guilty until proven innocent,the courts are fu cked up!
so little effort into this case,then so much effort is placed into wrongful convictions,what a world we live in.

Yeah, I don't "get" rough sex, in any way. There can't be any chance of a loving union but I suppose, if you are a Wolverine, ...

You cannot tell anyone to quit reading or replying to your posts. If you are going to post something in the forum, you open up that post to scrutiny, criticism, acknowledgement, agreement, disagreement, whatever....you do not get to pick and choose what responses you get. If you do not care to read what an specific member of this forum has to say, then you can put that member (aside from a moderator) on ignore. Or you can simply elect not to respond to a post that you don't deem worthy of your response.

I like that authority in your tone of speech,it is making me sit straight.
It would be nice to get scrutiny,criticism,acknowledgement,agreement, disagreement,dialogue,opinion,conversation,but unfortunately I get nothing,and when I do gerryh "chimes" in with immature responses,I am seeking deeper meaniful conversation and opinion particularly within the topic of politics.
review how my blogs or conversation,opinions are ignored and floated to never never land,why is this slm.

I am concerned for gerryh and the effect I have on him/her,you can tell he only receives anxiety upon reading my blah blah,I really don't think it is good for his/her health to be so negative,I guess I am overconcerned.I think he is shell shocked,and can't face the truth or opinions of others,including many others on the forum.

Missed your target, pt - the author of the article wrote that 'nobody' could predict ..........though I do agree with her as I was sure that this would be a slam dunk for the prosecution. BTW.....it is credibility.

Not having been privy to the prosecution's case, I cannot comment on its design.

Would you please expand your thoughts on 'the obvious in the predictability was overlooked' as it is not at all clear to me what your point is here.

In prior comments, I have stated that, in my estimation, the prosecution's case was sadly lacking in due diligence.

Accusing the Crown of not advising someone on their rights and obligations to tell the truth and nothing but simply shows your utter lack of understanding how our court systems work. If you had taken the time to read the literature available on this case you would find that all witnesses were duly advised - not once but many times.

No one led these women anywhere. They chose their path all by themselves. They may not be rocket scientists but one would think that they do know the difference between right and wrong, truth or lies. In this day of instant communication, stashed emails and public comments on places like FB, one would have to be a total dolt not to know that their words and actions would come back to bite them.

Absolutely and it's very sad, I'm sure Ghomeshi should be locked up for the duration but there's no to prove that, so what we likely have is a monster running loose and $millions of tax payer's money pissed down the drain!

Much as I dislike the guy JLM, monster is going a bit far. There are thousands of people who practice rough sex - heck there are probably all kinds of websites for devotees. The fact that it is not the kind of thing I would ever consider doesn't mean that I am against others doing so, with consent. The trial was about just that - consent. In light of all the prevarication and collusion, whether they consented or not is now a mute point.

I do agree that it was a waste of taxpayers money and court time.

Watching live blog of the judges decision in the trial. So far it's not looking good for the witnesses - no surprise there. The judge reviewed all the testimony and found fault in each case.

Specifically on Decoutere's evidence, the judge found that:

"It is the suppression of evidence and the deception maintained under oath that drive my concerns on the reliability of this witness. Not necessarily her undermined motivations for doing it."

The Judges summation.

"The allegations against Mr. Ghomeshi are supported by nothing in addition to the complainants' word."

There is no other evidence to look to.

There is no smoking gun.

There is only the sworn evidence of each complainant standing on its own.

Courts must guard against applying false stereotypes

Each complainant in this case engaged in conduct with Mr. Ghomeshi after the fact which seems out of harmony.

The bedrock foundation of the Crown's case is tainted.

The evidence fails to prove the allegations beyond a reasonable doubt."

Not guilty.

Though I don't believe Ghomeshi is innocent, I do believe the dramatic exaggerations and just plain fabrication of his accusers won him his freedom. Perhaps there should be some investigation ... but then that may draw the entire system of conviction over justice under scrutiny

I think the "victims" got their come uppance. They waited 10 years to file their complaint at the exact time the defendant first appeared to be getting public attention. The one "victim" apparently stated something to the affect that "after the a$$ kicking he gave me last night, I'm looking forward to f**king him tonight". From what I can see the whole process was one big charade. I think Ghomeshi deserved to get something but not that way. I think the biggest lesson to be learned here is if you are going to lay charged you limit any blabbing you do to your lawyer and the cops!

The judge had no other recourse than to find Ghomeshi not guilty. Lying, collusion, so-called faulty memories and especially the thousands of emails between two witnesses gave him no choice. Ghomeshi still has another court case sometime later this year - let us hope the witness and crown are able to get it right this time cause this last case was simply a huge waste of time and money.

Do you expect "the system" to care about women who gossip and can't get their stories straight and especially ones who have a "relation" with the "culprit" after they've been "abused"? A credible woman would have NO further contact with him in any way, shape or form after the alleged abuse!

all I know it was a sad day for Canadians,these words do not come lightly,
all over Canada sexual assault cases are being designed with the same outcome,
as demonstrated,the courts should be ashamed,the Judge proceeding over this case should be angry,he/she should recognize they were who red in the most profound way,allowing for the courts democracy to be tampered with.
those prosecuters led those women to slaughter,if i ever start to information audit again,i plan on taking on the question who led these women to slaughter,
sad day for everything right.

So I'm interpreting this to mean you'd be happier had Ghomeshi been sentenced to 5 years in prison. Do you understand what "reasonable doubt" means?

Are you on some kind of medication?
