'Apprentice' contestant's lawsuit against Trump goes to top N.Y. court

NEW YORK — New York state’s highest court will consider whether U.S. President Donald Trump must face a defamation lawsuit by a former contestant on The Apprentice, in a showdown that could help determine whether Trump can be sued while in the White House.
The Appellate Division in Manhattan, an intermediate-level court, on Tuesday granted Trump permission to ask the state Court of Appeals to review whether its 3-2 decision last March allowing Summer Zervos to sue him was correct.
In that decision, the majority said the U.S. Constitution did not strip state courts of power to decide cases arising under state constitutions, even if they involved sitting presidents, and that Trump was “not above the law.”
The dissenting judges said the case would interfere with Trump’s presidency and could wait until he left office.
A spokeswoman for Trump’s law firm Kasowitz Benson Torres said: “We believe that the Court of Appeals will agree that the U.S. Constitution bars state court actions while the President is in office.”

A lawyer for Zervos, Beth Wilkinson, said: “We remain confident that we will prove her defamation claim in court and that Mr. Trump will face responsibility for his actions.”
Trump has argued in a variety of litigation that he is immune from lawsuits and investigations, including criminal proceedings, while in office.
The U.S. Supreme Court is expected to decide, likely by the end of June, whether Trump can block subpoenas by Congress and New York state prosecutors for his financial records.
Zervos, a 2005 contestant on Trump’s reality television show The Apprentice, accused the president in a 2017 lawsuit of defamation for calling her a liar after she accused him of sexual misconduct.
She has said Trump kissed her against her will at a 2007 meeting in New York and later groped her at a Beverly Hills, California, hotel.
Trump has denied the claims of Zervos and several other women who accused him of sexual misconduct.
Zervos’ effort to question Trump under oath will remain on hold during the appeals process.
In its decision, the Appellate Division majority found Zervos’ case “materially indistinguishable” from former Arkansas state employee Paula Jones’ lawsuit accusing then-president Bill Clinton of sexual harassment.
The Supreme Court let that case go forward in 1997, helping pave the way for Clinton’s impeachment the following year.
Trump is expected to soon face trial in the Republican-led U.S. Senate, after the Democratic-led House of Representatives impeached him on charges of abuse of power and obstruction of Congress.

Anyone on the job hunt might want to be extra careful with where and how they apply. Police are issuing a word of warning after a spike in reported online scams. Chris Chacon explains.

Members of the Cyber Crimes Unit of the Edmonton Police Service have seized several web domains, after learning of fake job ads being posted on a job sharing site that scammed several job-seekers.

(Pretending to be an employer or pretending to represent an employer has to be a great way to STEAL all sorts of personal information!! One can easily find FAKE employment agencies online - CLAIMING to offer access to govt job applications!!!
And of course with all the hiring freezes and union requirements and word of mouth information sharing of actual job openings between employed HOGS and their job seeking relatives and pals - one simply CANNOT walk off the street into a govt job!! Yet ads for “city job opportunities” appear regularly - just hand in all your personal info to total strangers with NO HONEST listed address!!!!!!!!!!!!!!!!)

According to the EPS, a typical employment scam would lead victims to believe they are applying for a real job. The hiring process appears legitimate with professional-looking correspondence, including links to sites that appear to be authentic.

After a person is “hired,” they usually received a “cash advance” by the suspects and are instructed to transfer all or part of the cash into bitcoin or into another account.

(Naturally the “cash advance” and then the instruction to purchase bitcoin should have alarm bells ringing but some people are both desperate and DIM!! Evne if the bitcoin is not bought the fact remains that SCUM have all your personal information and are doing who knows what fraud with it!!!!!!!!!!!!!!!!!!!!!!!!!!!)

In this particular case, the suspects copied the website of a legitimate business, replaced the phone numbers and hosted the site under a “.ca” domain.

“Once we became aware of this, we seized all three websites,” Det. Phil Hawkins said in a news release.

(Uh huh - and considering that LIE-berals seem unconcerned with gang bangers shooting each other in the street - one has to WONDER how long it took to get those 3 domain sites shut down!! AND WONDER if anybody will ever be punished for the FRAUD!!!!!!!!!!!!!!!!!!!!!!!!!!)

(Oh that number - $240k is just what we KNOW OF - related to desperate people buying bitcoins for scammers!! One wonders how many FRAUDULENT credit cards were made using stolen personal info and how much retailers are OUT OF POCKET for those credit frauds?????????????????)

Once a domain is seized, anyone who visits that site won’t see the page as it used to be. Instead, it’s a blue screen with the EPS logo and text informing people the domain has been seized and visitors should call police.

“Within hours of the seized domain notice appearing, we had already received a call from someone who was in the process of being scammed,” Det. Hawkins said.

(So it seems NOBODY GOT ARRESTED for the SCAMS!!!!!!!!!!!!!!!!!!!!!!!!!!)

“The complainant visited the website to check that the job offer he was pursuing was linked to a real company, and saw our notice there.”

This is the second time the unit has seized web domains.

(Yes- and until there is real enforcement and ARRESTS and jail time - not just in Canada - but in the third world countries where so many such scams originate - such scams will continue to be profitable!!!!!!!!!!!!!!!!!!!!!!!!!)

Anyone who thinks they were a victim of this scam is asked to call the EPS at 780-423-4567.


In the first half of 2019, EPS received 93 reports of online employment scams with victims losing $240,925.83.

(So that is SIX MONTHS worth of bitcoin rip offs in just one Cdn city!!!!!!!!!!!!!!!)

Officers have even seen local companies become a front for an employment scam without their knowledge. Yardstick Technologies discovered their logo and company email address was being used by a scammer earlier this year to post a fake ad for an administrative assistant.

“Because the scammer was extremely aggressive and persistent, attempting to push applicants through the process as quickly as possible, many applicants felt it was out of character coming from a company like ours, and reached out to us to see if we were actually hiring for the position,” Nicole Hewson, corporate services manager for Yardstick Technologies Inc said.

“Thankfully we were able to catch this scam early and report it immediately to EPS, to whom I was able to direct all potential victims.”

According to Edmonton police, online employment websites and social media platforms are working to identify and remove fake profiles and job postings.

(Uh huh - the online world remains THE WILD WEST - with NO SHERIFF!!!!!!!!!)

(The cops position is that if the banks did not care to bother supplying records and documents - and considered it a WASTE OF TIME to cooperate with investigating cops - and bankers MADE IT CLEAR they considered FRAUD to be simply another business cost for them - the cops chose to take their cue from the bankers and IGNORE such fraud as well!!!!!!!!!!!!!!!!!!!!!!!)

If you suspect a job posting isn’t legitimate but you have not become a victim of the scam, report it to the hosting website and the Canadian Anti-Fraud Centre at 1-888-495-8501.
