In time of war, or of emergency involving the national defense proclaimed by the President, he may by Executive order declare the commissioned corps of the Service to be a military service. Upon such declaration, and during the period of such war or such emergency or such part thereof as the President shall prescribe, the commissioned corps (a) shall constitute a branch of the land and naval forces of the United States, (b) shall, to the extent prescribed by regulations of the President, be subject to the Uniform Code of Military Justice [10 U.S.C. 801 et seq.], and (c) shall continue to operate as part of the Service except to the extent that the President may direct as Commander in Chief.

As one human being to another I'd give you a little advice, so you'd have a better rapport with us Canadian boys, instead of being just as abrasive as Donald Trump. I for one have no doubt about your knowledge of American Constitutional law, but there's more important things in life. Pete probably sees you the same as I do, just filled with disdain for those you perceive to be your inferiors. You're well known on this forum for putting people down with your sarcastic remarks and making light of people you perceive as less intelligent than you. Anyway I don't really give a shit. He can leave it to PHS' "judgement" or he can militarize them and declare martial law.

Whoa whoa whoa back up and put the goal posts back where they were. Does he have absolute power in a national emergency to put the USPHS in charge of public health or not? Can a State contest the direction mandated by the USPHS? How can they deny their order in a National Emergency? Call Domino's for legal assistance?
