Ironic, Afghanistan was in part extra-hostile due to the terrorist actions of Khadr and if memory serves, he is not an Afghan citizen yet decided to make war within their borders.
That said, as Canada has a number of Extradition Treaties with many other nations, I suppose that it may make sense establishing one (if we don't have it already) with Afghanistan.

Not sure what you mean by he will face the death penalty in the US.
I am assuming if he was going to face the death penalty, he would be dead by now. The American's have executed Canadians before who have committed murder in the States.
