If the driver is illegal then the drunk guy is the one "in control" of the vehicle.

That's just a loophole for the cops like when you come out of the pub and are sensible enough not to drive and sleep it off in your car with your keys in your pocket.

He gave the kid the keys and asked him to drive. That is "control of the vehicle" , it far more than just sleeping **** off with keys in your pocket.

Parking lots are for parking, home is for sleeping. If you want to do both get drunk at home and sleep in your driveway.

To be honest, I don't mind if they want to sleep in their car while in the parking lot. That is a hell of a lot safer than the drunk attempting to drive. And the police usually won't charge the person if they are sleeping and the car is not running.

What this idiot did wasn't even close, and legally he was in control of the vehicle. I hope he gets a stiff sentence. He's just lucky that no one was killed!

It depends. Some States are quite strict when it comes to drinking and driving.

I realize that, but out of the two scenarios that I mentioned, what do you think the owner of the bar would rather see? The drunk get into a car and drive away or the drunk pass out in his backseat? It's not like it's an everyday occurrence after all.

I agree that is the best thing to happen, but if there wasn't any other way besides the two I mentioned then I think it is the lesser of two evils. I think it's ridiculous that you would be responsible for the drunk sleeping in your parking lot. Has it always been like that or is that something recent?

Rule #1 if you brought you car to the bar makes sure you have a ride home.


It's an old one. Bartenders and bar owners can even be held liable for someone crashing their vehicle after leaving your establishment.
