Watched it. He’s a Dick, but still a Senator.
What was he doing in that building where the “presser” was taking place? Was he traveling to or from some event that involved him in his official capacity as a senator? Is that relevant?
What I’m trying to say is, if he was in that building on an official capacity and he’s travelling to or from that official capacity, then it’s probably relevant.
Somebody who swims in US politics and has a legal background can make more sense out of this, but I believe the senator is constitutionally protected from harassment to and from official functions or capacities.
I don’t even pretend to know more than I do and yes, I think the guy was a dick, but…
They're immune from arrest during sessions of Congress and when traveling to/from those sessions.
"They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place." U.S. Const., Art. I, sec. 6, cl. 1.
He can sue. Probably turn on whether his conduct could be considered a breach of the peace.
