Not that it will amount to anything, but it's refreshing to see an official body of some kind acknowledge the obvious: all sides of every war commit war crimes.

Not that it will amount to anything, but it's refreshing to see an official body of some kind acknowledge the obvious: all sides of every war commit war crimes.
Israeli Defence Minister Yoav Gallant has rejected the arrest warrants sought by the International Criminal Court's prosecutor for him and Prime Minister Benjamin Netanyahu.

Mr Gallant said the prosecutor, Karim Khan, had drawn a "despicable" parallel between Israel and the Palestinian armed group Hamas and attempted to deny his country's right to self-defence.

“I stand with, support, and commend our troops, who are defending our people and fulfilling the extraordinary privilege and obligation of defending ourselves, by ourselves,” he said.

He added: “The attempt made by the ICC prosecutor Karim Khan to turn things around will not succeed - the parallel he has drawn between the Hamas terrorist organization and the State of Israel is despicable.”

Mr Gallant reiterated that Israel was not a signatory of the Rome Statute, the ICC’s founding treaty, and did not recognise its authority.

“Karim Khan's attempt to deny the State of Israel the right to defend herself and ensure the release of the hostages held in Gaza must be rejected explicitly.”

There was no immediate response from Mr Khan to the remarks or to the statement made by Mr Netanyahu, who denounced the warrant applications for him and Mr Gallant as a “moral outrage of historic proportions”.

The respective heads of three European countries—Ireland, Norway and Spain—announced on Wednesday that they will formally recognize the State of Palestine, effectively rewarding Hamas for its unprovoked slaughter of more than 1,100 people, mostly civilians, in southern Israel on October 7 of last year.

Not to be left out, the NDP took the news from across the Atlantic as an opportunity to reiterate its own call for Canada to recognize the so-called State of Palestine.

In a statement published on the party’s website, NDP Foreign Affairs Critic Heather McPherson wrote, “The right of the Palestinian people to statehood is a globally recognized right and it doesn’t legally require negotiation or a peace settlement.”

Conspicuously, McPherson’s statement made no mention of the Hamas-led violence that set in motion the chain of events leading to the announcements out of the three European capitals. The statement also failed to address the troubling precedent Canada’s formal recognition of Palestine would set in helping to legitimize the use of wanton violence (including torture and sexual violence) in the service of secession.
With Canada itself no stranger to secessionist violence, McPherson and her allies in the NDP caucus are playing a dangerous—and, frankly, irresponsible—game by endorsing Hamas’s violent path to securing a Palestinian state.

Hardly a surprise. The leader of the NDP endorses the Khalistani movement who blew up Air India and killed Prime Minister Indira Gandhi.

Mediators are making efforts to restart cease-fire talks between Israel and Hamas to halt fighting in the Gaza Strip, a day after an international court ordered Israel to scale back military action in Rafah.

Restarting talks would depend upon whether Hamas agrees to engage, Arab mediators said. Hamas has been approached but has not yet agreed to participate, said Arab mediators.

The U.S.-designated terror organization cited what it described as a concern that Israel isn’t serious about reaching a deal? The ICJ order represented the third major international pressure point placed on Israel in the past week.

Israel is a party to the 1948 Genocide Convention, which enabled fellow treaty party South Africa to bring an enforcement action against Israel at the ICJ in late December. The Convention gives the court jurisdiction over actions intended to destroy or decimate particular population groups, but not over ordinary military actions—even those that may give rise to allegations of war crimes.

Hamas, as a nonstate actor, isn’t a party to the treaty and is outside of the court’s jurisdiction, experts say.
(Having your resupply cake & eating it too?)

Last week, the Trudeau government announced they would resume funding UNRWA despite fresh evidence that their employees participated in the Oct. 7 terror attacks on Israel.

This week, the Trudeau government announced that they are banning non-lethal military exports to Israel, a supposed democratic ally.

Let’s be clear, under Justin Trudeau and his Liberal Party, Canada is no longer an ally of Israel, we are an ally of Hamas.

The transition was slow at first and then all at once, Canada has abandoned Israel in favour of the terror regime in Gaza. The Liberal government will claim otherwise but actions speak louder than words, empty words.
The Recognition of sovereignty by other governments is typically the final step. Before that, a state must have fixed borders, a permanent population, a government that is uncontested throughout its territory, and a government that has control of its own security, and foreign relations. Apart from the population in Gaza and the West Bank, the Palestinian territories do not come even close to being a state. Suggesting otherwise is pure make believe.

What’s worse, recognizing Palestinian statehood now would bestow legitimacy on Hamas and reward it for its terrorism. And yet, three European countries — Ireland, Norway and Spain — announced on Wednesday that they will formally recognize the so-called “State of Palestine” — a gesture that was quickly endorsed by the NDP….’cuz NDP.

In addition to being a mockery of long-established legal principles, the universal recognition of a Palestinian state, at this juncture, would be the ultimate vindication of the unspeakable atrocities committed by Hamas on Oct. 7. The global community rolling out the red carpet to a blood-soaked Palestinian delegation would be tantamount to a full endorsement of the use of wanton violence as a tool of “liberation,” adding tactics like organized rape and torture to the respective playbooks of militant organizations like ETA, in Spain, or the PKK in Kurdish Iraq and Turkey.

There’s no permutation of the “State of Palestine”, at present, that does not involve Hamas. Hamas is heavily favoured over moderate rival Fatah in both Gaza and the West Bank. Polling indicates it would beat Fatah by a 2-to-1 margin if parliamentary elections were held today, winning a near-majority of seats in the dormant Palestinian Legislative Council.

As of March, seven in 10 Palestinians said they approved of Hamas’s barbaric actions on October 7. The October 7 attacks will only become a bigger political winner if Palestinians see continued momentum toward international recognition in the weeks and months to come.

A near-term ”State of Palestine” would unavoidably be a de facto Hamas state. For the sake of both the international order and Canada’s own territorial integrity, the Trudeau government must dispense with its opportunistic posturing and voice a hard “no” to both…so 9 to 1 he won’t.

So, is Palestine a State? A Country? A Region? A Concept? Something else?

If Palestine is a State or Country or Nation or Sovereign Entity or what have you, who controls it? What are its borders?

Disturbing video footage released on Wednesday shows five female Israeli soldiers covered in blood and surrounded by the bodies of their massacred comrades while being threatened with rape after being kidnapped by Hamas terrorists on Oct. 7.

Bodycam footage from the Hamas gunmen shows the moment that the young women who were operating at the Nahal Oz base outside the Gaza Strip were cuffed and pushed against the wall.

The terrorists can be heard in the video announcing their apparent plans to sexually assault the soldiers, who are ages 19 and 20.

“Here are the girls who can get pregnant,” one of the gunmen said.

“You’re so beautiful.”

The Hostages and Missing Families Forum released the video and said the tape shows the horrifying reality of the five hostages still being held against their will by the terror group in Gaza.

The women have been identified as Liri Albag, Karina Ariev, Agam Berger, Daniella Gilboa and Naama Levy.

“The video is a damning testament to the nation’s failure to bring home the hostages, who have been forsaken for 229 days,” the group said in a statement, according to the New York Post.

“The Israeli government must not waste even one more moment — it must return to the negotiating table today!”

The video, shot inside the Nahal Oz base’s bomb shelter, shows the Palestinian terrorists in control by 9 a.m. Oct. 7.

The gunmen can be seen inspecting the injured and bloodied women and calling them “dogs,” while ordering them to pose for photos with their assailants.

One of the women can be seen with blood smeared across her face, while another is seen bleeding profusely from her mouth.

One of the Israeli soldiers pleads with the gunmen to find someone who could speak English with her, while another spoke of having friends in Gaza.

The terrorists don’t listen, however, instead yelling at them to be quiet and sit down, while accusing the women of being behind the death of their comrades, who were presumably killed when Hamas overran the base.

Footage shows the terrorists stop for a moment to pray before hauling an injured woman into the back of a vehicle as gunfire is heard in the background.

Several of the women are seen limping and having trouble getting into the vehicle, as some of the terrorists shout at them to leave the bodies of their friends behind.

Women scream from inside the packed car as it drives off during the final moments of the video footage.

Albag’s mother, Shira, said it was hard to watch the video. Families could view an uncensored version before it was released to the public.

“I can tell you that I am one of the only mothers who have seen the video,” Shira Albag told public broadcaster KAN. “Most of the mothers have not watched it. It is very difficult to watch.

“This is a very edited video, very censored,” she added. “It is three minutes long and does not show everything that happened there in the entire two hours — but one can only imagine.”

Gilboa’s mother, Orly, said she agreed with the decision to release the video to pressure lawmakers to renew negotiations to help release the more than 130 hostages who remain in Gaza.

“The decision-makers have time to wait — they have other goals, so this led us to release the video to the public,” she told Ynet News. “I personally have not dared to (watch) all the footage — but the decision-makers need to see what the girls have been going through for 230 days.”

“In my worst nightmares, in the biggest and most terrible Hollywood movie, I never thought I would see such a moment in my daughter’s eyes,” Orly said of the footage she viewed.

Hamas kidnapped seven female soldiers from the Nahal Oz base on Oct. 7, including Ori Megidish, who was rescued on Oct. 30, the Times of Israel reported.

The seventh kidnapping victim, Nao Marciano, 19, was confirmed dead earlier this month, allegedly killed by Hamas terrorists inside Gaza’s al-Shifa Hospital, the Jerusalem Post reported.

POWs not hostages.
Based upon what definition??? These ones may have been, depending on your definition, but the elderly and children abducted Oct 7th 2023 can also be depending on your definition too, but without knowing what the definition is???

1716738866006.jpeg
The five women where spotters, soldiers who where not involved in combat but watched to see if anyone breached the fence between Gaza and the rest of Israel. They don’t fit the above definition of POW’s, so find a different definition where they (& children, and the elderly) fit and Bob’s your uncle.

1716739335730.jpeg

This one stretches further to encompass the five unarmed women in the video, but not to the non-soldier woman and children and elderly abductees from Oct 7th, so a different definition might be needed assuming one exists.

In the nature of having your cake and eating it too, though…if these five women are really POW’s…are they being treated as POW’s or are they being treated as hostages? That alone would be very telling with respect to their status as either hostages or POW’s. The fact that nobody knows the status or location of these “POW’s” alone makes them hostages as opposed to POW’s using the Geneva Convention definition above that is the only one loose enough to include them in the first place that I’ve stumbled across so far this morning.

POWs must be military personnel. These are clearly hostages. Unless you are a terrorist supporter, and even then this goes well beyond the bounds of POW treatment.
Not necessarily…being military personnel, I mean, but…they have to be involved or following the troops or…there’s a whole list of prerequisites, & must extend beyond the fact that they were Israelis inside of Israel on Oct 7th.
I think the Geneva convention goes on to define the responsibilities of the jailer holding POWs. I don't think threatening them with rape is included in those guidelines.
You’re correct. Same with hiding them and not disclosing their status or location. As currently defined by the Geneva Convention, these people are not prisoners of war, but hostages based upon the actions of Palestinians, Hamas & Friends, etc…but maybe the Geneva convention definition is not the definition being used???

They are IDF captured at a military base. Read the post. Dont assume.
Those particular five women of the 253 (or so) hostages taken that day, yes.

Part of being considered a prisoner of war is their treatment afterwards. Are they being treated as prisoners of war, or are they being treated as hostages?

Maybe I should expand a bit. These particular five women, where unarmed IDF Spotters, at a military base, the morning of October 7th 2023….when approximately 3000 Palestinians (including Hamas and other militant groups in amongst the Palestinian civilians) entered Israel to do what they did.

Yes, these five women in particular were IDF unarmed spotters at the Nahal Oz military base in Israel. That’s why I called them Spotters above in post# 2533, and explained that they where non-combat soldiers (=IDF) in trying to inquire as to what definition was being used to consider them as POW’s. These 5 women are 5/7 taken from that military base Oct 7th, that haven’t be repatriated alive or otherwise.
That morning about 500 hostages were taken, but about half of them were rescued before they were taken outside of Israel.
In the 7 months, 2 weeks, & 4 days since this happened, have these five women and the other (who knows how many surviving hostages there really are?) Israelis kidnapped that day being treated as POW’s (?) or are they being treated as Hostages? There is a difference.
By what definition are you considering these five woman as prisoners of war? Granted, Hamas (the governing body of Gaza) are not going to be signatories to the Geneva convention, but if that’s the definition you’re using…there’s more to being a POW than the initial capture.
1716746191117.jpegDepending on the definition that you’re using with respect to POW’s, 77-year old Hanna Katsir or 13-year old Yagil Yaakov might also have been (or not) prisoners of war…but without you explaining your definition of POW’s regarding these five woman in particular, who knows?
Does this sound like the treatment of prisoners of war? It might depending on the definition I guess…

Anyway, Hamas fired a barrage of rockets from Gaza that set off air raid sirens as far away as Tel Aviv for the first time in months on Sunday in a show of resilience more than seven months into Israel's massive air, sea and ground offensive.

There were no immediate reports of casualties or damage in what appeared to be the first long-range rocket attack from Gaza since January. Palestinian militants have continued to sporadically fire rockets and mortar rounds at communities along the Gaza border since then.
1716747710611.jpeg
Hamas' military wing claimed the attack, and rocket launches could be heard in central Gaza. The Israeli military said eight projectiles crossed into Israel after being launched from the area of the southern Gaza city of Rafah, where Israeli forces recently launched an incursion. It said “a number” of the projectiles were intercepted.
Then on the northern Israeli border from a different Iranian wing:
Earlier, aid trucks had entered Gaza from southern Israel through a new agreement to bypass the Rafah crossing with Egypt after Israeli forces seized the Palestinian side of it earlier this month. But it was unclear if humanitarian groups would be able to access the aid because of ongoing fighting in the area.

Egypt refuses to reopen its side of the Rafah crossing until control of the Gaza side is handed back to Palestinians. It agreed to temporarily divert traffic through Israel's Kerem Shalom crossing, Gaza's main cargo terminal, after a call between U.S. President Joe Biden and Egyptian President Abdel-Fattah el-Sissi, etc…

Hamas claimed to have captured an Israeli soldier during fighting in northern Gaza and released video late Saturday showing a wounded man being dragged through a tunnel (perhaps an actual POW?). The Israeli military denied any of its soldiers had been captured, and Hamas did not provide any other evidence to substantiate its claim.
