British sailor acquitted in gang rape case at Halifax-area military base

HALIFAX — A young woman hurriedly left a courtroom Friday after a judge questioned her credibility and acquitted a British sailor accused in an alleged gang rape at a Halifax-area military base.

Darren Smalley was charged with sexual assault causing bodily harm and participating in a sexual assault involving one or more people in barracks at 12 Wing Shearwater on April 10, 2015.

But Justice Patrick Duncan said he did not believe portions of the complainant’s testimony and concluded the charges had not been proven beyond a reasonable doubt.

“It is my impression that the complainant was selective in how she presented her evidence of her conduct throughout the evening,” Duncan said in Nova Scotia Supreme Court.

“She maximized that evidence which supported her narrative and minimized any events that might be inconsistent with her narrative.”

Smalley, who is in his late-30s, showed no emotion after the verdict, while the young woman, who is in her mid-20s, wore a stern stare as she left with a group of supporters.

Outside of the courtroom, Smalley told reporters he was relieved.

“It’s been four years of my life,” said Smalley, wearing a grey suit and speaking quickly. “It’s took a toll on me mentally and physically.”

Ian Hutchison, Smalley’s lawyer, said his client will now return to the United Kingdom and will be “moving on with his life.”

“It’s a very difficult day for him, it’s a very emotional day. It’s a difficult day for all the parties before the court this morning,” said Hutchison.

The woman and a friend had met the men, members of a Royal Navy hockey team in Halifax for a tournament, through Tinder.

The complainant testified at Smalley’s trial last fall that she fell unconscious while lying in bed next to a sailor, and later awoke face down and naked as at least three men sexually assaulted her.

Duncan said the complainant’s testimony was inconsistent with the accounts of other witnesses who were inside the barracks that evening.

He said he did not accept her testimony that she lost consciousness, noting that she had not consumed enough alcohol or other substances to be impaired, nor was there any medical evidence to explain why she lost consciousness.

Duncan said her friend testified that when she came into the room after the alleged assault, the complainant expressed concerned that compromising photos were taken of her. He said that evidence indicated the complainant was fully alert at that time, and contradicted her testimony.

“It’s impossible to know where the truth begins and ends in this matter,” said Duncan, adding that he found the complainant’s friend to be a more credible witness.

“Obviously something of a sexual nature occurred in that room. Maybe it was a criminal offence, maybe it was not. But without credible evidence, it is unsafe to convict.”

Duncan said the complainant is intelligent and well-spoken, but characterized her testimony as “controlled.”

“The degree to which she prepared herself as a complainant from the outset has undoubtedly influenced the manner in which she presented her evidence,” he said.

“If demeanour was the only gauge of truthfulness of her testimony, than she would be viewed as highly credible, however demeanour is a notoriously poor gauge of truthfulness or reliability.”

Prosecutor Eric Taylor said the Crown disagrees with Duncan that the complainant’s testimony was not credible. He acknowledged the woman’s loss of consciousness and the difficulty explaining it was a challenge for the prosecution.

“The credibility was the central factor in this case,” said Taylor outside of court. “We felt the inconsistencies were minor and that the complainant’s credibility was clear throughout, but the court found differently.”

Smalley did not testify at the judge-only trial.

Four men had originally been charged, but charges were dropped against two of them before trial, while another man’s case was stayed after he became ill.

Taylor said the Crown will make a decision on whether to reinstitute the charges against one accused, Simon Radford, before the expiry of the stay of proceedings this October, and Smalley’s acquittal may impact that decision.

Mixed feelings ... Was a fellow sailor just saved from being railroaded or was the victim not bright enough to state her case properly.

Maybe, we'll never know if justice has been served. I sure don't know.

VANCOUVER — A British Columbia man acquitted of terrorism-related charges has filed a lawsuit against the provincial and federal governments, arguing he was maliciously prosecuted in violation of his charter rights.

Othman Hamdan was charged in 2015 over 85 Facebook posts in which he supported some actions of Islamic State militants and celebrated “lone wolf” terrorists. Last year, a B.C. judge ruled his comments might have been offensive, but they didn’t constitute inciting terrorism.

(And how are govt security forces able to read minds and determine which on line posts are just hot air and which are lethal threats? Anybody who supports Isis in any way or thinks that these lunatic lone wolf terror attacks are a good thing is clearly UNSUITED to be A Cdn citizen!)

Hamdan has filed a lawsuit that argues Canadian and B.C. authorities prosecuted him despite the absence of probable grounds supporting his guilt and chose to ignore a body of evidence that supported his innocence.

(Just because a LIE-beral hug a thug judge is not willing to convict- DOES NOT mean the guy is innocent! Vote hungry LIE-berals are more interested in buying Muslim votes than in weeding out terror- how else to explain their refusal to even deport CONVICTED Muslim TERRORISTS?)

“The conduct of the defendants was reckless, intentional, deliberate, in disregard of the plaintiff’s rights, indifferent to the consequences and exploited the plaintiff’s vulnerability,” says the notice of civil claim filed in B.C. Supreme Court.

Hamdan, 35, is a Jordanian national of Palestinian descent who came to B.C. after living in the United States and was granted refugee status following the 9/11 terrorist attacks. He has been detained pending the results of an immigration review.

(I say send the goof back to Palestine- its where he belongs- with the other crazed killers! He has already had ample opportunity to insult us!)

At the time of his arrest, he was living in the northern community of Fort St. John. The Facebook posts were written between September 2014 and July 2015, with one reading, “Lone wolves, we salute you.”

(Yes- he is definitely NOT ALIGNED with main stream Cdn sentiment - but he does have LIE-beral values! Meaning hatred of western white society! Perhaps lunatic LIE-berals think he can be “a powerful voice in Canada” - along with his returning Isis brethren?)

(It is a tribute to how slippery and slimy and poisoned LIE-beral morality is- that that Hamdan has not been charged with hate crimes! After all- his support if radical Muslim killers is certainly inciting hate against white people!)

In acquitting Hamdan, B.C. Supreme Court Justice Bruce Butler wrote that he “was trying to highlight what he perceived to be hypocrisy and injustice, support some of the actions of the Islamic State in its defence of Sunni Muslims in Iraq and Syria and promote discussion about these issues.”

(“Lone wolves, we salute you” is a specific attack on the west- which the judge chose to ignore- so LIE-berals could continue sucking up to the Muslim voters! LIE-berals assure us that honest dialog can resolve all problems- so why are morally challenged LIE-berals APOLOGIZING for a Muslim who is advocating violence- clearly shameless LIE-beral vote buying trumps all other needs!)

Hamdan says in his notice of civil claim that he only learned during trial that the sole evidence being presented against him was the online posts, which he says are constitutionally protected speech and “woefully inadequate evidence to secure a conviction.”

(“Constitutionally protected speech”?? In defense of twerrorists? These vile radicals play word games with our laws and rights! And we MUST ASK WHO is paying for this guys legal representative? If its legal aid then LIE-berals are REALLY INSULTING US!)

None of the allegations contained in the lawsuit has been proven and no statements of defense have been filed.

Hamdan alleges the Crown never presented the full body of evidence in their possession — hundreds, if not thousands of posts — but simply chose particular posts which fit their theory of the case.

(Of course not all posts were considered- there was no need! Mass murderer Jeffery Dahmer met many people in the course of a day- but the cops are only interested in the ones he killed and ate!)

“The only purpose of the plaintiff’s incarceration has been to disrupt him from having access to a computer to voice constitutionally protected speech, in violation of his charter rights,” says the lawsuit.

(The opportunity to publicly support groups who would injure and kill Cdns IS NOT a constitutional right! Supporting Isis is a hate crime!)

Hamdan says he remains “unlawfully” incarcerated and has suffered damages including loss of liberty, reputation, privacy and opportunity to earn income, as well as humiliation, pain and suffering.

He adds the defendants’ conduct “offends the moral standards of the community and warrants the condemnation of this court.

(The defendants conduct ONLY OFFENDS LIE-berals and radical Muslims! The main body of the Cdn community figures this guy is TROUBLE- and that he should be given a one way ticket BACK to his pest hole place of birth!)

“In doing so, they acted in a manner inconsistent with their roles as ministers of justice and with an intention to subvert or abuse the office of the provincial Crown and the process of criminal justice, and so exceeded the boundaries of the office and of the provincial Crown.”

(The ministers of the Crown are charged with keeping us safe from our enemies- and on these grounds LIE-berals are FAILING BADLY- by not immediately DEPORTING those who support Isis or other terrorists and their vile supporters!)

I do get your point.........but the principles of "reasonable doubt" and "presumption of innocence" would dictate that justice was done.........no matter what happened on the night in question.

She was dumb enough to find herself in the Shearwater barracks but because she as there is not licence to take advantage of her. Maybe she said "yes" and then "no", afterwards. Maybe, the message was not clear. It's a tough time in history to sort these things out if one party is playing dangerous games with the other.

Suffice to say, DON'T find yourself in a barracks that you do not belong in, ever.

Where do you live? Is the sea really rising or is the shoreline dropping?


Tantramar Marsh area and no, the shoreline isn't dropping. The sea is really rising. The marsh is at the head of the Bay of Fundy, the tides are getting higher each year. Our town is now having to plan for floods that are 50 year floods, not 100 or more. The dykes are no longer viable to help keep water at bay. The aboiteau's can't handle the water anymore. It's likely the area will return to being underwater instead of the isthmus it is currently.


Today we get more freezing rain and wintery mix storms than the snow of when even I was a kid. The storm we had last night gave us more rain than snow so flooding is a huge issue, which never really used to be before. We hit high 30's in summer when it used to be 25ish was considered 'high'. Heat index was not a thing here. We don't get the rain we used to do during the summer but lately when we do they remind me of storms in the midwest when I used to go there - intense downpours with lots of water instead of moderate rain. Floods are now off season too.

So yeah, don't tell me Climate Change isn't real. I'm watching it happen and while I agree it's a natural thing, I'm also not stupid enough to think that 7 BILLION people didn't influence ANY of it. That's just plain illogical.

The last time we had to deal with this "ocean is rising" claim from the lying climate change only makes the sea rise ( because it really global warmongering coated in fresh swamp slime), it was only in certain places, so I POINTED out on the other forum I write which is the biggest of it's type in the world, that in California they were "rising" in the same places as the Department of Land Subsidence in California had listed as subsiding for the last 75 years or so.

Another factor that affects Atlantic Canada is that the land beneath us is sinking even as the sea level rises. Manson said at the peak of the last glaciation, about 21,000 years ago, there was a very thick ice centre over the Hudson Bay region. The depressed crust underneath that ice sank as the ice grew. In Atlantic Canada, the ice cover was thinner.

“Because of the difference in ice thickness between the two areas, we were actually elevated more than normal,” said Manson, who works out of the Bedford Institute of Oceanography.

“The material underneath the earth’s crust is quite fluid. It’s kind of like sitting on a waterbed. When you sit down, when you put your bum down, it sinks underneath you but it rises up around the edges. We were on the edge and we were actually a high ground surface compared to where we were prior to glaciation.”

But with deglaciation, Manson said the material underneath the earth’s crust that shifted toward the Atlantic coast is now gradually moving back toward Hudson Bay.

“That area (Hudson Bay ) is actually rising and our land here is actually sinking, trying to go back to where it was prior to the glaciation,” Manson said.
As for sea level and AGW, after exiting the coldest point in modern man's history 160 years ago which saw glaciers reach their maximum extent in over 12,000 years it's illogical to think sea level isn't rising. If you are old enough you've seen it rise a whopping 15mm.

One has only to look at the history of the Cape Hatteras light house- built in 1870 - at a then safe 1500 ft from the sea- has now been MOVED 2900 ft from its original location to save it from being washed away as the shore erodes thanks to continental drift!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!



Or we could look at the ship canal running down St. Clair River between Lake Huron and Lake Erie- and the channel is NOW AT LEAST 20 FT DEEPER than was dredged by the Army Corps of Engineers!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Human activity along shorelines alters erosion patterns and wave sizes!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


A quick walk along the Lake Ontario shoreline around Bluffers Park Toronto reveals the FAILED EFFORTS of locals to halt erosion of the shore lines!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


All manner of steel and concrete structures ly half awash or disintegrating along the shores!!!!!!!!!!!!!!!!!!!!!!!


Each thing we build on shore ALTERS waves and currents and patterns of erosion!!!!!!!!!!!!!!!!!!!!!!!!


The dredging on St. Clair River changed the current flow and caused SUBSTANTIAL EROSION - so great that the river is now naturally deepening itself and affecting water levels on the upper Great Lakes by allowing MORE WATER to escape than in previous decades !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Various solutions have been proposed- such as installing "wing dams" across parts of the channel to slow the current- but of course the skeptics point out that the wing dams themselves will cause NEW problems as water turbulence will INCREASE around each dam and will likely result in ADDITIONAL NEW EROSION in unexpected places!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Or we could discuss the quotes from scientific papers by famous author Michael Crichton regarding the loss of snow cover on Mount Kilimanjaro!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Crichton cites papers that indicate clearly that snow loss at the mountain peak is the DIRECT RESULT of deforestation on the lower slopes!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Africans still use LOTS of wood for cooking and so the forests that once ringed Kilimanjaro ARE GONE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Sorry to burst youe bubble but guess what? It's sinking.

As for sea level and AGW, after exiting the coldest point in modern man's history 160 years ago which saw glaciers reach their maximum extent in over 12,000 years it's illogical to think sea level isn't rising. If you are old enough you've seen it rise a whopping 15mm.


So where did you get that quote from; I'd be interested in reading the whole of the article or whatever you took it from.
