Banks or Gangs? 1
I am talking about Canadian banks, I do not have much experience with US.
Most of us have heard and hopefully remember the 4 customers who lost money to their banks one by one. I really do not know details of their problems but I know details of mine and want people to know and be very careful regardless of their misplaced trust in banks. When I heard of the 4th victim I decided it was time to talk; although I was 'warned' by OBSI investigator of my 'obligation' not to talk about the investigation. What about his obligations to his job and to me to be honest, unbiased, justice and just decent human being; how about these?? Besides thing that we do in 'secret' stink. I have been a customer of CIBC for a long time and everything 'seemed OK' until I moved to London, ON when the nightmare started. In addition to small incidents, they tried to cheat me in Visa interest then tried to screw up my RRSP and when I fought back they put withhold on my accounts. I could not get any where with the bank brass let alone help to resolve the problem. From CIBC Customer Care and Ombudsman to OBSI (Ombudsman for Banking Services) all stand together to screw up customers. Although facts might be glaring in their faces but they choose to close their eyes and minds and render the most bizarre decisions. Here is what exactly happened without any exaggeration. I am an old man with health problems. Cold is not only painful but it is actually dangerous to me. For that I leave to US every winter.
I manage my accounts, and still do, well. Before my US trips I usually calculate my monthly Visa payments, if any, and estimate what I might charge in my stay and pay the total in advance. One year I spent a little over my estimate. The statement arrived just couple of days before leaving to Canada. The unpaid amount was less than $100. I figured if I sent a check, I would arrive and pay before the check reaches the bank, besides the interest would be roughly about $3. When the next invoice arrived the interest was over $12. I made an accurate calculation and even added an extra day, to find the interest less than $4. So I called CIBC Visa to correct the 'mistake'. Apparently they were expecting my call because the guy answering, cut me off right after I said "I received the invoice and..." before completing my sentence. He said in a loud serious firm voice "SIR ... we charge interest on the whole amount from the day it is posted and that is what you signed for". Notice his choice of words; whole amount. I replied also in same voice "SIR ... that is not what I signed for. What I signed for is to pay interest on the unpaid amounts only. The interest you charged me, on the unpaid amount is over 64% and that is not rip off ... it is theft" there was short period of silence then he said "how about no interest, we are not charging you interest" I said fine.
Here is what Visa was trying to do:
⦁ Normally if you pay part of the balance before the "due date", you are charged interest on the unpaid amount only. All banks do that.
⦁ I pay CIBC Visa in advance sum of money usually $500 - $1000 for 4+ months. CIBC pays me zero interest on it and it is OK.
⦁ Visa had a large portion of the purchase price already in hand before the purchase was made.
⦁ Visa wanted to charge me interest on my money that they already had in their hands, in addition to the unpaid balance!!! What kind of scam was that??
I had 2 GICs in my RRSP maturing in Dec. 2017. I went to the bank and gave my instructions in Nov. 2017 and I was ready to leave for the US. But due to an unrelated unexpected problem I was forced to postpone my travel. I went to the bank to deposit a check to find out that CIBC was trying to screw me up again. I had one RRSP GIC maturing in Dec 2015 (one of the 2 in 2017), I gave my instruction to the bank in Nov 2015 then left to US. CIBC ignored my instruction and did their own plan. At the time I thought it was an honest mistake (misplaced trust) and did nothing. Now in 2017 it can not be another honest mistake. I was angry and tried to get my instructions implemented, but CIBC was determined to ignore them to the point I asked for the police. That was useless; they did not know “banking laws”?? Or may be they know they can do nothing, thanks to the corrupt powers that be. Banking laws are set to screw up people, why? That is another discussion. In both years there were no papers printed or signed and I thought it was an effort to reduce paper use; stupid mistake and misplaced trust believing they are honest and will do it. But that was not the case, they had no intention of honoring my wishes at all; Why? Only one reason comes to mind, any guesses? I made a complaint in another branch and left for my trip after assurances that my instructions will be implemented. I received a statement in Jan. 2018 showing that my instructions were completely ignored. I cut my trip short and came back to Canada; as a result of the effect of the cold I was unable to move for 2 months. When I was able to move I went to the bank trying to salvage what I can. Things went from bad to worse; they refused to change what they had done with my RRSP as if the money was theirs not mine. They lied to me constantly. Like any sane person I did not want to keep my money in a bank like this; my trust was below ZERO. So I tried to withdraw my money and invest it somewhere else. CIBC refused to give me my money!!! I complained to Customer Care and his best offer was that CIBC is willing to implement my instructions that I gave in Nov 2017; this offer was made in Jul 2018!!! I wrote to CIBC Ombudsman (and president) and received “Rules of Engagement” from the Ombudsman, it was a war!! Customers who fight for their money are considered enemies. CIBC wanted me to sign an agreement allowing CIBC “to collect and share information and communicate with third parties”. That agreement did not have an "end date" or "list of people/organizations" that my personal information would be shared/disclosed to. Considering CIBC history with customers’ information (2004), I asked them to add these 2 points to the agreement, for me to sign. The agreement should be void after the investigation ends. The list is to limit its use to those who have direct connection to the problem. As it was, CIBC could have used it indefinitely and gave/sold my information to anyone on the street; literally. CIBC refused, why? I wrote to OBSI and first responses indicate that it is same old story; treat the victim as the guilty one and let the guilty walk away laughing. The investigator stated that the cost of my ruined trip will not be refunded because I would have "incurred it" if I stayed. I am sure he would fight like hell to get a refund if his 'pleasure' vacation was ruined. Also, he suggested that there was no need for me to come back and I could have resolved the problem by “other means”?? He did not say what these ‘other means’ are. Being 2000+ km away; letters/faxes and phone calls are the only ‘means’ I know. He chose to ignore/forget the fact that I tried very hard in person to resolve the problem before I left then after I came back without success and that was why I wrote to him!!! I went to the bank in Sep trying to take my money out, but I was told that Oxford branch manager who had created all this, put withhold on my accounts (why would she has this power???) and I was not given any reason. Few days later I decided to go to the bank and leave in one of 2 ways; leave with my money or refuse to leave until police arrests me. Fortunately for everyone, specially me, I am old with many health problems, I got most of MY MONEY. I have seen a lot in my life but I have never seen or heard of anything even close to these bizarre events anywhere in the world (OK? OBSI). Through out these events communications between OBSI and I continued. Early in the investigation, the analysis of the investigator was so bizarre I complained to their complaining office. Instead of replacing him they ignored my complaint. The final decision included reasons of justification that were so absurd I could hardly believe an investigator would produce such BS. His reasons ignored facts, made no sense, had contradicting statements, and even twisting facts or making up new ones to support his predetermined decision. Decision will be analyzed later.
In the meeting of Nov 2017, 'the financial adviser' tried relentlessly to sell me some Mutual Fund. I declined politely but she did not stop until I told her that I was not satisfied with CIBC Mutual Fund I already have. I don't think anybody should be subjected to this kind of pressure especially seniors. Although I am pretty stubborn, at one point I almost agreed just to shut her up, they know that!!! Failing to take my money for crappy Mutual Fund, she started asking me about my Tax Returns?? (strange? more than you think, next time).
These happenings are not new to some banks. The difference is; it used to be small, hidden, timidly done, infrequent and resolved if you complain; now it is an epidemic, large and brazen right in your face and you will always be on the losing end. Or may be it was the same and I did not notice because I was young and can fight. Banks that do this are specialized in taking money from Minorities and the Elderly; easy pry. I am sure there are more people losing money and don't know it because they don't monitor their accounts based on misplaced trust!! Even if you monitor your account, it will not be safe. I thought I was OK monitoring my money but alas they will not leave you alone.
Whoever said "people in finance have no sense of hummer" is wrong? What is more hilarious than these 2 items; CIBC has department/office for "Customer CARE" and OBSI logo says "Inspiring CONFIDENCE in the Canadian Financial Services"; aren't these the best JOKES ever? Personally; what I got from this experience is huge disappointment, lost confidence, and absolute mistrust.
Ever wondered why there are no actions against this epidemic of money grabbing by banks; simple.

Is anyone aware of the new CRA and the Bank's 3rd party agreement? The CRA can just put a request to the Bank's 3rd party for money that the CRA claim are in default, the bank will go into your account and seize it for the CRA with no communication to the account holder.

10 more months, however the CRA mandate won't change I afear, offshore banking is making it's mark onshore putting the Banks in an awkward position to be CRA collection agents.

CRA has the banks beat for being thieves, liars and bastards. Banks operate within legal bounds. CRA not so much.

Some years back -Bell Telephone was ordered by CRTC to PAY BACK some long distance phone charges to Cdns like me- with the amount owing being about $40.00..................................


And of course I slipped up and did not pay my monthly bill on time.................................


And Bell charged me interest on the late payment as you would expect .........................


AND THEY ALSO CHARGED INTEREST ON THE GOVT MANDATED REFUND THEY OWED ME!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


AND That I DID NOT EXPECT!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


So after going to my nearest Bell store and using their in house complaint line FOR FREE - CAUSE I AINT PAYING LONG DISTANCE CHARGES TO SIT ON HOLD WHILE WAITING TO DEMAND MY GOVT REFUND BE PAID IN FULL!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


I eventually got my full refund!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


And the really stupid thing was that Bell ALSO refunded the interest legitimately charged on the late payment!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Oh well!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Always has been like that. Worse if there isn't enough there they will wait until you make sure deposit and steal that too.

Yeah- I ran into this CRAP when I opened a savings account for my son some time back!!!!!!!!!!!!!!!!!!!


I had my mortgage at that bank and I was there in their building at least once a week.......................and one fine day I actually had



some more money to put into the savings account........................................AND IT WAS GONE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


NO ACCOUNT!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

And so I POINT OUT: ITS A SAVINGS ACCOUNT!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


The MONEY IS TO BE SAVED- NOT WITHDRAWN!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Oh..................UH............but you have not been back to th3e bank for a long time.....................................


So I remind the moron that they hold MY LIFE IN THEIR FILTHY HANDS!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

And manager RETURNS ALL MY MONEY THAT THE BANK HAS CONFISCATED!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


But of course the bank has NO CONTROL over the federal govt so that $20.00 IS GONE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


So it cost me $20.00 in govt fees to discover that having a savings account at a Cdn bank IS BULLSH+T because as soon as you are


out of the building they will start piling on new fees and REDUCING interest payments!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


And then the govt will tell us WE MUST SAVE MORE FOR OUR RETIREMENT!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


And then govt will wonder why we laugh at them!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

The CRA has always had the power to serve a requirement to pay. The document was always binding and final. No amount of bank communication with the customer would change the fact that the money was sent to the CRA.

Yes I was aware of the old system, but they had to communicate their intentions with you, with the new agreement they don't.

AS I previously posted- I had a chequing account at a big bank- that was in weekly use for my pay cheques and for my mortgage payments- and I also had a savings account at the same bank branch..................


In spite of my WEEKLY ACTIVITY over a period of years on the chequing account- the bank decided I had abandoned the savings account and it could be RAIDED!!!!!!!!!!!!!!!!!!!!!!!!!


CRA would have NO WAY of knowing that my savings account had little activity unless bank TOLD THEM!!!!!!!!!!!!!!!!!!!!!!!!!!!


Its mostly on BULLSH+T banks!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!



And yes- the LIE-beral govt GOT ITS CUT of my cash frm the bank raiders!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

When CRA reaches the point of freezing your bank accounts it means they have given up on trying to make you pay voluntarily!!!!!!!!!!


I knew a guy- this is 20 years ago- and no it was not me- who was working remodelling kitchens...................


and the guy had a rented apartment to live in and a rented workshop for his biz.............................


And he was working hard and making a success of things...........................


and CRA was rather neglected............................................


And guy got a letter to please submit his tax forms...............and forgot about the letter............................


CRA sent another letter asking him to contact their office to make an appointment to discuss his missing tax forms......................and he forgot........................................


CRA sent another letter TELLING HIM to come to an appointment on a specific day and time..............to discuss his tax obligations......


And he got a real nice profitable job and forgot about the appointment...................................


He got one more letter ORDERING HIM to appear for an appointment or legal action would be taken!!!!!!!!!!!!!!!!!!!!!!!!


And he forgot..................................just too busy making money...........................



And one Sunday morning he found out the hard way you can only ignore CRA for so long..........................


A loud knock at the door woke him from sleep.........................


A CRA agent. with cops and lock smith were at the door with assorted papers and DEMANDS!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


Give us the keys and ownership of your car- license number etc!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Of course the CRA has to inform you, but when has the bank ever had to correspond with anyone before acting on a CRA demand? If that process is now disclosed in bank documentation it's only to let you know how it works. The bank has never had any option but to comply.

Thank your bank for creating more fine print. Everyone reads the fine print.

From comments I think it was misunderstood that when teller asked about my tax returns it was because I owe CRA money, no she asked for TFSA account that has nothing to do with CRA. I wanted to write all same time for clarity. Nobody has time even for important stuff, read this to understand.
In part 1, I wrote about details of my horrible experience with CIBC. Their refusal to implement my instruction for my RRSP and doing their own plan. Then when I fought back CIBC 'withheld' my money for NO REASON and I could not get it for along time. CIBC attitude was 'if we can't get your money, you will not get it either'. They do it just because they CAN, thanks to the powers that be. But I got most of it. I was given $500 'compensation' and denied all other claims, but I am still fighting.
Now, I hope we all remember CIBC fiasco of 2004. Customers' information was sent to a US citizen. When the news became public, CIBC declared that it was going to sue the American. The whole thing was so bizarre, there are many questions left unanswered.
1. Why was customers' information sent to anyone in US? Was it sent by error or was it sold and a deal gone bad?
2. Why did the American go to the media? Negotiation ended bad?
3. Why did CIBC wanted to sue the American instead of thanking him for alerting the bank to the problem; if it was really an error? Did CIBC want to keep it quite and not report it? Obviously CIBC could not sue because the American did not hack CIBC computers, they sent it to him!!
4. What happened? This was a huge breach of customers' privacy, was there any investigations by CIBC, anyone government/privacy commissioner/police?
5. What ever happened to the person who did it, whether it was an error or intentional?

That should have been a red flag for me, and it was. But where would I go, most other banks are in the same boat. Ask the financial regulators. Here are my experiences with other banks:
CIBC: you have read what happened recently and information fiasco. Here is something else; about 10 yr ago, in Mississauga, I had an account. I went to the branch to withdraw cash to buy a computer. The teller got the money and sat on his chair and put his hands with the cash under the desk on his lab and 'counted' it. Brought his hands up on the desk and asked me if I wanted it in an envelope. I replied "do you mind if I count them first?" He put his hands down again with the money under the desk, then gave it to me. While I was counting the money he used his phone to talk to someone. Leaving the bank and going to my car, I noticed a car standing idling and people inside starring at me. I did not know what it was, it was just strange. I went shopping but did not buy computer. When I got home I found out that passenger side door was damaged and somebody broke into my car, I did not loose money it was with me (1).
Bank of Nova Scotia: 30+ yr ago I had an account with a branch close to my home. Then I got very busy at work, I had to work late every day and in weekends. I had to get another account with RBC close to work. I waited until first chance to close my account with Scotia bank about 3 months later (not sure). When I went to withdraw the money and close the account the teller looked at her terminal and said "that account is closed". She did not elaborate, that was it; probably expected me to just leave. I said "who closed it? I did not close it and what happened to the money?" She went and brought some people to look at the terminal (they could have done that in their offices). Then she told me that "the account is dormant". I asked shouldn't they have notified me and what happened the money. Now she knew I was not just going to leave my money. She said that to reactivate the account I had to make a transaction. That was exactly what I asked for first thing; withdraw the money!!!
Royal Bank: 20-30 yr ago I had a cashable progressive/escalating GIC. First year has the lowest and final year has the highest rate. Unfortunately I needed the money one year earlier than maturity. Of course I lost final year's interest. The redemption paper had 9 in all digits of the certificate number instead of the real number, it was strange. Because I did not know what it was I did not say anything but I kept it. On tax time I received the tax form for interest earned; it showed the total interest at maturity including final year. It was significantly higher than what I got, interest rates those days were double digits. I took the tax form and redemption paper to the bank and told the teller to either give me the difference or correct the tax form. Tax form was corrected. It looked fishy to me so I wrote to the head office; I thought they should know. I was not looking for anything not even thanks. I told them what happened and I got it corrected. The reply I got was strange, it basically said: you got it corrected, so? About 5 yr ago I moved to Niagara Falls and manager of RBC tried to convince me to use Online Banking emphasizing that it was zero liability to me if I did not do the transaction, but I was still not comfortable. Not long after that, just few days, my card did not work at ATM. I went inside and got the money and the card was fixed. Couple of days later I was blocked out trying to use my card. I went inside; first thing they did was to accuse me and ask what I did!! Contrary to what they tried to sell me about Zero Liability??? Although not one cent was missing, first thing accusations were flying. Then I found out that a new card was ordered and I did not receive it. After that I closed my account.
Bank of Montreal: I opened an account with BMO after closing my account with RBC. The account I chose was checking with zero monthly charge if balance is above certain amount. The minute I moved to London, ON the bank started to charge me a rather large monthly service charge without giving any notice. I took the account agreement to a branch in London and asked for refund and account closing. I refused to consider keeping the account after the refund.
TD: 10-20 yr ago I had an account with TD. I needed quarters ($0.25) for laundry machines, I usually give the teller $10 bill and she takes a roll of quarters from the drawer and gives it to me. That time the teller took the roll from the drawer and put her hands down under the desk for few seconds then gave it to me. It was strange, and at home I counted the quarters to find that she took one quarter; she did all this to steal ONE quarter, if she had asked me, I would have given her 2 quarters!!! (2).
What kind of people do banks hire? What process or interview do they go through? Do banks send someone to stand on the street and pick people? Do banks ask any questions other than if wages are acceptable? Then OBSI investigator says; I have to take banks employees' word for it, really Mr investigator? No offense to good employees, bad apples stink the whole bunch. As I mentioned to OBSI, banking employees are a segment of society. They do as the rest and act like others, they have the Good, the Bad and the Ugly, also.

I wrote to the office of the Federal Finance Minister that told me to use the “complaints processes”!!
Ever wondered why there are no actions against this epidemic of thefts by banks, simple.
