Court ruling quashes approval of Trans Mountain

VANCOUVER - The Federal Court of Appeal has quashed the approval of the contentious Trans Mountain pipeline expansion.

The decision means the National Energy Board will have to redo its review of Kinder Morgan Canada's project.

VANCOUVER -- The Federal Court of Appeal court combined into one case nearly two dozen lawsuits calling for the National Energy Board's review of Kinder Morgan Canada Ltd.'s project to be overturned.

First Nations, including the Tsleil-Waututh and Squamish on British Columbia's south coast, argued the federal government did not adequately consult them before the energy board review or the cabinet decision to approve the project.

Lawyers for the federal government told court that Ottawa conducted extensive consultation.

Environmental groups and the cities of Vancouver and Burnaby also challenged the project in Federal Court last fall, supported by British Columbia, which was an intervener.

Alberta was also an intervener and the province's lawyer told the court that Ottawa's decision to approve the expansion was based on evidence that considered environmental, economic and Indigenous interests.

Kinder Morgan shareholders are also set to vote today on whether to approve the sale of the pipeline and expansion project to the Canadian government for $4.5 billion.

They refused to fully consult with the Feds, wanted far too much and got stuck with the minimum.

The Federal Court decision will effectively compel the NEB to repeat the third phase of its consultation process, which it carried out between February and November, 2016.

Time to change some judges in this country, I fully expect an appeal to the Supreme court and look at the merits based on law not feelings Lol.


Not the big win that they were looking for from Flossy's article, but enough of one to complicate things

The court also concludes that the federal government failed in its duty to engage in meaningful consultations with First Nations before giving the green light to the project.
That decision means the government will have to redo part of its consultations with Indigenous groups.

Too bad this bought decision can be overruled by the government.
also you seemed to have over looked the fact that all the construction workers and their unions involved are not anxious to loose any pay and may just continue with construction. After all who is going to stop them? And then there will also be lawsuits flying around by everyone with a financial interest including all the bands along the route that were expecting significant financial rewards just for having claimed the land along the route.

Really?? Which University will accept grant money to provide a paper that has the conclusion in summation before the ink is dry on the check? What method that needs the least time on repairs would seem to be important when it comes to devices like pipelines. Event planned and constructed and 70 years later review and repair and add all of that into the 'play-book' when planning similar event in other places. The mistakes we made in being 'pioneers' would mean somebody else that does the same type of construction gets the good parts and is able to avoid the bad parts.

Oh, don't worry genius, this decision to hobble our economy will change every aspect of our lives. If it's security and sufficiency you're looking for, we just took a big step away from that with this ruling. Bend over, the big fist of change is coming...have fun.

It is. Thier compassion for mother earth should have driven them to pure electric by now, if they could find any. Of course global warming adherants are not science fans by any means, warming worried me when in the first years of its popularization but that little warm blurb is well and truely over for the next decade or so, if we are very lucky. In any case climate change is also civilization change. Eating the neighbours will not be uncommon. How much bacon does Mentalflush carry do you suppose?
He should be invited to dinner.

Wrong. "Consult" is not a scientific term. In fact, even though the courts have made it a legal requirement, nobody knows what it means. How much yakking back and forth does it take to meet the legal standard for consultation? Nobody knows. No legal standard has been set. Any indigenous group wanting to stop or delay a project can claim they were inadequately consulted. The courts created this mess.
