Encarnacion's lawyer calls STDs claim 'completely inappropriate'

TORONTO — A New York woman is suing Edwin Encarnacion, alleging the Toronto Blue Jays slugger knowingly infected her with two sexually transmitted diseases.
Ashley Lebron, 24, filed the lawsuit in a New York court on Monday. She says in a statement of claim she contracted genital herpes and chlamydia after having unprotected sex with Encarnacion in February. She’s seeking US$11.5 million in damages.
The documents contain allegations that have not proven in court.
Encarnacion hasn’t spoken publicly about the lawsuit battery. His agent, Paul Kinzer, didn’t immediately return a telephone message Tuesday but in a statement released to Fox Sports and others called the claim “completely inappropriate and meritless.”
Kinzer added Encarnacion “will take every legal measure to defend himself against this frivolous claim and will bring appropriate claims in the appropriate forums against all of the individuals seeking to exploit his financial position.”
Encarnacion, 33, was batting .268 with 101 runs-batted in and 35 homers heading into Toronto’s home game Tuesday night against the Los Angeles Angels. He’s in the final season of a four-year, US$39-million deal that will pay him $10 million in 2016.
Lebron says in her statement of claim that her family has long been acquainted with Encarnacion’s. She says she met the player in 2013 when Toronto was playing in New York and that Encarnacion provided tickets to the game for her and her family.
Lebron says in court documents she and Encarnacion met again in September 2015 in Baltimore.
In February, Lebron said Encarnacion invited her to the Dominican Republic. Court documents allege he purchased round-trip plane tickets for her, arriving Feb. 13 and leaving Feb. 15, although he later changed the departure date to Feb. 16.
According to the court documents, Lebron and Encarnacion had unprotected sex on more than one occasion while in the Dominican.
When she returned to New York, Lebron claims she began experiencing body aches, headaches, a fever and chills as well as a stinging sensation when urinating. The statement of claim says Lebron went to hospital and was told she might have a urinary tract infection.
Shortly afterwards, Lebron claims she went to another hospital where she was diagnosed with genital herpes and chlamydia. She said the hospital informed her “she most likely contracted herpes from her last partner, which was Encarnacion,” the statement of claim says.
After informing Encarnacion about her conditions, Lebron alleges he said he was “clean.” Lebron adds in the documents that Encarnacion claimed she may have picked up the virus when they went four-wheeling and swam in a river but eventually agrees to get tested.
Lebron also claims Encarnacion contended on Feb. 26 that he had papers proving he was “clean.” But, according to the statement of claim, after asking him repeatedly if he has received his test results, Lebron alleges Encarnacion told her the results hadn’t come back.

Allegations that Blue Jays star Edwin Encarnacion knowingly infected a family friend with sexually transmitted diseases are “frivolous” and “meritless,” his agent said Tuesday.
Ashley Lebron, 24, alleges in civil lawsuit filed in U.S. court that she contracted genital herpes — a non-curable STD — and chlamydia, which is curable, after having unprotected sex on three occasions with Encarnacion in the Dominican Republic in February 2016.
Lebron is seeking $11.5 million in damages, alleging Encarnacion, 33, inflicted “bodily harm” by having unprotected sex that exposed her to the STDs without disclosing his infectious condition.
None of the allegations have been proven in court.
Paul Kinzer, Encarnacion’s agent, said in a statement sent to the Toronto Sun that Encarnacion won’t be commenting on the civil suit but will respond in court to the allegations.
“He will take every legal measure to defend himself against this frivolous claim and will bring appropriate claims against all of the individuals seeking to exploit his financial position,” Kinzer said.
“This is an unacceptable attack on his exceptional character and stellar reputation within the baseball community as a man who carries himself with the highest level of integrity.”
The Jay’s designated hitter earned $10 million this year and will become a free agent at the end of the season. He’ll receive a substantial pay hike based on his stellar performance this year.
Lebron, who lives in New York, maintains in documents filed with the U.S. District Court that Encarnacion grew up across the street from her aunt in the Dominican Republic and that her family had been friends with his for years.
However, she first met him on August 20, 2013 in the Jays’ “Family Room” in Yankee stadium after he provided four tickets to a Jays/Yankees game for her, her aunt and a friend of his.
Two years later, the court documents suggest Lebron reconnected with Encarnacion and at his urging was introduced to an unnamed Jays teammate.
That led to an invite for her and a friend to attend a Jays versus Baltimore Oriole game during the height of the Jays’ successful pennant race in September 2015.
Lebron claims the teammate fed her “weed chocolate,” making her “very high,” and both smoked marijuana from a “weed pen” before they had protected sex in the hotel where the Jays were staying.
The unidentified teammate — not a defendant in the lawsuit — isn’t alleged to have done anything wrong.
In December 2015, after experiencing “certain issues,” Lebron had herself checked but tested negative for STDs, although she was diagnosed with “bacterial vaginosis.”
After the Jays season ended, Encarnacion invited Lebron to the Dominican and paid for her round-trip air tickets where she stayed with her aunt “Chave” in La Romana in February 2016.
Lebron maintains she twice rebuffed Encarnacion’s advances at his house but had fun four-wheeling, dancing and playing pool with him.
Then, after a night of excessive drinking, dancing and some weed smoking at Encarnacion’s home, Lebron and Encarnacion had unprotected sex on the night of Feb. 13-14, the lawsuit alleged.
They drank champagne, shared a joint and later that night, had unprotected sex, according to the legal document. Encarnacion claimed he didn’t have any condoms at the time, the suit alleged.
They had unprotected sex on two more occasions and Encarnacion spent Valentine’s Day with his girlfriend Karen Yapoort.
Shorlty after returning to New York, Lebron says she was diagnosed with herpes and chlamydia, the lawsuit alleged.
Robert Hiltzik, a New York attorney representing Lebron, told the Sun his client has been “very upset” since being diagnosed with STDs and will be “suffering for the rest of her life” with the stigma and health issues they present.
Reached by phone Tuesday afternoon, Hiltzik said his client — who lives in Nassau County, New York — won’t be speaking with media.
“The complaint really speaks for itself,” he said. “We stand by what we wrote.”
When asked why the lawsuit was filed now, he said they “did try and resolve it in another fashion.
“And it was clear that that was not going to happen,” he said. “So we really had no choice.”
Encarnacion is not a citizen of the U.S. but Hiltzik believes there is still jurisdiction in New York to allow the case to proceed.
“We think there’s enough of a connection in this, given the details of this matter,” he said.
Hiltzik added they have been in touch with Encarnacion’s counsel.

TORONTO - In two years or less, Blue Jays slugger Edwin Encarnacion and family friend Ashley Lebron could be squaring off in a civil trial over allegations he knowingly infected her with two STDs.
Lebron’s New York lawyer, Robert Hiltzik, said the trial could take place by 2018 or earlier.
“Federal courts move relatively quickly. There’ll be some motions, but after that, there could be a trial within two years or sooner,” Hiltzik said in an interview.
It’s also possible that Edwin’s unidentified teammate — who according to allegations detailed in the lawsuit had sex with Lebron last September in a Baltimore hotel room while the Jays were closing in on their division title — could be called as a witness, Hiltzik said.
Encarnacion — a highly touted, 33-year-old making $10 million and who will be an unrestricted free agent at the end of this season — is due for a huge raise and a lengthy contract as he’s second in the major leagues in both home runs and RBIs. That means Encarnacion will still be playing and making substantially more than his current salary when this trial occurs.
Encarnacion, who has remained silent on the issue, will be fighting the lawsuit. His agent Paul Kinzer, on behalf of his lawyer Bob Lanza, dismissed the claim as “completely inappropriate and meritless.
“He will take every legal measure to defend himself against this frivolous claim and will be appropriate claims in the appropriate forums against all individuals seeking to exploit his financial position,” Kinzer said in a statement released Tuesday.
Hiltzik denied the claim is frivolous or meritless. He said he and Encarnacion’s lawyer engaged in discussions to avert a lawsuit but it was unproductive.
Hiltzik said Encarnacion’s lawyer has to respond between 30 and 60 days and he could move to throw the $11.5-million suit or pursue other motions.
The 24-year-old Lebron had unprotected sex with Encarnacion on three occasions at his Dominican home in February, her lawsuit alleged.
Lebron, who lives in New York, maintains in documents filed in New York District Court, that Encarnacion grew up across the street from her aunt in the Dominican Republic and that the family had been friends with his for years.
When she returned home to work on a film, she experienced pain while urinating, a rising fever and weakness, her lawsuit alleged.
According to her lawsuit, she attended two hospitals within five days and was informed she had genital herpes and Chlamydia.
When she confronted him, Encarnacion insisted he didn’t “give her anything,” and she might have picked up the virus when they went four-wheeling or swimming in the river, the lawsuit states.
He claimed he only had sexual relations with one other woman and hadn’t had any sex for at least a month before sleeping with her.
None of the allegations have been proven in court.
“She suffered through a total of five painful outbreaks of herpes symptoms over the last six months and was informed by health-care professionals that this disease will be with her forever and she’ll suffer through the symptoms periodically for the rest of her life,” her suit claimed.

Blue Jays crossed off bucket list for dying young man

TORONTO - Doctors have told Jonathan Mudryk to prepare to die.
The 23-year-old has responded by trying to live as much as possible in these last moments.
The young man from Saskatoon checked another item off his bucket list Wednesday night by meeting some of the Toronto Blue Jays, with help from the Toronto Sun.
Mudryk has undergone 10 major heart surgeries for a rare congenital heart defect that left him without one of the two pumping chambers needed to oxygenate the blood for proper circulation and has led to liver damage.
Transplants aren’t a viable option.
No one in Canada has lived past their early teens with this condition and doctors have recently told Jonathan there were no treatments left and he should prepare for the end.
“They told me they don’t know how long I have left and to enjoy my life,” he said. “That’s what I’m doing.”
On Wednesday, the Sun helped arrange for Jonathan and his mother to get onto the Rogers Centre field to watch batting practice before the Jays game against the Los Angeles Angels.
Veteran Sun sports reporter Mike Ganter let the players know he was there and after the practice, centre fielder Kevin Pillar, outfielder Michael Saunders and infielder Darwin Barney stopped to greet Jonathan and autograph his jersey.
“It’s amazing ... I thought batting practice (alone) was cool,” said Jonathan, who was a little starry-eyed and tongue-tied.
Play-by-play announcer Buck Martinez stopped by to say hello as well.
“This has been a dream come true,” Jonathan’s mom, Brenda Mudryk, said.
For Jonathan, the ultimate dream bucket list item would be for the Jays to win the World Series.
Back in 1998, after a major surgery at the Hospital for Sick Children, Jonathan was invited to a hockey game at Maple Leaf Gardens by then Leafs goalie Curtis Joseph and his picture graced the cover of the Sun.
Seeing another hockey game is another bucket list item.
“I’m not able to play sports, but I love them all” — as long as they are Toronto teams, he said.
He doesn’t talk about dying, other than when he told his friend to wear either a Leafs or Jays jersey at his funeral.
“It’s been talked about and it is done. My friends think it is amazing I’m taking it so well,” Jonathan said.
Jonathan and his mother will be back at the Rogers Centre for Thursday night’s Jays game before returning to Saskatoon.
Another fond memory he will have from this trip is that it was the first time a trip to a big city wasn’t for medical reasons.
When he is back home, he will work a few hours a week at his part-time job at a bingo parlour and take in local sporting events.
Other than that, the only thing he says he will think about is being with friends.
“(His medical condition) may not be on his mind, but it is always on mine,” his mom said.

On Wednesday, a New Brunswick farm unveiled a gigantic corn maze portrait of Toronto Blue Jays right fielder Jose Bautista's iconic bat flip from the 2015 American League Division Series.
The Hunter Brothers Farm's masterpiece, which also features the slogan 'OK BLUE JAYS', pays tribute to the Jays' 40th anniversary season.
The YouTube video hit the web a day after Ortiz, the Boston Red Sox slugger, visited a Massachusetts corn maze made in his honour.

BALTIMORE -- Toronto used a three-run first inning, including homers by Jose Bautista and Russell Martin, to stay hot on the road and continue to pace the American League East.
The Blue Jays, 5-3 winners in Wednesday's rubber game over Baltimore at Camden Yards, are 36-29 away from Rogers Centre, which is good for the highest road winning percentage (.554) in the AL. The red-hot Blue Jays (76-57) kept their AL East lead to two games over the Red Sox and pushed third-place Baltimore (72-61) into a tie with Detroit for the second Wild Card spot.

Blue Jays-Angels game gets buzzed by swarm of bees

ANAHEIM, CALIF. - The thing about baseball is that you’re liable to see something new every day.
Sunday, the Jays and Angels experienced a “13-minute bee delay.”
With one out in the bottom of the third inning and Albert Pujols at the plate, suddenly Toronto first baseman Edwin Encarnacion called time and started swatting away at some unseen assailants. Soon, the players on both teams were all clustered on the left side of the diamond as a swarm of bees moved in and then slowly migrated across the field as players and fans fled for shelter.
After a few moments, the umpiring crew declared the state of emergency over and the game resumed.
Bad Baserunning, Part II
Less than 24 hours after Devon Travis ran the Blue Jays out of a potential big inning, Encarnacion did exactly the same thing Sunday.
On Saturday, Travis doubled to lead off the fifth inning then tried to advance on a ball hit to the left side of the infield. He was thrown out rather easily at third base.
In the top of the fourth on Sunday, Encarnacion led off with a double, then foolishly tried to advance to third on a hard-hit grounder to second base by Jose Bautista. He was cut down in even easier fashion by Los Angeles second baseman Cliff Pennington.
He’s Still The One
Josh Donaldson’s September numbers (.175 BA, 7-for-40, 0 HR, 1 RBI, .632 OPS) have probably taken him out of consideration to be named American League MVP for the second consecutive season, but his two seasons with the Blue Jays still rank as the best first two seasons ever by a Jays player.
Over the 2015 and 2016 seasons, Donaldson has a .948 OPS, 75 HR, 152 extra-base hits and 35 game-winning RBI. His 216 RBI are second only to Joe Carter, who posted 227 in his first two seasons with Toronto.
In 2016, Donaldson has the second-best OBP in the AL at .405, the third best slugging percentage (.554) and OPS (.959). His 99 walks are second only to Mike Trout’s 100.
Streak Goes On
Travis singled in the third inning to stretch his hitting streak to 15 games, second-longest current AL streak behind Brian Dozier. The Minnesota second baseman went 1-for-5 Sunday against the Mets and extended his streak to 22 games.
Travis is now hitting .406 (26-for-64) over those 15 games. He walked twice on Sunday, his first two during the streak.
Travis is hitting .379 in September, fourth in the AL and .341 since the All-Star break, also fourth in the league. In that span he is hitting .475 with runners in scoring position and slugging .441 in two-strike counts.
Steady Eddie
After he hit his 40th home run this weekend, Encarnacion reflected on his approach this year and took a moment to consider the company it puts him in.
He joins a select group of two Blue Jays who have had multiple 40-homer seasons, joining Bautista and Carlos Delgado.
“It’s a nice number to reach,” Encarnacion said. “I’m really happy to be a part of that group and knowing that those two guys are big horses.”
Part of his success this season has come, he believes, because he put a moratorium on contract negotiations once the regular season began. Prior to that, Encarnacion would have entertained contract discussions with the Jays, but the front office chose not to engage. Once the season began, Encarnacion was all about baseball.
“That’s why I didn’t want to negotiate during the season,” he said. “I just wanted to concentrate to help the team and make this team win and enjoy the season.”
On the same night Encarnacion hit his 40th, Troy Tulowitzki hit his 24th and talked about Encarnacion’s value as a teammate.
“The guy’s as smart as any hitter I’ve been around,” said Tulowitzki.
“Very even-keeled guy, I think that’s something people don’t realize, he’s the same guy every day whether he’s going good or whether he’s going bad. You can’t say that for everyone in this game, that’s tough to do. He’s just as solid as it comes.”
Encarnacion’s consistent power production that has seen him hit 191 home runs and drive in 529 runs over the last five years could earn him a four or five-year contract in the $100-million range. The Blue Jays have given no indication if they will be players in that negotiation but Encarnacion is well-positioned in a year when there are very few consistent power bats available.

Fantastic weekend of sports for this household. Team Canada wins. Jays take their 2nd game against the Yanks. My Riders actually win another game and then today the Jays get a walk-off run in the 9th after falling behind 3 - 2 in the 8th. Yeah Jays.

Fantastic weekend of sports for this household. Team Canada wins. Jays take their 2nd game against the Yanks. My Riders actually win another game and then today the Jays get a walk-off run in the 9th after falling behind 3 - 2 in the 8th. Yeah Jays.

If only they had not had that 2-3 weeks of sucking that choked away the division lead to the red sox. Too easy to see them have '1 bad game' on the wildcard game.

I expect a fight to break out at a hockey game but I see it happens in baseball too.

It all started when Josh Donaldson got hit by a pitch from Chase Headley - the 8th time he's been hit this year. Then JA Happ hit Headley on the bum with a pitch - that was settled with a wee skirmish. Then Severino who was in for Headley after he was ejected after the first go-to, went after Smokie missed him the first time and got him the second time. That erupted into a bench-emptying free-for-all that is just settling down as I write.

So two pitcher's are gone. The manager is gone. The guy standing in for the manager is gone - all on the Yankee's team. Haven't heard of any Jays being ejected yet. There were some pretty good punches thrown and there will be bruises tomorrow for sure. Sheesh

Martin bunts, Barney tags out at home after a super - unfortunately - save by the pitcher who got him with a bare handed ball at the plate. 2 out and Tulo is at the plate.

grille bombed out tonight, just didn't have his stuff, that's the way it goes sometimes, that
was the ball game, if he had pitched like he can, they would have gone on to win, he hasn't been
as 'lights out' lately as he had early on, hopefully he gets it back, maybe he needs a bit of time off,
but kind of late in the season for that, playoffs right around the corner, but he is older, and might
be tired.
