Tax dodgers seek break from Sask. Court of Appeal

A Moose Jaw naturopath and his wife who once contended they were “natural persons” exempt from Canada’s income tax laws are fighting to overturn their convictions and jail sentences for tax evasion.

The Saskatchewan Court of Appeal heard Friday how Douglas Preston Amell and Heidi Lynne Keyzer have declared bankruptcy since receiving hefty fines on top of jail sentences. If the convictions stand, their lawyer Doug Christie wants conditional sentences for the couple, parents of three children, so they could serve time in the community instead of a jail cell.

“We don’t want to turn someone who was misguided into a hardened criminal,” said the B.C. lawyer.

He added that the couple have had to forfeit everything of value because of the bankruptcy.

“I’m not sure how much destitution (the prosecution) feels is appropriate,” said Christie.

Crown prosecutor Doug Curliss urged the judges to let the sentences stand.

“These people continue to believe they don’t have to pay taxes,” he said.

After a full day hearing legal arguments, Justices Stuart Cameron, Gary Lane and Maurice Herauf reserved decision.

Amell, then the 42-year-old operator of the Moose Jaw Naturopathic Clinic, was sentenced in 2010 to 15 months in jail on top of one month he’d already served after he was convicted of four Income Tax Act offences, including failing to report nearly $700,000 in income, evading payment of federal tax, falsely obtaining GST credits and assisting his wife in obtaining GST credits and Canada Child Tax Benefits (totalling $15,303) to which she wasn’t entitled. He was also fined $189,796.

Keyzer, then 36, was sentenced to five months in jail and fined $33,106 for three similar offences. In addition, Amell’s father Robert Lawrence Amell, then 65, was sentenced to three months in jail and fined $20,334 for two offences. Robert Amell, also represented by Christie, appealed conviction and not his jail sentence, which he has already served.

In addition to the fines, which represent 100 per cent of the benefits illegally received and evaded taxes, the three are also required to pay the outstanding taxes plus penalties and interest.

Curliss told the court that with the three declaring bankruptcy, they’re trying to walk away from paying about $1 million.

But Christie noted that the fines will stand regardless of a bankruptcy judgment, although not necessarily the tax penalties.

Judge Douglas Kovatch, who presided at the trial, found tax returns were correctly filed until 2003 when the three executed a “contract for hire, independent agent agreement” with the clinic, where Robert Amell and Keyzer were employees. They contended any money was “compensatory,” not taxable income. No income was reported between 2003 and 2006.

Doug Amell admitted the idea stemmed from a seminar by the Paradigm Education Group. Kovatch characterized the speakers as “nothing more than the proverbial snake oil salesmen.”

Cameron pressed Christie about whether or not the Amells regret getting caught up in a “charlatan scheme” or still believe they were right. “He realizes now this was the biggest mistake of his life,” Christie replied. But Curliss noted that in reports prepared for the 2010 sentencing, they contended they had been “betrayed by the system.” Christie said they have paid income tax for the past two years.


On the conviction appeal, he argued several legal errors had been made, including issues with obtaining the search warrant; Kovatch continuing to hear evidence when Keyzer was absent due to illness; and the judge’s failure to specifically tell Doug Amell, who wasn’t represented at the trial by a lawyer, he wasn’t required to testify.

Curliss contended no errors were made, but if they were, they didn’t warrant overturning the convictions.

A B.C. anti-tax crusader, who tax authorities say counselled people to be tax cheats has been sentenced to five-and-a-half years in prison and fined $259,482, according to the Canada Revenue Agency.

Russell Porisky of Chilliwack was sentenced July 29 in B.C. Supreme Court, the CRA said in a news release. It was the second trial for Porisky and his common-law spouse, Elaine Gould, who were first tried on tax charges in 2012.

The two were found guilty at their first trial, but the pair appealed, arguing that they should have been tried by a jury, rather than by judge alone.

In 2014, the B.C. Court of Appeal ordered a new trial in the case, his former lawyer Martin Peters said.

In July, Porisky was convicted of two counts of tax evasion and one count of counselling others to evade taxes, the CRA statement said.

Gould was sentenced to one day in jail after she received six months' credit for time previously served. She was also fined $38,241 for one count of tax evasion.

Porisky advocated a theory that centred around what he described as a "natural person." He argued the government's legal definition of a person — someone who votes, owns property, receives benefits and pays taxes — is artificial, and by merely declaring themselves "natural" people, his followers could avoid paying their taxes.

Prosecutors argued during the trial that Porisky, through his group Paradigm, taught more than 800 people at paid seminars about his "natural person" theory.

Porisky told his followers that his research of the law showed the average Canadian didn't have to pay taxes because each working Canadian is being taxed as an "artificial person," a category created by government.

According to Porisky, if one declares oneself a "natural person," no taxes need to be paid. He practised what he preached.

The CRA said Porisky and Gould failed to report total income of $1.4 million between 2004 and 2007 and evaded $231,574 in federal income tax. As well, Porisky failed to collect and remit $66,149 in GST between 2004 and 2008.

No, not all freemen are radical. Most of the ones I know and am involved with simply want to change our govt to a more accountable body responsible to the people than to any corporation or foreign entity. We seek to have our freedom to live our lives as 'we' see fit and not under the rules set by a govt controlled by corporations. We don't mind paying taxes/fees to provide for policing, healthcare, education, basic infrastructure etc but want fair taxation used for the essential programs instead of corporate welfare and pork-barrel projects.

You obviously know noting about the movement itself and only a few snippets about some of the more radical persons on the fringes. The main body of the movement is actually about freedom from oppressive govt and personal responsibility for yourself & your actions without 'big brother' controlling you. We are not throwing tantrums but claiming as long as we are not infringing on your rights we can control ourselves and do not have to live by the laws you agree to live by because we choose not to have them imposed upon us by force.

The other thing I notice in this thread is a belief that freemen want to have benefit off the govt programs without paying for them. That is incorrect. Those radicals that choose to go 'off the grid' will use the phrase "waive the benefit & claim the right" which means they do not claim EI or welfare etc.

There will always be people or groups that live on the edge of society. But there are questions to be asked. When a fringe group grows, then it's time to ask if what they are saying, in whole or in part, should be examined more closely. Is the system broken? Has something gone wrong?

Perhaps this is a signal to government that they should be examining how they do business with the people who elected them. I think of Freemen of the Land as a possible symptom of a larger problem.

I was very naughty indeed about a month ago. I went and picked my own cherries at reduced cost and hence deprived someone of a job where he/she could pay taxes!

The only freeman issue I followed was a man that was charged with fishing out of season . He said a lot of hokey things but I do agree with a sentiment that he was being charged for eating food from land....law breaking simply by living
