Texas county deputy fired after police dog dies in hot car

AUSTIN - Officials in a Texas county fired a deputy whose police dog died after he left it in his patrol car for more than 20 hours on a hot day, the Jim Wells County Sheriff's Office said on Wednesday.
The office has referred the case to the district attorney for the county west of Corpus Christi for possible prosecution.
The dog handler, Latham Roldan, is thought to have let the dog, Jola, in the patrol car earlier this week without activating any of the systems the sheriff's office has in place to protect dogs from the heat, the office said.
Roldan said he forgot the dog was in the car, the sheriff's department said. Roldan was not immediately available for further comment.
Recent temperatures in the area have been in the mid-90s.
"Policies were violated and he was terminated," an official with the sheriff's department said.
"It's just a sad situation when you lose a member from our department," the official said referring to the dog.
The patrol units with kennels for police dogs have a system to turn on air conditioning, roll down windows and sound an alarm when temperatures in the units reach a certain level. The office said it appeared the system was not activated in Roldan's unit.

LOS ANGELES - The city of Los Angeles on Wednesday agreed to pay US$15 million dollars to the family of a teenager paralyzed in 2010 when he was shot by a police officer who mistook a pellet gun the youth was holding for a real firearm.
Rohayent Gomez Eriza was 13 when he was struck by a single bullet while playing near his home with two friends, according to court documents.
His family filed a lawsuit in 2011, saying the teen was "subjected to excessive force" by police officer Victor Abarca in the form of a gunshot that left the boy with "serious and permanent physical and psychological injuries."
The bullet stuck Gomez Eriza's spinal cord, rendering him paralyzed from the chest down and unable to care for himself or work, according to court documents.
A jury ruled in favour of Gomez Eriza's family in 2012, awarding them $24 million.
The city appealed, saying the details of the case made the judgment unwarranted.
"This is a tragedy for all involved, but in particular for the young man injured in this police shooting and for the officer who believed that he was protecting himself and his partner from a real threat," Los Angeles Police Department Chief Charlie Beck said in a statement following the 2012 judgment.
A police spokeswoman on Wednesday said there was no immediate comment on the $15 million settlement.
Gomez Eriza was holding a replica 9 millimetre Berretta handgun when he was shot the evening of Dec. 16, 2010, while playing with two friends who also had pellet guns, according to police.
Two patrol officers approached the youths, and Gomez Eriza pulled the gun from his pocket before Abarca fired, police said.
Following an investigation, the department and city officials determined the shooting was "in policy."
Attorneys for Gomez Eriza have criticized the LAPD for deeming the shooting justified, and said the boys, who were playing cops and robbers in an illuminated street, were not engaged in any illegal activity when they were stopped.
Gomez Eriza's shooting, and the death in 2013 of a Santa Rosa, California teen who was holding a replica AK-47 when he was killed by police, prompted debate over fake guns.
Governor Jerry Brown last year signed the "the Imitation Firearm Safety Act" which requires toy guns to be painted a bright color, or to feature florescent strips to make them easily distinguishable as fakes.

Tragedy struck the PGA Championship in Kohler, Wis., on Thursday when local cops lost one of their own.
Officials confirmed Wix, a cop dog trained in explosive detection, passed away inside an air-conditioned K-9 squad cruiser after being left unattended.
While the three-year-old Belgian Shepherd was periodically checked on by his partner, the vehicle's AC unit reportedly failed at some point and the heat alarm failed to activate, according to multiple reports.
Wix joined the Brown County Sheriff's office last April, Fox 6 reported. He was contracted to work the major championship along with his partner.
An investigation is being conducted to determine Wix's cause of death.
There have been cases of pet owners facing animal cruelty charges in Wisconsin after leaving dogs in vehicles when temperatures were extreme.

In a variation of the old "I didn't know the gun was loaded," a former Manitoba cop has admitted to accidentally shocking a potential recruit with a Taser.

Randoph Chudyk, 56, pleaded guilty to assault and received an absolute discharge Thursday.

Judge Tim Preston said the former Ste-Anne Police sergeant has already been effectively punished. Chudyk retired three months after the Nov. 2011 incident, ending an otherwise unblemished 30-year career.

Court heard Chudyk had just finished a ride along with the 40-year-old victim, an aspiring officer, when they returned to the police station and saw a holstered Taser on a table.

The victim "commented that she was concerned that it was unsafe to be left out," Crown attorney Deann Sahulka told court. "At that time, Mr. Chudyk advised her that he believed it wasn't charged, picked it up, and pointed it in her direction."

The woman had asked Chudyk to put the Taser down when it discharged, firing electric darts into her leg and groin area.

"I can't believe it happened," the woman quoted a shocked Chudyk saying.

The woman removed the darts herself and was preparing to go on a second ride-along when she started to feel sick and drove herself to hospital, Sahulka said. She was examined, quickly cleared and suffered no injuries.

Chudyk "was trying to explain to (the victim) how (the Taser) worked when it accidentally discharged," defence lawyer Daniel Wolson said. "This was an accident. He never intended to discharge that Taser."

Court heard Chudyk had not been trained to use the weapon.

"If a person is not trained in a weapon that can do serious harm, then that weapon should stay where it is," Preston said.

The woman, who suffered another setback when she later she broke her leg, "is continuing with her efforts to become a police officer, but obviously not with the Ste-Anne Police Department," Sahulka said.

Peel police officer arrested on child porn and fraud charges

A veteran officer in the Peel Regional police force has been arrested on charges relating to child pornography and fraud.
On Wednesday morning, Detective Craig Wattier, supervisor of the Technological Crime Unit, was taken into custody and charged with accessing child pornography, possession of child pornography, two counts of fraud over $5,000, and one count of breach of trust (essentially abuse of power).
Peel police Chief Jennifer Evans said, in a written statement, that Wattier had been suspended with pay, “in accordance with the current legislation under the Police Services Act.”
Wattier, who has 30 years of experience with the Peel police, will appear at a bail hearing on Thursday in Brampton.
The detective had been under investigation for fraud since April, when Evans received a complaint about the detective.
Peel police media officer Staff Sergeant Dan Richardson declined to comment, as this is an ongoing case.

The Newton officer accused of exposing himself to male drivers over a 7-month period last year has accepted a plea agreement that calls for him to resign from his job on the police force.




Under the terms of the agreement, Miller pleaded guilty to turning off the video and audio components of his patrol car's dashboard camera system "to conceal unprofessional and inappropriate conduct" between March 1, 2014 and Oct. 23, 2014.


Additionally, Miller, who is currently suspended indefinitely without pay from the Newton Police Department, will be barred from seeking employment as a law enforcement officer in New Jersey, Sussex County First Assistant Prosecutor Greg Mueller said.






An investigation was launched by the Sussex County Prosecutor's Office in late October 2014, when the Newton Police Department received two anonymous tips alleging that the 14-year-veteran of the force had unzipped his pants during "numerous" traffic stops of male drivers between the ages of 18 and 26.


Authorities said they took statements from drivers the officer had stopped, and reviewed dashboard camera footage captured from Miller's police car. He turned himself in at the prosecutor's office on Nov. 17, 2014 and was charged with two counts of official misconduct, one count of a pattern of official misconduct and one count of lewdness.


Miller, who was also ordered at the time of his arrest to surrender any firearms, remains free on $35,000 bail.


Iacullo declined to speak with reporters following Monday's hearing but last week told NJ Advance Media that if there "was anything" his client regrets it would be not "ensuring that his equipment was in proper working order or activating it so that his dialogue would have been preserved to refute these frivolous allegations."

The Philadelphia Police Department is investigating a video that apparently shows a police officer selling tickets to a police fundraiser — and making homosexual slurs.


"Either you buy these, or I take your car, because it's unregistered," the officer, identified as Officer Charles Zagursky, 32, says in the video.


The driver, identified on Facebook as Rob Stay Faded, buys the tickets as the officer encourages him to buy more, telling the men in the car they should avoid looking like "fruitcakes."


"You got any kids," the cop says. "You got any sweetheart?"


In a second video, Zagursky commented on the driver's pink windshield wipers, asking, "What's up with the f----t-*** wipers?"


Commissioner Charles Ramsey told Metro he saw the video at 8 a.m. But a member of the command staff saw it Thursday and immediately stripped Zagursky of his badge and his gun.


The 9-year veteran, assigned to the 24th District, was placed on desk duty pending investigation.


"There's no excuse for his conduct at all," Ramsey said. "There's nothing good I can say."


Ramsey said the Hero thrill show is a worthy charity that raises money for the families of fallen officers and firefighters.


"This guy has tainted that. We don't pressure people to buy tickets. We don't even pressure people internally to buy tickets, which I'm told is something that used to happen."


Metro has reached out to the poster to determine where and when the video was made, and whether it was some sort of misguided hoax.


Ramsey said he believes the video to be real, especially because of the recorded anti-gay reamarks.


"I don't think this was staged," the commissioner said.

On November 14, 2014, Kelvin Kirkpatrick, an African-American Metro bus driver with over 20 years of experience in Seattle, requested that sheriff's officers remove sleeping homeless men from his bus, per company policy. The officers weren't helpful and even lied to Kirkpatrick about why they weren't being helpful. He got back on his bus and got back to work.
Little did he know that two of the officers involved would flat out lie about the entire encounter in a report that they completed, stating that he dropped f-bombs and berated them. The thing is, that never happened—and a body camera, worn by the bus driver himself, captured the entire ordeal as you can see below the fold.

The firings resulted from an investigation into a complaint filed by King County Sheriff’s Office Sergeant Lou Caballero after an early morning argument on Nov. 14 between him and driver Kelvin Kirkpatrick in downtown Seattle, internal Sheriff’s Office documents showed.
During the argument, Kirkpatrick, a 20-year transit veteran, criticized Caballero and his deputies for not removing non-paying “sleepers” from his bus.

Caballero said Kirkpatrick yelled at him: “You got three ****ing deputies out here that don’t do nothing.” Another deputy, Amy Shoblom, attested to that in a witness statement.

Both officers have now been fired, but it shows you the frightening ease with which officers will not only make **** up, but back each other up on the fiction.

A sheriff's deputy in La Plata County, Colo., was kind enough to return reporter Chase Olivarius-McAllister's phone call about crime statistics this week.
Deputy Sgt. Zach Farnam didn't actually provide any numbers in the voicemail, but he did apparently forget to hang up and proceeded to share his thoughts about the reporter's face ("she doesn't have like a real pretty face at all"), body ("OK body"), skin ("extremely pale white"), and breasts ("f------ giant, dude") with two other cop colleagues.
The voicemail received more than 50,000 clicks on YouTube in one day.

Needless to say, Olivarius-McAllister, her editor at The Durango Herald, and the Internet weren't impressed with the message.
"I knew my not having a pretty face meant I couldn't be a model. And now, I can't even be a reporter who's treated respectfully," Olivarius-McAllister tweeted Friday.
In an interview with Jezebel, she called the officers' conversation "sickening."
"I felt incredulous that people who are in uniform, on the job, and trusted with protecting the public could express so much contempt for women," she told the website.
She also said Sheriff Sean Smith called her and said he's taking the matter "very seriously."

Actually my wording was off
One blank line between lines of text or paragraphs is called "double spaced"....two blank lines is called "double double spaced"
I found that lately when copy and pasting an article from the web, I have to hit the preview button and most of the time I have to back space the paragraphs by two sometimes three lines so that there is only one blank line in between.
I looked for an easier way of doing it, but so far no luck......
If I ever find one I'l post it....
We can't be the only ones with that problem.

"Quite truthfully, the actual rate is probably higher as law enforcement suicides are more likely to be underreported or misclassified as accidental deaths. This misclassification usually occurs to protect the family, other survivors, or the agency from the stigma of suicide," she wrote.

Compare that to 47 police officers who were shot and killed in 2014 or the 43 that are predicted to be shot and killed this year, and it's increasingly clear that people who love police officers and want to see them do well in life should seriously consider focusing on their mental health.
Instead, police departments stock up on military-style tanks and body armor, which do nothing whatsoever when your greatest pain is in your mind. Not only that, but studies are showing that as many as 25 percent of police officers are battling drug addictions, more than twice the national average.

All of this is deeply disturbing because the mental, emotional, and physical health of the men and women paid to protect us is vital for a safe and fair America, but people claiming to love police are strangely focusing on Black Lives Matter.

The family of a man fatally shot in the head by a Cleveland policeman was awarded $5.5 million on Tuesday by a federal jury in a civil case that found the officer liable for using excessive force.

The decision comes more than a year after the county prosecutor cleared the officer, Roger Jones, of criminal wrongdoing in the March 2012 shooting of Kenneth Smith after a disturbance outside a downtown nightspot.

The Smith family's attorney, Terry Gilbert, said the 20-year-old Euclid man "did not deserve to die this way" and that the jury's decision means it recognized that Jones acted improperly.

"This officer committed a horrible act by shooting Kenny Smith in the head," Gilbert said. "It was completely unjustifiable."

Also, the #1 cause of on-duty death of cops is traffic accidents. Little fact they fail to mention when they start weeping and moaning about how cops need to be on a hair-trigger to defend themselves from black children.
