A motorist must always be in control of his vehicle and drive in such a manner to be able to avoid anything in front of him. The motorcyclist was obviously driving too fast to avoid the stopped vehicle in front of him. Had the car been stopped for any other reason, mechanical failure, traffic jam, a crash, the motorcyclist and his passenger would still be dead because of the motorcyclist's inability to stop in time. I pray that this conviction will be overturned on appeal otherwise we'll have to rewrite all the rules around rear-end crashes.

We'll see in AugustThe biker was following a large camper ,his daughter was on the back of his bike and his wife was following on another bike, obviously he was too close to avoid the collision when the camper suddenly swerved out of the way and he was confronted with a stopped car, however i dont think his driving was reckless as none of the witnesses said he was driving abnormally, i believe he was going with the flow of traffic on a high speed expressway and was following the camper at a normal distance for normal conditions.
Remember also that he was distracted at a critical moment at the site of the woman walking back to her car mere inches from highspeed traffic.
IMO it would be the rare driver who would drive a half mile behind a truck/camper on the off chance there was something stopped in front of it. the biker paid the highest price for not following that far back, what price does our duck lady pay for her stupidity

I hope she has a good lawyer. I read in a law book years ago that you can not be convicted of a crime you didn't mean to commit, mind you I've also heard the motor vehicle act has a different criteria, so like you say we'll probably have to wait until August to find out. -![]()
in my opinion the motorcyclist has lots of fault in this tragedy, but i guess because she wasn't suppose
to stop at any time on the highway, which they will say for 'no' reason, she will be
considered totally at fault, but the camper was able to swerve around, so then the motorcycle should
have done the same. not expecting that something was stopped in front of the camper, for me, isn't
good enough, he obviously wasn't paying 100% attention, and was enjoying his outing a bit too much.
if he and his daughter were just injured, and would recover, how would the story be different, because
they died doesn'tchange anything she did, or anything that happened, except the charge would not be
'causing death'.

That's pretty much the way I see it, when you are driving one of the cardinal rules is you don't run into anything in front of you. I good driver always drives expecting the unexpected. I think she was very foolish in doing what she did and deserves some penalty for a traffic infraction, but she certainly didn't cause anyone's death.
furthermore, she should be charged and convicted of a valid offense. "dangerous driving" when she had already parked the vehicle? This is ****ing ridiculous.
this seems as ridiculous as charging a person for improper storage of a firearm, when the real crime is they took it out of storage and used it on someone.

Appearantly she look in her mirror, came to a complete stop, put on her flashers, the had time to walk down the side of the road before anyone came.
