About Mayors and Lawsuits.....

I just wanna know where the moral mayor club is in all this, and why they're so silent in all these threads about mayors other than Ford.

Kinda quiet.......

Toronto only. The rest of the country don't count.

If you guys ask for it I am more than happy to oblige.

My take is that it is the mayor that is accountable and not the city... At least it damn well better be... Calgary's mayor wants to make slanderous comments and broadcast it through the media? - great, fill yer boots, but I sure as hell ain't paying for that gaffe

That always becomes the issue right? When you hold public office and you speak publicly, who are you speaking for? In principle I'd say that once you hold public office, you don't speak publicly unless your speaking on behalf of your position. Which isn't saying he, and the city by default, should bear the brunt of anything he said, but that when you hold office your public words take on a whole new meaning. I do hope, for all your sakes, that the courts will find he spoke on his own behalf, even though he shouldn't have been expressing personal opinion while in office.

I think that would depend on the setting. In city hall definitely he speaks for the city. At a hockey game probably not. There would be some grey areas.

Nenshi is an idiot and he is totally in the wrong... He opened his mouth in public and slandered a man that has the capacity to launch, and fight, a lawsuit.

.. All it would take to make this go away is for the mayor to apologize, but he's too arrogant and filled with self-aggrandizement that he can't see the forest through the trees

I don't know how much of a case there really is here.

Sorry, but the Ford case seems to be the most relevant previous example here.

This is what Ford said in an interview:
""Is someone getting money under the table?" host Jerry Agar asked Mr. Ford.

"I truly believe they are and that's my personal opinion."

He also made accusing the guy of corruption part of his campaign stump speech. In the end though, Ford not only won, but was awarded partial costs.

So if Ford can win his case after saying that he thought that the owner of the Boardwalk Pub was bribing the city, I can't imagine how insinuating that this guy is like the godfather could actually lead to a successful lawsuit.

I believe that Privilege from suit is only available to MP's/Senators and Prov MLA's-MPP's when sitting in their respective House-Parliament- Not to Mayors or Councillors.

The two cases are pretty similar though.

I think it's one of the only positions one can hold (public office) where they literally have to put their own private lives on hold, at least to a certain degree. If you are out in public, and you are the mayor, then what comes out of your mouth is what the mayor is saying. Because that's the only reason people are listening to you.

Who pays for lawsuit?

The city's insurer is investigating who will pay for Nenshi's defence against the claim.

“It's worth noting that I'm not a wealthy man. I left the private sector 13 years ago to devote myself to education, public service and community work," he said in a statement.

One political observer believes the mayor and council should be covered.

"He was operating in his capacity ... as mayor about his performance [as] mayor," said Duane Bratt. "To say we wouldn't want politicians protected and have director's insurance today is the equivalent of being sued. I think it's important those people have it."

I thought I did, but ya, it's two local politicians who accused a local businessperson of illegal activity on the radio. Ford's actually seems a bit more explicit, and was repeated many more times off the radio.

But in the end, Ford was not successfully sued, so I imagine Nenshi has a good chance too.

Possibly, but Nenshi was in an election campaign. Not sure if Ford was or was he elected at the time?
