This is something that pops up in here from time to time. What risk do they pose to society after committing a crime. Unless they are violent criminals the risk is probably minimal to none. But what about Crime & Punishment? For example white collar crime, they are not a threat to society. Should they be let go? Bernie Maddoff is hardly a threat to anyone... should he not have been sent to jail.
When a rape charge or abuse charge is levied that carries a hefty social penalty even if they are falsely accused. The falsely accused are the real victims... and the ones that levies the charge is the real criminals. They should be punished.
My thoughts on that are that we should be restricting imprisonment to the violent criminals and we should come up with other methods of "punishment" for the Bernie Madoff's of the world to pay back society for their crimes.
Absolutely they should be punished but how is the question.
I think one of the main concerns here is the fact that our courts across the country are jammed, some of it by trivial cases, so (I'm not necessarily advocating prison) there has to be a level of punishment in place to put a stop to this bullsh*t.

Those are all fun things to say and I know you are kidding but the fact of the matter is the Maddof's are still living the high life and living a life of luxury. They are worth over 100 Million. They are so lawyered up and their money is so protected that their victim's will spend their lives trying to recoup what they lost.
Let him leave jail because he is not a threat and he'll be sipping wine in the Hamptons tomorrow.
The way things work right now, you're absolutely right. I'm speaking of an almost 'ideal' situation here. If the justice system can restrict someone's freedom, like a Bernie Maddoff, by putting them in prison, then they should conceivably be able to impose other restrictions. Would it be inconceivable for something like Ricoh to apply to someone like him for instance? That could compensate the victims and on top of which we could impose house arrest or make him work exclusively in a community service capacity for set number of years. Something. It's not anything that's going to happen tomorrow of course, but as much as we hear about overcrowded prisons and still having really dangerous violent offenders on the street, is it not time to start thinking outside the box a little?
Obviously this woman doesn't have the resources of a Bernie Maddoff. If, mind you I'm saying if, we are going to look at reforming the correctional system would it not be best to start with a person like this? I think she needs to pay a debt to society in general and the falsely accused in particular. All I'm saying is why is imprisonment the only way we can come up with for her to do it?
I never said they shouldn't, I just questioned the mentality that she should face worse than she is.
I suppose in the U.S. she'll likely get what she deserves, in Canada that would be highly doubtful!
