Michael Avenatti gets trial date over alleged Nike extortion

NEW YORK — Lawyer Michael Avenatti, an outspoken critic of U.S. President Donald Trump, is scheduled to go to trial on Nov. 12 in federal court in Manhattan on charges of extorting Nike Inc.
U.S. District Judge Paul Gardephe scheduled the trial at a hearing on Tuesday, according to a court record. Avenatti has pleaded not guilty to the charges.
“I look forward to a New York jury hearing all of the relevant evidence relating to Nike,” the California lawyer wrote in an email. “I have complete confidence in the truth and am confident that I will be exonerated at the end of the trial.”
Avenatti, 48, was arrested on March 25 in New York on charges of trying to extort more than $20 million from Nike by threatening to expose what he called its improper payments to recruits for college basketball teams it sponsored. Nike has denied wrongdoing.
He has been separately charged in two other cases.
In one, also in New York, prosecutors claim that Avenatti defrauded porn star Stormy Daniels, the client who propelled him to fame. They say he diverted two $148,750 installment payments from Daniels’ $800,000 book advance to himself by forging her signature in a letter to her literary agent and directing that the money be sent to his bank account.
In the other case, prosecutors in Los Angeles claim that Avenatti stole millions of dollars from clients to pay for personal and business expenses and lied to the Internal Revenue Service and a Mississippi bank about his finances.
Avenatti, who remains free on bail, has pleaded not guilty in both other cases. Trial dates have not yet been scheduled.

Daniels, whose real name is Stephanie Clifford, was paid $130,000 by Trump’s former personal lawyer Michael Cohen shortly before the 2016 presidential election to keep quiet about a sexual encounter she said she had with Trump in 2006. The president has denied having sex with her.
Avenatti began representing Daniels in litigation involving the hush money deal in 2018. He became a fixture on cable news channels as an outspoken critic of Trump, and briefly toyed with running for president in 2020.
Daniels said on Twitter on the day of Avenatti’s arrest that she had decided to terminate Avenatti’s services more than a month earlier.
Avenatti said Tuesday that he had terminated Daniels as a client on Feb. 19, and that Daniels had not indicated she was firing him at any time before then.
Cohen is about six weeks into a three-year prison term after pleading guilty to campaign finance violations related to the hush money payment to Daniels and other financial crimes.

Porn queen and Donald Trump nemesis Stormy Daniels was barred from entering Canada over the weekend for a performance at a Niagara Falls strip joint.
The blond bombshell who rose to prominence beyond the world of sexxx-rated cinema with accusations of infidelity levelled against the U.S. president was reportedly turned back at Pearson International Airport on Friday.
The Buffalo Chronicle reported that Daniels — star of Sexbots: Programmed for Pleasure, The Price of Lust and the Witches of Breastwick — may have been the victim of power politics.

Daniels, 40, had been slated for a meet and greet at The Sundowner in the Falls, which was celebrating its 40th anniversary.
Instead, the porn legend was detained, questioned and put on a return flight to Miami.
She reportedly has no criminal convictions and there was no legal premise for the decision, the Chronicle reports.

“I’m really disappointed for the fans. We had hyped the event for months and so many of our patrons were looking forward to our big 50th-anniversary event,” Sundowner owner Simo Ruden told the Chronicle.
He said the Sundowner paid her fee, flight, accommodations, and other travel expenses.
“We have never had a problem like this before booking talent from the States. We are a progressive country and welcome Americans with open arms. We are a border town and our economies are linked and I’m ashamed that she was treated so disrespectfully by our government,” Ruden added.

NEW YORK — Lawyer Michael Avenatti asked a federal judge to dismiss an indictment accusing him of trying to extort Nike Inc, saying he was targeted in a “vindictive and selective prosecution” because of his feud with U.S. President Donald Trump.
Avenatti made his request in filings on Wednesday night with the federal court in Manhattan.
Prosecutors accused Avenatti in March of trying to extort more than $20 million from Nike by threatening to expose what he called its improper payments to recruits for college basketball teams it sponsored. Nike has denied wrongdoing.
A spokesman for U.S. Attorney Geoffrey Berman in Manhattan declined to comment on Thursday.
Avenatti is also known for having represented porn star Stormy Daniels, who claimed to have received hush money not to discuss an affair she had with Trump in 2006. The president has denied having had sex with Daniels.
In Wednesday’s filings, Avenatti accused Berman’s office of having “eschewed the typically careful and thoughtful fact-gathering investigation on which it historically prides itself,” in its “zest to nab” him.
Avenatti said the office “substituted its own personal impressions” of him based on his “aggressive public persona,” criticisms of Trump, and brief involvement in the prosecution of Trump’s former personal lawyer Michael Cohen.
He said that if he were “attorney Doe,” he would not have been arrested or charged.
Avenatti faces separate charges in California alleging wire fraud, bank fraud and other crimes, and in New York alleging that he defrauded Daniels, whose real name is Stephanie Clifford. He has pleaded not guilty to the various charges.

Porn star Stormy Daniels has settled a lawsuit against the city of Columbus, Ohio, for $450,000, receiving the payout after she charged that police arrested her at a strip club in retaliation for her claim that she had an affair with Donald Trump.
Columbus police arrested her during her performance at the Sirens Gentlemen’s Club on a misdemeanor sex offense for touching three customers who were undercover vice detectives. The charge was dropped hours later.
“It could have been a lot more with a jury but we recognized that was the number that would get justice and would get attention and we agreed to that,” attorney Clark Brewster told reporters from the courthouse steps, standing alongside Daniels.
Daniels, whose real name is Stephanie Clifford, filed suit in federal court in January, alleging police were politically motivated when they arrested her. She originally sought $2 million in damages.
Daniels has described having an affair with Trump before he became president and receiving hush money through his former lawyer Michael Cohen.
Cohen pleaded guilty last year to directing payments of $130,000 to Daniels and $150,000 to Playboy model Karen McDougal to avert a scandal shortly before the 2016 presidential election.

Trump has denied having the encounters more than a decade ago with Daniels and McDougal.
Daniels’ lawsuit alleged the Columbus vice unit officers who arrested her were registered Republicans, as is the president, and retaliated by arresting her during her performance.
Brewster, Daniels’ lawyer, credited city officials for how they handled the case.
“The city of Columbus took responsibility and understood it and did a proper investigation and was critical of their own people. And today we got this case settled,” Brewster said.
Daniels said she would use the money to pay her legal bills and that she was about to start touring as a stand-up comedian.
“To do any of this, you have to have a good sense of humor,” Daniels told reporters, adding she was proud of how Columbus “took responsibility and is actively making changes and holding those officers accountable.”
Daniels and her lawyer offered no further details of what changes police would institute, and the Columbus city attorney’s office did not immediately respond to a request for comment.
Meredith Tucker, a spokeswoman for the city attorney’s office, told other media the parties reached a settlement of $450,000 during mediation, an amount that was “fair given the facts and circumstances involved.”

NEW YORK — Federal prosecutors on Wednesday unveiled a new fraud charge against lawyer Michael Avenatti, accusing him of lying to a client as part of his alleged effort to extort Nike Inc.
The prosecutors also dropped two counts of conspiracy against Avenatti from the case, which was first made public in March, according to a superseding indictment filed in federal court in Manhattan.
“I am extremely pleased that the two counts alleging I engaged in a conspiracy against Nike have just been dismissed by Trump’s DOJ,” Avenatti wrote on Twitter, referring to the U.S. Department of Justice under President Donald Trump. “I expect to be fully exonerated when it is all said and done.”
“It is obvious the government’s case is falling apart, it should never have been filed,” Avenatti added in a message to Reuters.

Avenatti, 48, became famous for representing porn star Stormy Daniels, whose real name is Stephanie Clifford, in lawsuits involving Trump and his former personal lawyer Michael Cohen. He also faces federal charges in Manhattan of stealing about $300,000 from Daniels after helping her secure a book contract.

Prosecutors had previously charged Avenatti with extortion, accusing him of threatening to publicize a claim by one of his clients, a basketball club coach, that Nike arranged for payments to elite college basketball recruits. Avenatti demanded that the athletic wear company pay the coach $1.5 million and pay himself more than $20 million, prosecutors said.
The new indictment adds a claim that Avenatti defrauded the coach. Prosecutors said Avenatti concealed the fact that Nike agreed to pay the coach to settle the case as long as it did not have to pay Avenatti, and instead continued trying to use the case for his own benefit.
Federal prosecutors in Southern California have separately charged Avenatti with wire fraud, bank fraud and other crimes, saying he stole millions of dollars from clients.
Avenatti has pleaded not guilty to all the charges against him.

WASHINGTON — The U.S. Supreme Court on Monday rejected adult film actress Stormy Daniels’ bid to revive her defamation lawsuit against former President Donald Trump over a Twitter post in which he accused her of a “con job” after she described being threatened over publicizing her account of a sexual relationship with him.

In bringing the case to a close, the justices left in place lower court decisions throwing out her suit. The San Francisco-based 9th U.S. Circuit Court of Appeals last year agreed with a Los Angeles-based federal judge who decided in 2018 that Trump’s remarks were not defamatory and were protected by the U.S. Constitution’s First Amendment’s guarantee of free speech.

Daniels, whose real name is Stephanie Clifford, has said she had a sexual encounter with Trump at a Lake Tahoe hotel in 2006 – the year after he married his third wife Melania and more than a decade before the businessman-turned-politician became president. Trump has denied the sexual encounter.

Daniels has said that in 2011, an unknown man approached her and her infant daughter in a Las Vegas parking lot and threatened her after she had agreed to talk about her experience with Trump in a media interview. Daniels said the man “leaned around and looked at my daughter and said, ‘That’s a beautiful little girl. It’d be a shame if something happened to her mom.'”


In 2018, more than a year after Trump became president, she released a sketch of the man. Trump responded on Twitter to the release of the sketch, writing: “A sketch years later about a nonexistent man. A total con job, playing the Fake News Media for Fools (but they know it)!”

Daniels sued Trump in federal court claiming defamation, saying his comment conveyed his belief that she was a liar. Her lawyers have said the judge was wrong to dismiss the lawsuit under a Texas state law that allows for speedy resolution of cases that are seen to burden the right of free speech.


Daniels was a Texas resident when she filed the lawsuit and Trump was registered as a New York resident.

The legal issue at the center of her appeal was whether such state laws can be applied in federal court when the two parties are from different states. The lawsuit was originally filed in New York but was transferred to Los Angeles, where Daniels had already sued Trump seeking to end a $130,000 hush money agreement intended to silence her over the alleged sexual encounter ahead of the 2016 election. That lawsuit was also dismissed.
