Jail ? He should have sentenced to the healing circle, nothing more.
Indeed.

Now at the other end of a sentencing shocker there is this........

Dustin Badillo, who was found guilty earlier this year of abducting a woman and her children during a two-day crime spree in 2015, was sentenced Friday to 127 years in prison, officials said.

State prosecutors and Anchorage police made separate announcements about Badillo's lengthy sentence. Back in April, it took a jury less than two hours to convict Badillo on 19 of 20 counts, which included felony kidnapping, sexual assault, robbery and burglary charges.

Anchorage Superior Court Judge Kevin Saxby said, according to prosecutors, that the 23-year-old took advantage of a woman who'd been focusing on her children. The judge also noted the many victims, four of whom spoke at the hearing.

After buying breakfast at McDonald's on the morning of April 22, 2015, the defendant stole an unlocked car just off Northern Lights Boulevard, prosecutors said. Just after 8 a.m., he ended up on a quiet residential street.

Prosecutor Jenna Gruenstein said during trial that the victim was in her driveway loading her sons, ages 5 and 3, into their car seats in the family minivan, heading out to deliver the older child to school.

Badillo approached the mother and threatened her with a gun. He burglarized her home and sexually assaulted her on two occasions. Then began a three-hour drive around Anchorage in which Badillo made the woman withdraw money at ATMs and banks, the prosecution said.

Badillo eventually let the woman and her children, who remained in the van during the whole ordeal, out of the vehicle. The woman immediately called police and a citywide search began.

The following day, Badillo broke into another house in downtown Anchorage. He ran away when the family returned home, and police arrested him a short time later near North Star Elementary.

The BC Supreme Court has ruled against designating child killer Allan Schoenborn as a “high-risk accused.

The judge ruled against giving the designation, finding Schoenborn was under psychosis at the time of the brutal killings.

The judge found Schoenborn’s psychosis has been in remission for two years, and that although he has anger issues, he said he was satisfied that Schoenborn’s mental illness was improving and he doesn’t pose enough of a risk of causing grave harm to another person to be declared ‘high risk.’

Schoenborn’s next court appearance in front of a review board will be in November

Outside the court, family members of Darcie Clarke, the mother of the three children killed, were visibly upset.

“He is a threat, and I am scared because I live in the area, I live close to [the] Colony Farm [psychiatric hospital] and I don’t want to turn around and see him behind me in the line in the supermarket,” said Dacie’s sister Stacy.

And there has [sic] been escapes from Colony Farm, and one recently, and the person went to Merritt. And my cousin was scared, and my aunt was scared, because they thought maybe that person was sent by Alan Schoenborn. Our fear is real. What he did was heinous. And he shouldn’t be able to walk the streets. He should be in care for the rest of his life.”

Schoenborn’s lawyer Rishi Gill said that his client is a long way from completing his treatment.

“Clearly Mr. Schoenborn has issues, and that’s to put it lightly,” he said.

“Clearly he was also someone who was, and has been for a long time, extremely mentally ill and that’s being dealt with, and clearly his treatment needs have to keep going and it was never argued otherwise by anyone, and I think at the end of the day the court found that was a reasonable position to take.”

Crown prosecutors have been working to have the high risk accused designation applied to Schoenborn since 2015.
The label was added to the Criminal Code in 2014, and applies to people who have been found Not Criminally Responsible (NCR) of a crime due to psychological reasons.

A young man who had been drinking before his car struck and killed a pedestrian in Leamington has lost his licence for one year and must pay a $2,000 fine.

Jamie Redekop was convicted of impaired driving but found not responsible for the death of 55-year-old Robert Wallingford.

“I’m really sorry for what happened,” Redekop, 20, said in court Monday. “There was no intention for this to happen.”

Wallingford died in hospital on Jan. 11, 2015, after he was struck by Redekop’s red Chevrolet Cavalier in the area of Fox Street and Askew Street.

The collision happened around 8 p.m. Wallingford, a father of four and grandfather of seven, had been walking near his home.
