Just a note. Not as regards who should get a ticket, but if there was a lawsuit over the accident, many states have a doctrine making "the last clear chance to avoid an accident" either the standard for, or a defense against, liability.

That might be the answer Boomster's looking for. Yeah, she was wrong, legally, but some states place a duty on the driver to avoid accidents even when they are in the right, if they can safely do so.

Does that sound like the sort of thing you might be shooting for, Boomster?

Also, the "he was being a dick" could go to contributory negligence.

All the Trucker had to do is let up off the accelerator vs being an aggressive driver.

The "Last Clear Chance" counted in Quebec when I first got a driver's licence. That prevents idiots from charging ahead and conciously causing an accident because they have the right of way.

She was clear to make her lane change, was doing so gradually and the trucker accelerated to block her. Passing on the right is stupid and generally not legal but goaltending your territory on the road is psychopathic.

I agree wit Boomer if the truck had slowed just a little the whole thing could have been avoided.She also could have balanced her speed better, both are to blame

hmmm. merging is merging and can be dangerous.

I've been driving for 25years and have never been in an accident that I've caused. I've only been in 2 accidents and both times I was re-ended while waiting for the light to change to green.

I think driving standard helps. To me it looks like the truck sped up once he saw what the car had indicated it was going to do. I usually wait to see if the person I'm trying to get in front of is going to do that exact thing. In Vancouver, there's always an azzhat who doesn't want to be .5seconds behind and will speed up to avoid you getting ahead of them.

My opinion is, even though the car signaled its intent and tried to maintain a safe distance, unless this video is presented to the judge, the car's driver will be charged for making a lane change not in safety. The car did everything right. The trucker was just a moron....
