I'm a kind and generous guy. I was proposing giving the convict the choice between death, life, and surgical castration followed by at least a year of institutionalized therapy until at least two psychiatrists recommend release. In theory, that last option still does not guarantee release anytime in the person's life even after castration since he would still need the recommendation of at least two psychiatrists in addition to the surgical castration followed by at least a year of institutionalized therapy.

I believe in choice! :)



and the 18 yr old caught banging his 14 yr old girl friend? He has the choice between those 3 also.

As for an eighteen-year-old banging a 14-year-old, we could consider the OP as the maximum sentence. We could consider allowing a judge discretion in reducing the sentence. Where it was consensual and the guilty party is particularly young, maybe a year of prison.

You never said any of that in the op. You didn't say "upto this", you said these are the choices. Period. Nothing about discretion.

Now that I've given it more thought, an 18-year-old isn't a child. If an 18-year-old has sex with a 14-year-old, yes, let's give him the options in the OP. Death, life in prison, or castration. That would serve as an effective deterrent. I can guarantee that any 18-year-old would give it some damn serious thought then.

But why waste a shed?

If a person is convicted of having sex with another person under the age of fifteen or who sexually assaults a person, the judge should give him one of the following options:

1. Death.

2. Life in prison (with the option of requesting death at a later date should he wish to do so).

3. Surgical castration (gonadectomy if male, oophorectomy if female)followed by at least one year of institutionalized therapy until at least two psychiatrists recommend the offender's release.

Every situation has to be judged on it's own merits. This is a situation that lends itself to the old adage - "there's an exception to every rule". Should the 18 year old suffer a disproportionate sentence to that imposed on a guy 17 years 11 months?

Many shrinks say the same thing. THey claim it is about power. I'm not convinced.

That is only 4 years age difference. In two years, still having the same age difference it is legal. And until not very long ago 14 was legal in Canada so again with a stroke of a pen we have made a legal activity illegal for no apparent reason.

100 years ago men in their 30s married women 14 years old consentually. It was acceptable then. Now we are going to the opposite extreme where women aren't having children until their late 30s or older and quite often as a result giving birth to a lot of f**ked up kids, where Down's syndrome is only the tip of the iceberg.

I don't think there is a cure for child molestation/rape. It is like expecting a gay person to become hetrosexual.

Lock them up for life, but in a prison with only these type of people in it. It is something they are born with, and should not be treated like animals. (Something like an internment camp.)

For a second offense, the judge should give the offender only options 1 and 2.

In addition to this, should a female offender have caused her male victim to impregnate her during the assault, the male victim could register (even retroactively) the fetus as a human life starting at conception, meaning that any attempt on the abuser's part to abort the fetus other than for medical reasons could lead to a charge of murder which would then leave her with only two options:

1. Death.

2. Life in prison (with the option of requesting death at a later date should she wish to do so).

Should a male offender impregnate a female victim, then he should automatically be given only two options:

1. Death.

2. Life in prison (with the option of requesting death at a later date should he wish to do so).

The above might seem harsh; but when we consider the harms of sexual abuse to mental health and to society in general, we need such a harsh deterrent.
