what is wrong with the crown,and should they be reported to their governing body?
it is evident the victims were poorly guided through the Justice system,"ill prepared and set up"
,normally i would not question or find obvious in the situation but i have noticed "a trend"exampling itself in law proceedings such as sexual assault trials,so much so,I may be the one to report the Crown for investigation, I am certain the investigation would vindicate what I know.

You're right, the crown screwed up. They should have known all of this well before hand. Now they are just looking like rank amateurs right out of law school. They are going to lose what should never have been brought to trial in the first place, based on what is comings light now.

I think we got an inkling of that the very first day of the trial. It will be interesting to see how he is regarded after the trial is over. (in a day or two)

I wonder if the three complainants can be charged with public mischief! Too bad there isn't an infraction called "public stupidity"! I wonder how many "$millions have been eaten up by their stupidity!

It's not the complainant. It is the crown prosecutor that decided to take these complaints to trial.

I've been reading some of the released cross examination. These women may have been assaulted, but they did themselves no favours by colluding with one another. I will be amazed if they can get one conviction out of this.

I agree; it seems fairly clear that they were assaulted, but the women really hampered their own case by their subsequent behaviour.
That doesn't excuse what he did, just makes it harder to get a conviction.

The judge presiding over one of the year’s most high-profile criminal trials is no stranger to hot-button issues.


Three years ago, Ontario judge William Horkins ruled that police street checks — also known as carding — were unconstitutional, a debate that carries on among many police forces to this day.


He nonetheless allowed the gun found during a carding stop to be entered as evidence and found the accused guilty of unauthorized possession of an unauthorized firearm.


Horkins was called to the bar in 1980 and served as both a Crown attorney and a defence lawyer before he was appointed to the bench in 1998.

Yeah, totally.............................well maybe not, seeing there's no boundaries to the stupidity in the legal system! :)

At least we can comment on this form, CBC is protecting this creep.

I think this is heading to an acquittal. If this were a jury trial and I a member, I would have to say that the Crown has failed in its burden of proof. The defense is supposed to make its closing statements tomorrow.

No way this judge is dumb enough to not recognize that this is simply a case of who's the smarter lawyer. He's guilty of assault, no matter how it is spin.

I was sure of that too, now nowhere near so much. He is probably guilty of consentual assault, but I'm not sure that's a crime! :)

I think he is guilty as charged, JLM but he won't see a day in the clink because the Crown was unprepared for the duplicity of their witnesses. There was something like 5,000 emails exchanged between Decoutere and another witness. Now to me, that borders on collusion.

Where was the due diligence? The Crown had to have access to all the same materials as that of the defense. Why weren't these discrepancies in the testimony caught earlier? Why didn't the Crown know about the emails?

finally we agree,
the bigger problem,seems to be some strange symptoms which are consistant with the crown purposely and intentionally handling sex assault cases in a careless manner,in which the victims are presented as victimized all over again,canadians need a nation wide assessment to determine the factors which influence such a poor design.
