Mueller's top critics want the memo out

Several Republican congressmen — many of whom have been highly critical of the special counsel Robert Mueller, the FBI, and the investigation into Trump's ties to Russia — have released statements calling on the House Intelligence Committee to declassify and release Nunes' four-page memo.

The executive branch would have to review the document before it could be released to the public, but "this could happen real quick," Rep. Jim Jordan told Fox News on Thursday.

"Chairman Nunes is committed to getting this information to the public."
The document purportedly describes classified information Nunes obtained from the FBI and Justice Department as part of his investigation into whether the Obama administration misused the Foreign Intelligence Surveillance Act to spy on Trump and his associates during the presidential transition.

"The House must immediately make public the memo prepared by the Intelligence Committee regarding the FBI and the Department of Justice," said Rep. Matt Gaetz, a Florida Republican who has called on Mueller to resign. "The facts contained in this memo are jaw-dropping and demand full transparency. There is no higher priority than the release of this information to preserve our democracy."

Rep. Ron DeSantis, who has introduced legislation that would curtail Mueller's mandate and budget, said in a statement on Thursday that "the classified report compiled by the House Intelligence is deeply troubling and raises serious questions about the upper echelon of the Obama DOJ and Comey FBI as it relates to the so-called collusion investigation."

The figure surfaced as lawmakers have been pressing for answers after revelations that the FBI “failed to preserve” five months of texts between Peter Strzok and Lisa Page.

“We will leave no stone unturned to confirm with certainty why these text messages are not now available to be produced and will use every technology available to determine whether the missing messages are recoverable from another source,” Sessions said in a statement provided to Fox News. “If we are successful, we will update the congressional committees immediately.”

“After reviewing the voluminous records on the FBI’s servers, which included over 50,000 texts, the Inspector General discovered the FBI’s system failed to retain text messages for approximately 5 months between December 14, 2017 to May 17, 2017,” Sessions said.

FBI Director Chris Wray threatened to resign as Attorney General Jeff Sessions called on him to fire his outgoing deputy, Axios reported Monday.
CNN previously reported Deputy FBI Director Andrew McCabe told other senior FBI officials months ago that he planned to retire in the near future, is eligible to retire in March and, under FBI rules governing accumulated leave, may be able to exit earlier. McCabe has taken fire publicly from President Donald Trump and his allies in recent weeks over the FBI's handling of the Hillary Clinton email investigation and his connections to anti-Trump messages sent between two FBI employees during the campaign.

The Axios report, based on three unnamed sources, said Sessions was pressuring Wray to fire McCabe, and that one source familiar with the situation said Sessions conveyed to White House counsel Don McGahn how upset Wray was about the request, and that McGahn in turn said it wasn't worth losing Wray over.
In a statement responding to the Axios report, White House Principal Deputy Press Secretary Raj Shah did not address its reporting specifically, but instead reaffirmed Trump's respect for the agency and its leader.
"The President has enormous respect for the thousands of rank-and-file FBI agents who make up the world's most professional and talented law enforcement agency," Shah said. "He believes politically motivated senior leaders, including former Director (James) Comey and others he empowered, have tainted the agency's reputation for unbiased pursuit of justice. The president appointed Chris Wray because he is a man of true character and integrity, and the right choice to clean up the misconduct at the highest levels of the FBI and give the rank and file confidence in their leadership."
Asked about the Axios report in an interview on CNN's "Cuomo Prime Time," White House counselor Kellyanne Conway declined to respond and said she had no direct knowledge of direct conversations between the attorney general and the FBI director.
"I am certainly not discussing what Attorney General Sessions and Director Wray discuss on the job," Conway said. "I would have no direct knowledge of that."
Trump has publicly called on McCabe to step down and tweeted repeated attacks on the FBI official.
In one December tweet, Trump said, "FBI Deputy Director Andrew McCabe is racing the clock to retire with full benefits. 90 days to go?!!!"
McCabe took on heightened scrutiny and criticism as news surfaced early last month that FBI agent Peter Strzok had been removed over the summer from the special counsel investigation led by Robert Mueller after Mueller learned of anti-Trump messages Strzok had exchanged during the campaign with Lisa Page, an FBI lawyer who also was assigned to the Mueller investigation.
In an August 2016 message, Strzok made an apparent reference to a discussion in McCabe's office.
A new cache of messages between Strzok and Page were delivered to Congress last Friday, according to Wisconsin Republican Sen. Ron Johnson. The senator asked in a letter on Saturday if the FBI has any records of messages exchanged from December 14, 2016, to May 17, 2017, which the Justice Department said were not preserved due to a technical glitch.

The Justice Department is currently investigating how and why the messages were lost, and will determine if they were purposefully destroyed.

Attorney General Jeff Sessions on Monday announced the Justice Department will investigate missing text messages sent between two FBI agents critical of President Trump, joining the chorus of Republican lawmakers who are eager to recover the exchange.

GOP officials have seized on the messages as evidence of FBI bias against Trump in the probes into Russian election meddling and Hillary Clinton's use of a private email server while secretary of State.

“We will leave no stone unturned to confirm with certainty why these text messages are not now available to be produced and will use every technology available to determine whether the missing messages are recoverable from another source," Sessions said in a statement.

"I have spoken to the Inspector General and a review is already underway to ascertain what occurred and to determine if these records can be recovered in any other way. If any wrongdoing were to be found to have caused this gap, appropriate legal disciplinary action measures will be taken," he continued.

An investigation revealed that FBI agent Peter Strzok and FBI lawyer Lisa Page had privately sent disparaging text messages about Trump during the presidential race. Special counsel Robert Mueller removed the two officials from his team after the exchanges became known.

The FBI told lawmakers in a Sunday letter that the bureau did not have a record of messages exchanged over a roughly five-month period between Strzok and Page, citing problems with the bureau's issued mobile phones over “rollouts, provisioning, and software upgrades.”

"The Inspector General has been reviewing these texts based on 'allegations that Department or FBI policies or procedures were not followed … and that certain underlying investigative decisions were based on improper considerations,'” Sessions said.

Republicans now are also eager to hunt down the missing back-and-forth, between Dec. 14, 2016, and May 17, 2017.

“Six congressional committees made a request to the Department of Justice for FBI text messages between two FBI employees from July 1, 2015 to July 28, 2017, which the Department agreed to produce as quickly as possible," the attorney general noted in his statement.

"If we are successful, we will update the congressional committees immediately.”

Also Monday, three Republican House committee chairmen — Judiciary's Bob Goodlatte (R-Va.), Oversight's Trey Gowdy (R-S.C.) and Intelligence's Devin Nunes (R-Ca.) — issued a joint statement on Monday expressing further concern about political bias among top FBI and Justice Department officials, calling the contents of the private text message records "extremely troubling."

GOP Rep. Lee Zeldin (R-N.Y.) also urged Congress to subpoena the cellphone carriers in an effort to retrieve the messages.

“Congress must do everything it can to recover these critical text messages, including subpoenaing Strzok and Page’s cell carriers and requesting the FBI perform a full forensic exam of their employees’ phones in an attempt to recover the messages,” Zeldin said in a statement

Republicans have also sought to draw attention to the text messages as a sign that the investigation is politically motivated against the president, while Democrats accuse their colleagues of attempting to undermine the Russia probe that is looking into ties between Trump campaign aides and Russia.

The president and his allies have also described Mueller's Russia investigation as a "witch hunt."

Rep. Jim Jordan of Ohio, during testimony from FBI Director Christopher Wray, demanded to know if anti-Trump FBI agent Peter Strzok used the dossier to justify obtaining a surveillance warrant from the secretive Foreign Intelligence Surveillance Act (FISA) court.

“Director, did Peter Strozk help produce and present the application to the FISA court to secure a warrant to spy on Americans associated with the Trump campaign?” he asked, though Wray declined to answer that question in a public hearing, suggesting he would rather discuss the answer during a closed-door session.

“Let’s remember a couple of things about the dossier,” Jordan said. “The Democratic National Committee and the Clinton campaign, which we now know were one and the same, paid the law firm who paid Fusion GPS who paid Christopher Steele who then paid Russians to put together a report that we call a dossier full of all kinds of fake news, National Enquirer garbage and it’s been reported that this dossier was all dressed up by the FBI, taken to the FISA court and presented as a legitimate intelligence document — that it became the basis for a warrant to spy on Americans.

“The easiest way to clear it up is tell us what’s in that application and who took it there,” he said.

The Ohio Republican added: “Here’s what I think — I think Peter Strozk … Mr. Super Agent at the FBI, I think he’s the guy who took the application to the FISA court and if that happened, if this happened, if you have the FBI working with a campaign, the Democrats’ campaign, taking opposition research, dressing it all up and turning it into an intelligence document so they can take it to the FISA court so they can spy on the other campaign, if that happened, that is as wrong as it gets.”

Later, during an appearance on Fox Business‘ “Lou Dobbs Tonight” program, Jordan said he believes that the FISA court application used to open surveillance on the Trump campaign will prove that the FBI used the discredited dossier to essentially spy on a rival political campaign.

“There are a couple of fundamental questions here. Did the FBI pay Christopher Steele? I asked that of the Attorney General two weeks ago he wouldn’t answer the question. Did they actually vet this dossier?” he said.

CIA Director: ‘I haven’t seen’ proof of Russian interference claims

CIA Director Mike Pompeo has said he hasn’t seen any evidence of Russian interference in the US election, but that the Trump administration took the allegations very seriously.
During his first interview with CBS News at CIA headquarters, Pompeo was asked whether he had seen any evidence of collusion between members of the Trump campaign and Russian officials.
