Calgary police ID man charged in fatal gas-and-dash

Calgary police have identified the man charged in connection with the death of a gas station attendant who tried to stop a gas-and-dash on Sunday.

  • Joshua Cody Mitchell, 20, has been charged with:
  • Criminal negligence causing death
  • Hit and run causing death
  • Dangerous driving causing death
  • Possession of stolen property over $5000
  • Theft

Ashtiana (Maryam) Rashidi, 35, was carried 15 metres on the hood of a 2006 Ford Super Duty pick-up truck, thrown off of it and then run over by the driver, police said.

She died in hospital from head injuries.

Rashidi was a chemical engineer who recently immigrated to Canada from Iran. She leaves behind a husband and a six-year-old son.

Mitchell barricaded himself inside a home for hours before his arrest on Tuesday by Calgary Police Service officers.

A 16-year-old male, who was the passenger of the vehicle, is not facing any charges.

And if they don't, don't make the attendants cover the shortfall. That is likely the only reason she was trying to stop the prick in the first place.

The young lady he killed.. Maryam Rashidi Ashtiani standing next to her husband.

I used to manage a Chevron Gas station in Arlington, Texas.. I had a runner, jumped out to read the plate, called the police and his mother came to the station to pay for the gas..

The mother was 70 years old, and the son 30 years old, still living at home.. what a loser.

I hope they make Alberta pre-pay, because you can't rely on gas companies or corporations to do the right thing if you ask me..

I wonder how long he will get in prison.. the guy who shot the RCMP in Alberta is free.. Canadian justice.

The charges are not biggies. 10 years if he gets a tough judge would be my guess.

And agree on pay first. I do anyways as it is easier.

Providing he's found guilty of course, I hope they lock the little c/s away for the duration. Too much of this sh*t is going on the message isn't getting out there!

How many gas station owners give a damn about laws when there are a hundred people waiting for the job?

I don't see how the gas station owner is at fault!

Northern Ontario,
I looked and the article doesn't say who owns that service station
I'm almost willing to bet that the owners are pakistani...
Here in town, the Shell station tried that on a poor attendant that had a runner, dunno if the fact that the girl was Indian (from India) had anything to do with it....but they held her wages for the amount of the runner
My son, who used to run a service station before, gave her a contact # and address....dunno what came of it....i'll have to ask him the next time I see him.

I don't see how the gas station owner is at fault!
My above post shows why....the policy of garnishing the wages of the employee is against the law!

From what I can there is one person who is 100% guilty of all aspects of this tragic event. The accused was already free on bail for a previous charge of dangerous driving, then he allegedly decides to steal a vehicle, steal gas and then run over the person in pursuit. How can anyone else possibly be at fault for this catastrophe? Put the blame 100% where it belongs.

The attendant probably wouldn't have been pursuing had she not been on the hook for the shortfall.

The gas station owners will give a damn about this:

Alberta Human Rights: Employment standards

Violations are assessed by the Employment Standards office, if the 'owner' does not comply or appeals, the employee is represented by a QC (read: Queens Council - read: one of the big boys).

See below....
If I was the husband I'd sue the company"If it was their policy to garnishee the employee"... that would make them partly to blame for the incident...

No company, regardless of the industry can force an employee to cover shortfalls... It is against employment law

Like I said: How many give a damn? It's easy to make it word against word - and the judge hears cash best

With the predominance of security cameras in gas stations, I'd like to know why she felt compelled to make the attempt?

Centex gas station.. you know, the one owned 95% by East Indians, 16th Avenue in northwest.

Not to sound racist, but East Indians own damn near every corner gas and taxi in Canada..

Also if they can get away with paying you cash so they don't have to pay workmans comp, and follow the laws.. they sure will.

Possibly not but that in no way reduces the responsibility of the brat. There's a simple solution we've used here for about 10 years. The pump doesn't get turned on until you pay.

The company is zero percent to blame for the accident and I think you might be wasting your time suing. :)

I could think of a few reasons to go after the company...

1. It was in the evening, generally two employees are working evenings at most gas bars, was she working the night shift alone??

2. Was she sufficiently trained, this was after all her 3rd day on the job. She obviously was not trained enough.

3. Evening shift at most gas stations in Texas are pre-pay, days depends on station. Did the gas station consider employee safety in the evening and have pre-pay??
