So all my firearm experience is with long guns I don't know handguns at all maybe someone here can answer this for me.

If Baldwin used a piece as pictured, pulled back the hammer and then it slipped would that discharge the pistol?

TAOS — Some of the people who handled guns on the set of Alec Baldwin’s movie “Rust” may face criminal charges in the fatal shooting of a cinematographer, the New Mexico district attorney said on Friday.

Mary Carmack-Altwies said in a statement that she had not made any decision yet on charges but that everyone involved “in the handling and use of firearms on the set had a duty to behave in a manner such that the safety of others was protected.”

Once the investigation is complete “certain individuals may be criminally culpable for his/her actions and/or inactions on the set of ‘Rust’,” she added.

Carmack-Altwies gave no indication when the investigation might conclude.

Her statement followed a television interview on Thursday by Baldwin, who was holding the gun when it fired a live bullet and killed cinematographer Halyna Hutchins and wounded director Joel Souza during a rehearsal in October on a ranch near Santa Fe.

Baldwin said in the interview that he did not believe he was responsible for Hutchins’s death and that he did not think he would be criminally charged. The actor had been told by a crew member that the gun was safe.

“I feel someone is responsible for what happened, but I know it isn’t me. I might have killed myself if I thought I was responsible, and I don’t say that lightly,” Baldwin told ABC television’s George Stephanopoulos in his first public comments on the accident.

“I’ve been told by people in the know… that it is highly unlikely I would be charged with anything criminally,” said Baldwin, who has been interviewed by the investigators.

Baldwin said that as an actor he was not responsible for checking the gun, or what it was loaded with. He also said he did not pull the trigger but the revolver fired as he cocked the gun while practicing a shot.

“I let go of the hammer of the gun and it goes off,” he said in Thursday’s interview.

Authorities in Santa Fe have been focusing their attention on how live bullets found their way onto the set.

An attorney for armourer Hannah Gutierrez, who was in charge of weapons, has said she checked the gun before it was handed to Baldwin by assistant director Dave Halls, who shouted that it was “cold” or safe.

LOS ANGELES — Alec Baldwin has deleted his Twitter account, just a few days after he conducted his first in-studio interview about the fatal shooting on set of his movie “Rust.” His wife Hilaria Baldwin followed suit and deleted hers as well.

The @alecbaldwin Twitter account was first noticed missing late Sunday night. That was the same account Baldwin used to release his first official statement regarding the accidental “Rust” shooting that killed cinematographer Halyna Hutchins and injured director Joel Souza

By Monday morning, Hilaria Baldwin’s Twitter account @hilariabaldwin was also deleted, as was the account for the Hilaria and Alec Baldwin Foundation @ABFalecbaldwin.

Only one verified Twitter account remains for Alec Baldwin, @AlecBaldwln____, though it says in the bio that it’s a “social media phantom limb” and it hasn’t ever mentioned the “Rust” tragedy.

The last time the account tweeted was on Oct. 19, just two days before the accidental shooting, and before that on June 12, so it appears to be inactive as of now.

Both verified Instagram accounts for Alec and Hilaria Baldwin remain online and are actively posting as recently as Sunday.

The Twitter accounts being deleted comes just a few days after Baldwin appeared on ABC with George Stephanopolous to talk about the “Rust” tragedy for the first time on-air in a studio. The actor broke down in tears multiple times as he answered questions about why he pointed a gun at Hutchins, though he denied pulling the trigger.

“I let go of the hammer of the gun, and the gun goes off,” he said.

Baldwin has been sued twice, by the film’s gaffer and the script supervisor, but he said in the interview that he think it’s unlikely he’ll be charged criminally.

As a matter of fact You shouldn't point even an unloaded firearm at anyone unless you are ready to use it should the need arise!

TAOS — Police obtained a search warrant on Thursday for actor Alec Baldwin’s cellphone in the investigation of October’s fatal shooting of a cinematographer on the New Mexico set of his Western movie “Rust,” court documents showed.

The search warrant and accompanying affidavit were filed in Santa Fe County Magistrate Court nearly two weeks after a prosecutor overseeing the probe said that some people who handled guns on the film set may end up facing criminal charges stemming from Halyna Hutchins’ death.

The warrant authorized investigators to seize Baldwin’s Apple iPhone in order to examine text messages, email correspondence, social network communications, browser activity and other information stored on the device, according to the documents.

A sheriff’s detective, Alexandria Hancock, said in her affidavit that she sought a court order requiring Baldwin to turn over his phone after she had requested it from the actor and his attorney on a voluntary basis and “was instructed to acquire a warrant.”

Neither the warrant nor the seven-page affidavit cited any particular material that investigators were looking for on Baldwin’s phone.

But suspects, victims and witnesses “often make and/or receive telephone calls and/or messages before, during and/or after the commission of crime(s). Such information, if it exists, may be material and relevant to this investigation,” the affidavit stated.

It added: “There were several emails and text messages sent and received regarding the movie production ‘Rust’ in the course of (police) interviews” following the Oct. 21 shooting.

Baldwin has acknowledged he was holding a Colt .45 revolver pistol on the film set when it went off during rehearsal, discharging a live round that struck Hutchins in the chest and killed her. Director Joel Souza was wounded.

But the actor said during a television interview that he never pulled the trigger, and he denied responsibility for the shooting. He also said then that he had no idea how a live round got onto the set of the film.

According to detective Hancock’s warrant, the film’s “armorer,” Hannah Gutierrez-Reed, who was in charge of weapons on the set, said under questioning that she had loaded the gun with what she believed were six “dummy rounds” before the ill-fated rehearsal earlier that day.

Gutierrez-Reed also recounted having trouble inserting the sixth round into the gun’s cylinder, managing to fit it only after she “cleaned ‘it’ out,” the affidavit said.

TAOS — New Mexico authorities on Thursday said they were working with police in New York state to obtain material from actor Alec Baldwin’s cellphone relating to a probe into the fatal shooting of a cinematographer on the set of Western movie “Rust.”

The sheriff’s office in Santa Fe County and the New Mexico First Judicial District Attorney’s Office said they were working with the Suffolk County, New York Sheriff’s Department and Baldwin’s lawyers to get any materials on the phone pertaining to their investigation.

The statement came nearly three weeks after the Santa Fe sheriff’s office got a search warrant to seize Baldwin’s Apple iPhone to examine text messages, email correspondence, social network communications, browser activity and other information stored on the device, according to court documents.

A spokesman for the Suffolk County Sheriff’s Department and a lawyer for Baldwin did not immediately respond to requests for comment.

Baldwin has a home in the area of Amagansett, Suffolk County, towards the eastern tip of Long Island, New York.

The New Mexico prosecutor overseeing the probe last month said some people who handled guns on the film set may end up facing criminal charges stemming from Halyna Hutchins’ shooting death in October.

The armourer overseeing weapons used in the filming of the Western “Rust” sued the prop supplier on Wednesday, alleging his company distributed live ammunition on the set where police say actor Alec Baldwin fired a round that killed cinematographer Halyna Hutchins.

Armourer Hannah Gutierrez Reed, 24, is seeking unspecified damages from prop provider Seth Kenney and his company, PDQ Arm and Prop LLC, according to the lawsuit filed in New Mexico state court.

Kenney could not be reached for comment. In a December interview with ABC News, Kenney denied that live rounds on set came from his company.

The Oct. 21 shooting is under investigation by authorities in New Mexico and has rocked show business, claiming the life of a rising star of a cinematographer and wounding the film’s director, Joel Souza.

Reed’s suit says she recalls loading the gun with rounds labeled as dummy ammunition, shaking the box to create the signature jingling sound that the inert rounds should make.

“To the best of Hannah’s knowledge, the gun was now loaded with 6 dummy rounds,” the suit said.

The suit also says she had given up control of the gun for 15 minutes before the shooting because COVID protocols kept her out of the church where the shooting took place. The shooting was not captured on film, as Baldwin was practicing for a scene to be shot later.

“The ammunition was misrepresented as only dummy ammunition when it contained both dummy and live ammunition,” the suit said. “Defendants distributed boxes of ammunition purporting to contain dummy rounds but which contained a mix of dummy and live ammunition to the Rust production.”

Baldwin told ABC News he did not pull the trigger, saying the Colt revolver went off when he was cocking the gun and rehearsing camera angles with Hutchins.

LOS ANGELES — A lawyer for Alec Baldwin on Thursday said the actor would hand over his cellphone as part of a probe into the fatal shooting of a cinematographer on the movie set of Western “Rust,” but police in New Mexico said they had yet to receive the device.

Baldwin’s lawyer, Aaron Dyer, said he had reached a deal with New Mexico authorities to turn in the phone after steps were taken to protect the actor’s privacy regarding matters unrelated to the “Rust” investigation.

“Mr. Baldwin’s phone is being turned over this week for review,” Dyer said in a statement. “Mr. Baldwin has continued to cooperate with the authorities, and any suggestion to the contrary is simply untrue.”

The comments followed a Thursday news release from the Santa Fe County Sheriff’s Office saying Baldwin had not complied with a search warrant requesting he hand over the phone and that a New Mexico prosecutor was now working with the actor’s lawyer to get it.

“To date, the cell phone has not been turned over to authorities,” the news release said.

LOS ANGELES — Actor Alec Baldwin has handed over his cellphone to investigators who are looking into the fatal shooting on the New Mexico set of the film “Rust” in October, his attorney and a law enforcement official said on Friday.

A search warrant for Baldwin’s iPhone was issued in December. The Santa Fe County, New Mexico, sheriff’s office had said earlier this week that it was still trying to obtain the device from the “30 Rock” actor.

On Friday, sheriff’s department spokesperson Juan Rios said via email that Baldwin’s phone had been turned over to authorities in Suffolk County, New York, who were in the process of downloading relevant data to send to investigators in Santa Fe.

LOS ANGELES — Attorneys for Alec Baldwin and other producers of the movie “Rust” are asking a court to dismiss a civil lawsuit filed by a script supervisor who was on the set when the actor fatally shot a cinematographer.

In a filing in Los Angeles Superior Court on Monday, the attorneys said the claim by Mamie Mitchell should be thrown out because there was no evidence that Baldwin or any of the producers intended harm. Baldwin was the lead actor and a producer of the independent film, a Western.

“Despite Plaintiff’s attempt to label claims as intentional, nothing about Plaintiff’s allegations suggest that any of Defendants intentionally committed harmful conduct,” the filing said.

Mitchell claimed in a lawsuit filed in November that Baldwin should have checked the Colt .45 revolver he was holding to make sure it did not include live ammunition. Baldwin has said the assistant director told him the gun was “cold,” or safe to use and that he did not pull the trigger Mitchell, who said she was in the line of fire, alleges assault, intentional infliction of emotional distress, and deliberate infliction of harm and is seeking unspecified damages in the lawsuit filed in Los Angeles Superior Court.

Cinematographer Halyna Hutchins was killed and director Joel Souza was wounded when the gun discharged as Baldwin was rehearing on the New Mexico film set.

Mitchell, who said she was in the line of fire, alleges assault, intentional infliction of emotional distress, and deliberate infliction of harm, and is seeking unspecified damages in the lawsuit filed in Los Angeles Superior Court.

Gloria Allred, Mitchell’s attorney, said on Tuesday that the claim should be allowed to proceed.

The producers are “trying to avoid explaining their conduct before a judge and a jury in a court of law,” she said in a statement.
