I'm pretty sure you can legally drive drunk on private property.

If I was to open up a ATV park on private land I assume the riders could drink but I would be wise to get them to sign a disclaimer that stops them from suing me should they get hurt while on the property and as long as they leave when they are sober that aspect should be covered also. I think you can drink on a boat if it has a 'bathroom' and you are at anchor..

Yes and no. If you're out in a field that's your property and you're driving while drunk, nobody can do squat. BUT, a driveway is considered part of the "highway traffic act" insofar as it directly accesses public roads. More than a few unlucky souls have been nailed for impaired because they fell asleep in their car in the driveway. As long as the keys are in the vehicle, you can be charged.


However, back to your ATV thing. If it's just a private place for you and your friends to ride, you can get away with drinking, well get away with it from a legal aspect anyway. But if it's a place that's open to the public, then no you can't.

Since my point is that the cop is making cops look silly, he is the guilty individual. The driver is guilty of breaking law. Since the law was created (supposedly) to increase safety, one has to ask what he was doing that was unsafe. While you and the officer may feel texting while stopped in a drive through is unsafe, judging from the outcry on social media, you would be in the minority.

OH?? He must have been the guy I had to run off the road into the ditch because he was drunk and almost hit a family with kids in a black Ford Escape outside Brooks, Alberta..

A real loser, I had to go to court with the family in the other vehicle ... the guy plead out like a loser he was, with all the witnesses showing up.
