As with most people, you are confused between the letter of the law and the spirit of the law. You can take solace in the fact that the police officer probably doesn't know either.
Ah yes. blame the cop, not the guilty person. Ever had your back broken? How about whiplash? If you've already suffered whiplash at some point, you'd be amazed at how a small bump from behind, even in a drive-thru, can just tweak it right up.

Then again, those lost in the leftard-o-sphere just aren't into personal responsibility so it's no surprise you have a problem with this.

Cnuk has had a hate on for cops since his DUI.

I'm pretty sure you can legally drive drunk on private property.

If I was to open up a ATV park on private land I assume the riders could drink but I would be wise to get them to sign a disclaimer that stops them from suing me should they get hurt while on the property and as long as they leave when they are sober that aspect should be covered also. I think you can drink on a boat if it has a 'bathroom' and you are at anchor..

Yes and no. If you're out in a field that's your property and you're driving while drunk, nobody can do squat. BUT, a driveway is considered part of the "highway traffic act" insofar as it directly accesses public roads. More than a few unlucky souls have been nailed for impaired because they fell asleep in their car in the driveway. As long as the keys are in the vehicle, you can be charged.

However, back to your ATV thing. If it's just a private place for you and your friends to ride, you can get away with drinking, well get away with it from a legal aspect anyway. But if it's a place that's open to the public, then no you can't.

The comical thing about this is, the cop probably drove by a dozen princesses texting and talking on the phone during his shift.
But he preferred, to pick the low hanging fruit.

Ah yes. blame the cop, not the guilty person.

Since my point is that the cop is making cops look silly, he is the guilty individual. The driver is guilty of breaking law. Since the law was created (supposedly) to increase safety, one has to ask what he was doing that was unsafe. While you and the officer may feel texting while stopped in a drive through is unsafe, judging from the outcry on social media, you would be in the minority.

It was stated that he was first observed texting while driving and then he pulled into the drive through. Do try to read all pertinent articles so that you can do something completely different and be informed before you comment.

...at which point the cop says he decided to let it go.

In your case, it really doesn't help.

I'll take that response as your admission that youre finally willing to accept that the officer was silly. At the very least, he shouldn't have admitted to letting the driver go for texting on a roadway.

It really is hard to believe that you have managed to learn how to use a computer and get on the internet with your obvious limited mental capacity and abilities.

OH?? He must have been the guy I had to run off the road into the ditch because he was drunk and almost hit a family with kids in a black Ford Escape outside Brooks, Alberta..

A real loser, I had to go to court with the family in the other vehicle ... the guy plead out like a loser he was, with all the witnesses showing up.
