In each one you accused the jogger of burglary in order to keep with the idea that the men were justified in shooting him.
The last burglary in the area: in January.
Video tape showing the jogger in a house under construction has him looking around, not taking anything, nor did the owner of the house say anything had been stolen.
So he stole nothing.
Hence, no burglary.
They chased this guy, and shot him, murdered him. Again, what kind of murder, that's for a court to decide.
