The WSJ editorial board posted an OpEd over the weekend warning of a Souter Trap. David Souter was a G.H.W. Bush appointment with presumably reliable conservative credentials who became a notoriously liberal voice in key cultural decisions before his retirement, notably in support of abortion rights.
The problems it noted with Hardiman was that he was the only candidate not recommended by the Federalist Society (a conservative legal conference) but by Trump's sister, who serves with him on the 3rd Circuit Court of Appeals. He has solid Catholic college degrees (Notre Dame, Georgetown). They also state that Hardiman's legal opinions are not as extensive or as impressive as Kavanaugh's or Kethledge's. The latter two and especially Kavanaugh are known quantities. Kavanaugh is the only Ivy Leaguer, Kethledge is the only Evangelical in the group of 4.
Amy Coney Barrett in a new appointee to the 7th Circuit. She's a devout Catholic who is a member of charismatic sect of Catholicism (People of Praise). She has 7 children, 2 of whom are adopted Haitians orphaned by the earthquake there. She has impressive law journal publications but a very short list of judicial opinions.
I trust the Federal Society vetting process more than Trump's sister. But Trump likes Hardiman's working class Pennsylvania roots. Its good for the midterms.
I don't know. Frankly Barrett would be the most interesting choice but would create a firestorm in the Senate nomination process. But Trump's never backed away from a confrontation or been unwilling to take a chance.
The USSC will set the example for all other nation's Supreme Court in the West. They are all headed to the right.
